I am responding to complaint ID# [redacted] , this complaint was regarding a refund of $for a deposit on a bus charter that was later canceled This deposit was made with a Visa ending in ***, the customer requested a check be issued for the deposit or credited to another persons credit card and was advised that we could only issue a refund on the credit card that was charged On 6/4/a refund for $was issued to the credit card ending in [redacted] was approved and taken from our accountAfter receiving this complaint our accounting department contacted our bank to see if the funds had been returned to us and were advised that they were not USA did issue a refund to this customer, and the customer's credit card provider did take the fundsI suggest the customer contact their bank and inquire where those funds were put I do apologize for how long it took to process this refund, we consider this issue to be resolved [redacted] Director of Operations USA Bus Charter, Inc Tel###-###-####, Ext [redacted] Direct###-###-#### Fax###-###-#### [redacted] [redacted]

USA Bus Charter Response To Consumer Complaint:Boy Scout Troop [redacted] contracted with USA Bus Charter for charter bus service to be provided on; June 21, During the course of their charter which USA Bus 'arranged' for them, the bus they were riding on broke downPursuant to our contract which this group entered into with USA Bus they agreed to the following below These two sections hold USA Bus harmless from failure of the bus since, USA Bus does not own and operate the buses provided to this clientUSA Bus Charter acts in the capacity of intermediary in providing these services and while we stand by our contract to fulfill each order, we cannot be responsible for situations or events out of our control wherein we are not contractually liable per our contract and agreement with customersAlso, the person making this complaint is NOT the person who entered into this contract and, our contract (section 20) has a non-assignment clause Non-Owned –Affiliate Operated ServicesCompany is an established network providing charter bus services through our network of AffiliatesYou agree in the event you have a complaint based on the quality of service, Equipment, drivers or other area of service beyond the control of Company to direct same to the Affiliate and to hold Company free and harmless from complaints, actions or otherwise since Company does not own or operate Equipment received or employ drivers who may have provided such serviceCompany will provide to you, prior to your charter a direct contact at Company’s Affiliate including name, telephone number and address this will be your point of contact for customer service issues or itinerary changes while your charter is in progress or after the charter has been providedIn the event of unsatisfactory service and/or equipment you agree to provide your complaint or service issues in writing within hours of completion of your charter or your contract will be deemed satisfiedIn the event our affiliate is not able or does not provide or complete your charter bus service for any reason beyond our control you agree to seek any and all eligible refunds or credits from our affiliate EquipmentCompany guarantees that the Equipment which is provided through its affiliates will be the type of vehicle describe on page of the Contract Because the Equipment is being provided through a company affiliate, Company makes no representations as to the age, condition, or suitability of the Equipment Any photographs, web page depictions or descriptions are for a general description and are not meant to imply that the actual Equipment supplied will be of the same color, condition or have the same features as depicted or even substantially similar thereto Our company reserves the right to substitute Equipment with similar Equipment anytime, so long as the replacement equipment can provide adequate transportation for your groupRequests for specially equipped Equipment will be honored to the best of our abilityIn the event Equipment fails to meet the chartering party’s expectations or should break down or fail, you agree to hold our company harmless for any resulting liability or costsWhile we regret the inconvenience this client incurred, we are merely following the terms and conditions we all agreed to pursuant to our contractWe did make a good faith effort to contact the owners of this bus, CM TOURS but they have refused to address this clients complaint and offer any type of credit or refund

In response to complaint [redacted] .After reviewing this, it appears the refund check was processed on April 30th, 2015, however there seems to be a glitch in our accounting office and the person in charge of mailing this check, and in charge of reporting back to the CEO for info, did not mail the check and it was still sitting inside of the folder.This check has since been mailed, and went out over business days agoThis check should without a doubt be arriving to [redacted] any day now.USA Bus Charter does not conduct business in the manner explained in the complaintIf the check does not arrive with one more week, USA Bus Charter will overnight a new check with proof.Thank you

USA Bus Charter works with a nationwide of affiliates, the events that happened are as followsOur account manager Luis Perez received a telephone call from our affiliate the night before service that we had reserved to provide service to MsKingStating that they had made an error and could not
provide service anymore, at this time Luis did everything in his power to locate another charter bus for the service, he was successful finding one however due to the urgency of this matter, the only bus available was located further away, with another affiliate at a higher price.MsKing was notified of the situation and that the error was not in USA Bus Charters control, and MsKin agreed to the extra fee, as well as signing documentation authorizing the additional feeI can send all of this over, as well as our terms and conditions she agreed too, which states any price increases are out of our control, USA Bus Charter will not be held liableThe Revdex.com also has a copy of our terms and conditions on fileThe incident that occurred is unfortunate and saddening, however it was completely out of the control of USA Bus Charter and per our terms and conditions, we complied with our termsWe have also offered MsKing a 20% discount on any future charter with USA Bus Charter. In response to complaint #***. USA Bus Charter does not own, or operate any equipment providedAll equipment is owned by affiliates contracted with USA Bus Charter.USA Bus Charter affiliate, Bell Trans of Las Vegas stated that the group used hour and minutes overtime service,
and at the end of the charter, the group agreed the overtime fees would be comped by Bell Trans, in return for the AC not working on the first leg of the charter.USA Bus Charters affiliate did replace the vehicle on the return.Mr*** agreed to the terms below that I will point out, and I will also include a copy of our contract between Mr*** and USA Bus CharterThe terms he agreed to release liability from USA Bus Charter and it's affiliate, and that any service complaints will me made directly to the affiliate and/or refunds will come directly from the affiliatePlease see below

[redacted]Please see terms below, from the contract between the client and USA Bus Charter.USA Bus Charter is going beyond it's contract, and reaching out to the affiliate to resolve this matter as well. As stated in the previous response, per the affiliate they plan to refund the client. I have also been advised that someone from Checker Elite, Inc has been in contact with a someone from the group. We do look forward to getting this matter resolved, as USA Bus Charter is not liable.  Regards.

[redacted] responded to the information provided by USA Bus Charter that they in fact returned the check as our credit card had already been charged the full amount. In addition, as the charge from [redacted] was quite a bit less, we require our deposit amount to be returned or a receipt/invoice for any “fees” charged to us per our audit requirements. Please see the response from [redacted] attached.Thank you, [redacted]
