Review: I parked in a 1 hour parking lot around the address of 4516 Mission Blvd in Pacific Beach. I parked my car at 11:50am. When I returned 1 hour later, my car had been towed. When I confronted the security officer, [redacted], who was patrolling the parking lot, he stated I had been over my time limit by 2 minutes, and that he had my car towed at 12:52pm. He showed me his patrolling log, which showed my arrival time as 11:50am and a tow time of 12:52pm. When I went down to Western Towing, they printed out a full record for me showing that [redacted] had actually given Western Towing false information, stating I arrived in the parking lot at 11:45am, not 11:50am as he had written down on his log and had showed me as well. In addition, [redacted] called Western Towing at 12:30pm requesting my car be towed from the premises, even though I had 20 minutes remaining in the lot. I spoke with [redacted]'s manager, [redacted], who stated that the security patrols the lot every 30 minutes. The 1st round he writes down license plate numbers, the 2nd rough he makes note if that car is still there, and the 3rd round, which would be 1 hour later, if that car is still there, THEN he can call a tow company to have the car removed. Therefore, [redacted] not only falsified information, but also did not do his job correctly and requested my car be towed too early. [redacted] said the whole process takes about an hour and a half or so, yet the tow was initiated at 12:50pm and taken off premises at 12:55pm. I arrived at Western Towing at 1:08pm, and had to wait until 1:18pm when my car was dropped off and spend another 40 minutes there while they completed their towing paperwork before they could start on the paperwork to actually release the car to me. Due to the falsified information given by [redacted] to Western Towing, the request by [redacted] to Western Towing before my 1 hour time slot in the parking lot, and for the early initiation of towing, I am requesting they rectify this matter through reimbursement.Desired Settlement: I am only asking for reimbursement of the $314 towing fee. I would hope we can resolve this peacefully and without escalating it further. If so, I would then need to ask for refunds for grievances for time wasted on my part, including time and money spent going from the parking lot to Western Towing, and any other time spent dealing with this matter. I contact [redacted] last week and left her a voicemail that this issue will have to be resolved in small claims court by all our records the vehicle was parked and towed after one hour.

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.

[Per the paperwork from Western Towing, you can clearly see that [redacted] falsified information. He lied to Western Towing stating he first saw my car in the parking lot at 11:45am, however, on his clipboard form he wrote down 11:50am, which he showed to me. Therefore he lied to Western Towing giving them an earlier time in order to get my car towed from the parking lot early. In addition, [redacted] informed me on the telephone on Monday October 28th that the parking attendants are not allowed to call until the car is after the 1 hour mark of being parked in the same spot. They make rounds every 30 minutes and if the car is there after 2 rounds then they call call for a tow truck. Even if [redacted] hadn't falsified information to Western Towing about what time my car was first seen in the parking lot, he still called them before the 1 hour mark, had a tow truck dispatched too early, and towed my car too early. I am asking for a refund for the towing fee of $314. I think this is more than fair considering I had to incur costs to get to the tow yard, time spent getting there and waiting for my car (I arrived at the tow yard before my car even arrived there!).
