I have reviewed the response made by the business in reference to complaint ID 9867788, and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.USA Promotions has not attempted to contact my Father and discuss this complaint at all. The only phone calls he has received are calls to inform him that he needs to give them his new bankcard information so they can continue to take money out of his acct. Never once mentioned this complaint. My Father never said this matter was resolved. The only time he ever said anything remotely like that was when they agreed to close the second order of magazines that he did not order. Yes, that was resolved, but not this matter. I will send a copy of my POA to the Revdex.com and they can inform you of its legitimacy. I do not trust USA Promotions with any of my information. His spoken okay for a company to talk to me should and would have been enough for a reputable company. My name is also on my Father's bank account and has been since we opened it approximately 4 years ago. So, no, he is not solely financially responsible. In case you missed it in my original letter, you are dealing with an at risk adult on many medications that make it difficult for him be the individual solely responsible for his financial affairs. As a matter of fact, one of your sales people called him a name and said he sounded drunk. It is not clear in the last part of your reply, have you canceled all accounts with your company or are you still saying that the first account with him is still open. Because if it is, then this is not resolved.At this point I would like to add that my father is on the National No Call List. USA Promotions is in violation of the Colorado Consumer Protection Act, which states; Under the Colorado No-Call Law, businesses that contact telephone, fax or wireless numbers registered with the No-Call List may be violating the Colorado Consumer Protection Act, unless the call falls within a statutory exemption. Consumers have private remedies, such as a small claims court action, under the No-Call Law, and may recover a minimum of $500 per violation.There is a reason I put him on the No Call List and that was to try and protect him from companies like USA Promotions. I am absolutely ready to file a claim with small claims court. This company has fraudulently and unethically taken advantage of an at risk adult who is on the No-Call List. And if all accounts are not closed and money returned to him immediately, that is what will happen. I'm 100% sure it will not take the court long to see that your company has taken advantage of him. He is also on a very limited income and this is not something he can just absorb. I will make sure the court has a copy of my POA and documentation that I am on his bank account. You can look at it then, but you may not have it in your files.Regards,[redacted]

U.S.A. Promotions has issued a refund for charges made to Mr. [redacted] (XXXXXXXXXXXX[redacted]) in the total amount of$89.78. A check is being issued in the amount of $49.98 for a total refund in the amount of $139.76. Mr. [redacted] has been placed on our do not call list.

U.S.A. Promotions attempted to resolve this matter on several occasions, and the last conversation we had with Mr. [redacted] ended with him stating the matter had been resolved. It is not that we do not believe Ms. [redacted] statement that she is Power of Attorney; rather, it is that we...

require documentation for our records of any entity except the account holder that manages an account holder’s financial affairs. Mr. [redacted] informed us on several occasions that he was the individual financially responsible for himself, and therefore we required proof from Ms. [redacted]. Mr. [redacted]’s first account is completed. We have cancelled his remaining two accounts. Services have been rendered to Mr. [redacted]; therefore, there will be no refund.
