Review: I am a third party beneficiary of my landlord's purchase of a refrigerator.

On Wednesday July 10th a refrigerator was supposed to be delivered between 12-2pm. The delivery was a ridiculous situation, first they claimed they had the wrong phone number and failed to deliver on the day promised. Rescheduled for the next day, Thursday July 11th, they were extremely late, the driver told my landlord at noon he'd be at my place within an hour and a half...3 hours later I was still waiting. I had to cancel an important lunch with out of town people because of this situation. After complaining to my landlord, he called the delivery guy again and was told that the delivery would have to be rescheduled anyway because they only sent one guy to deliver a refrigerator and there are 14 stairs to my apartment. The delivery guy said he was going to have to reschedule the delivery again...my landlord had to come to help get the refrigerator up the steps to get this resolved.

On Monday July 15, 5 days later, I arrived home to a defrosted freezer and refrigerator, I contacted my landlord at 6:30 pm and he said he'd contact Better Appliance first thing in the morning because they were closed. Apparently, the 24/7 Emergency Service doesn't exist for their warranties. As of 4:30 pm, Tuesday July 16th, they have not been able to provide a service technician to repair the refrigerator or someone to replace the refrigerator even though it is under their 30 day warranty.

I have lost significant time and money due to this company. I had gone grocery shopping last week, at this point the estimate I have for the lost food is approximately $200 and currently the cost of ice to try to salvage any food is at $25.Desired Settlement: At this point I am still waiting for a repair technician or for a replacement of the refrigerator unit. I am willing to wait to see how the situation with the repair/replacement goes before requiring action on that.

I do want compensation for the lost food and the ice that was purchased to mediate the damages. I am prepared to file a claim in small claims court if this situation is not resolved, but I would prefer not to lose additional time and expenses. 5 days is certainly not within my expectations of the life of a refrigerator, refurbished or otherwise.
