After a thorough search of our records, we cannot find an individual by the name of “*** ***” or a business by the name of “***” being a client

Account *** - American Casualty AuditGroup, Inc Thank you for the additional information. We have had minimal contact with client. We were contacted by *** ***12/19/to add users to the account Next correspondence received was6/4/when we received an updated credit card from Mr***, which thenwas declined yet again in July and August There are no records of anyrequest to close the account We closed the account due to non-payment.The following are the months that a credit card was declinedfor payment owed: 4/20145/20146/20147/20148/2014Our internal collections department was attempting to collecton past due balances owed to LocatePLUS Our contract and our terms andconditions (which each client is required to agree to before they can enter oursite) clearly indicates requests to close accounts must be received in writingand must come from the primary contact The customer cannot provide anyproof of such request. We are an online subscription service. The pricing plan American Casualty AuditGroup agreed to 8/requires a monthly minimum usage requirement. There are no contract dates so the contractdid not “expire” The service isavailable to all clients until they request to cancel. Mr*** does not want to settle his balancebecause he claims he did not use the serviceThis account was not requested tobe closed by the client; we closed the account because of non-payment. Our offer is to clear out the balance owed and part ways

We addressed Revdex.com compliant #[redacted] from [redacted] received 6/8/15.  This same company has now submitted yet another complaint against our business for the same issue (with different scenarios about what occured).   We cleared the $50 balance owed and ceased our business...

relationship but our accounting department continues to receive emails from this company including sending us a previous complaint listed on Revdex.com that we successfully resolved.  An organization with thousands of clients, we have had 2 billing complaints in over 3 years and we feel that does not constitute us as being fraudulent, or requiring further investigation into our business practices.   We do not feel we should have 2 complaints from the same client listed on our company profile and we request the duplicate complaint be removed.

I can't address the issues if I do not have a client matching the information provided to Revdex.com.  Could there be an alternate contact or company name you may have done business with us under?

If all of our terms and conditions were read prior tosigning the contract, the Client would understand how our product works and theterms of the subscription, specifically overages.   We have spoken with the Client, hisemployees and even his credit card company that ultimately sided with[redacted] believing that he was liable for the charges.     We feel strongly if a Client was not satisfiedwith our product or data provided, they would not continue to utilize theservice only to notify us of their dissatisfaction after processing of payment.Specific sections of our agreement which was signed byclient:                “3.PERFORMANCE. [redacted] will use commercially reasonable efforts to deliver the[redacted] Services                 requestedby Customer and to compile information gathered from selected public recordsand other sources                 used inthe provision of the [redacted] Services; provided, however, that Customeraccepts all information "AS                 IS."Customer acknowledges and agrees that [redacted] obtains its data fromthird-party sources, which            mayor may not be completely thorough and accurate, and that Customer shall notrely on [redacted] for the            accuracyor completeness of information supplied through the [redacted] Services….”                 “5.WARRANTIES/LIMITATION OF LIABILITY. …[redacted] does not make and herebydisclaims any warranty,                 expressor implied with respect to the [redacted] Services. [redacted] does notguarantee or warrant the                 correctness, completeness, merchantability, or fitness for a particular purpose of the[redacted] Services or                 informationprovided therein. In no event shall [redacted] be liable for any indirect, incidental, or                 consequentialdamages, however arising, incurred by Customer from receipt or use ofinformation delivered                 hereunderor the unavailability thereof. Due to the nature of public record information, the public records and                 commerciallyavailable data sources used in [redacted] Services may contain errors. Sourcedata is sometimes                 reportedor entered inaccurately, processed poorly or incorrectly, and is generally notfree from defect.                 [redacted]Services are not the source of data, nor are they a comprehensive compilationof the data. Before                 relyingon any data, it should be independently verified. We additionally provide disclaimers on our search results:                 “Thisdata is provided as is. It is not a complete list, either nationally, orstatewide, nor is it guaranteed to be                 correct. The data provided is for informational and reference service purposes only. Itis not to be used to injure,                 harass,or commit a criminal act against any person listed here. For more informationrefer to the Terms and                 Conditions.”  The Client received over 1,000 phone numbers in one month’stime through [redacted]. It is highly unlikely that every, single one of those1,094 Phone Searches yielded inaccurate information. In order to obtain thedata, a full name and address is needed. When conducting this search, allpoints of the data would need to match in order for a telephone number toreturn. It is also implausible that if the Customer received inaccurateresults, they would have continued to run 1,094 phone searches. Furthermore, ifthe Customer believed the phone information to be so inaccurate, when the salesrepresentative contacted the Customer several times as a follow-up courtesy totry and schedule training, it stands to reason that the Customer would havemade this point and actually elect to utilize training. Instead, the Customerdeclined the training on the grounds that the searches were being runcorrectly, liked the results, and did not want to waste time on somethingredundant.

