Used Cars and Trucks for Less

The business is attempting to withhold repayment of a deposit.
I was looking at buying a 2009 Saturn VUE from this dealership. I initially talked to Cowboy, a salesman about the car. I was clear to him that I liked the car but wanted to take it to a mechanic before finalizing the sale as I had heard a soft screaming noise from the engine compartment after parking the car after the test drive. He passed us over to Omar to talk about the financing. Omar suggested we finance it through a bank instead of through the dealership.
I left a $700 deposit on Saturday 2/15 to hold the car until my mechanic could look at it (Monday 2/17) and we could finish arranging financing (bank holiday on Monday). At no time that day was I informed that the deposit was not refundable.
Monday 2/17 I picked up the car, took it to my mechanic, and got it checked. The mechanic noted that there was oil leaking down the side of the engine and the power steering system was also leaking and making the noise I heard the first day. I provided a copy of this assessment to the dealership, and told them I would have to think about it. Monday night I talked with my wife and we decided we didn't want to buy this car, even if they fixed it up. I called to inform them and got Cowboy, the salesman. I told him we weren't interested in buying it, and requested a return of the deposit. He told me I would have to call in the morning to discuss it with Omar.
Tuesday morning 2/18 ~9:30AM I called in and got Omar. I requested a return of our deposit. He told me I would have to talk to Cowboy about it, and that he would get him to call me later. Cowboy called me later ~11:45AM to tell me the deposit was not refundable.

I had purchased a car from used cars and trucks for less in Salt lake City on 1/25/20. I returned it two days later on (1/27/20) for it dying on me twice. They said they sent the check on 1/28/20 and said it would take a week. So I waited a week later and had called them again and they told me they sent it on the third. Have been calling the bank to keep up with the check to see if they received it in mail and they told me to call used cars and trucks for less and ask them again when they sent it, how much and where. They told me how much, when they sent it, which they said it was the 7th this time and they refused to tell me where. Everytime I have called they hang up on me . MY husband has called to inquire about it and they hung up and called him an it. From what I can see they are refusing to refund me the check even though the car has been returned. It has almost been a month and I can not get a other car until this loan is off my account. Now I have to pay on a car that I dont even have.