subscriptions works as well as proof the client was contacted when high usage alerts were received, etc.  Our subscription acknowledgment addendum is provided as a separate document and clearly states: ““For each response, Customer agrees to pay [redacted] theapplicable charge then prevailing for Services rendered to Customer. I am also aware that this is an ongoing authorization for all monthly charges and overages incurred while using [redacted] services. Customer will be responsible for the monthly fee which will be charged beginning on the date of account activation. Upon application approval, customer will be billed. Customer shall be responsible for payment for all services obtained through Customer’s access identification code.  Payment shall be via credit card only and such payments will occur by an automatic charge to Customer’s credit card on file for this purpose.”The rate plan the Customer was on was for $59.95 per month. Included exclusively for that $59.95 monthly rate, Customer has unlimited access to the Basic Person Search and the Comprehensive report. There are other searches [redacted]provides free of charge to all customers, such as the SSN verification search, which would also be considered included. All other searches have a price per search. Almost all [redacted] searches are “no hit/no fee” which means that if no results are returned, Customer is not charged.  Customer utilized services during the month the account was active, running a total of 210 included person searches, as well as 1,837 phone searches, 1094 of which were successful.   We provide proper disclosure of the quality of data and site performance of [redacted]’s services on our website.    Disclaimer states: “This data is provided as is. That is not the behavior of an individual who does not care for the quality of the data. It is unfortunate that despite every explanation and opportunity for the Customer tocomprehend that some searches were included and others carried a cost, the Customer claims that they were unaware of this fact. [redacted] always strives to maintain customer relationships and to handle all matters possible in house to reach a resolution that is satisfactory to both parties. We even offer all new customers a 7 day trial period in which they can try the [redacted] Services, and if it is not advantageous for their business, they can cancel their account and get a full refund. This policy was in place at the time the Customer initiated services and had the quality of data not been up to par, the Customer could have elected to cancel at that time for a full refund. The Customer did not do so, and had no complaint about data quality until a bill was received.  It should also be noted that [redacted] staff made roughly 6 attempts to schedule product training with our client.  We provide complimentary trainings to ensure our clients fully understand how the product works, best searching methods, etc. One was finally scheduled and the customer ultimately canceled the training saying they did not have the time to do so.In closing, it should be documented that customer submitted a chargeback via his credit card company.   Based on the proof provided in our rebuttal, [redacted]won the chargeback and ultimately retained payment for services.  We firmly maintain that: the services fit thedescription at the time of purchase, all relevant rate plan, billing, and cancellation procedures were satisfactorily explained, that services were amply utilized, and that [redacted] immediately complied with the Customers request to cancel services. [The statements made are fraudulent and erroneous.  We do not accept your response.  There was no usage on the account because the account was cancelled.  Not only did we call to cancel the account, but we also faxed something in (as requested) to cancel the account.  If you have no record of the fax, that is your issue, not ours.  If you continue these slanderous accusations and continue to send false statements, we will have no choice but to go to the authorities.  You are attempting to collect $50.00 for services never rendered that you suggest occurred over a year ago.  The services were cancelled following the guidelines that YOU set forth.  You need to manage your documents better; if you have a policy in place (i.e. fax requests), then keep records.  Failing to keep records, then trying to extort funds is a crime.

[You have the contact as [redacted] with American Casualty Audit Group.  I have an email from you this morning indicating that you've done business with us.  As suggested this is suspicious activity.  Now they are requesting faxes from June of 2014.  If their records were updated they will see we have not used their service since December 2013.  We do not accept your response.
