I am responding to the complaint dated 03/04/16, ID# [redacted] I apologize that this complaint has not been answered previously, however, it was just brought to my attention yesterday and I was out of the office travelling to one of our regional offices As you may be aware, USIC is a utility line locate firm that marks the location of underground utilities in advance of excavationIn February 2016, USIC was preforming utility locates on [redacted] Avenear the complainant’s addressUSIC did misread the location maps for a water line in the area and as a result, the line was struck by excavationThe escaping water flowed for about hours before the utility owner was able to repair the line and stem the flow of water As a result of the incident, the complainant claimed that the flowing water caused cracks to his drivewayUSIC investigated the claim and found that there were two small cracks found on two slabs along the drive approach to the drivewayThese cracks could just as easily have been caused by weather extremes as well as settling, as was explained to the homeownerNot wishing to bring any aspersions to our utility customer, USIC decided to consider the homeowner’s claim and offered to have the two slabs replaced, as settlementHowever, the homeowner refused the offer and is demanding that the entire drive approach and driveway be replaced in their entirety USIC sees this as an unreasonable demand and is currently standing by its original settlement offerI have attached photos of the drive for your review, as I believe it will help you to clearly see just how unreasonable the complainant’s demand is Please feel free to contact me directly, should you have any questions or concerns regarding this issue Best Regards Dan [redacted] Operations Claims Director O: 972-871- C: 214-502- Westridge Dr Irving, TX USICLLC.com

I have tried several times to Reach MrDan *** on the phone numbers that he providedI have left him messages so that he could call me to discuss the issue, but he has failed to call me back
In Mr***’s rebuttal he indicated “USIC Investigated the claim and found that there were two small cracks found on two slabs, and that these cracks could have just as easily been caused by weather extremes as well as settling“
The issue I have with this investigation, is that they visited the site after all the digging was covered up, and the following is a written statement from the *** *** who’s crew were on site at the time of the incident
The following is a quote is from Tod***, Manager *** ** *** *** ***, in a previous e-mail
“Our crews were installing a gas main for three new homes on *** AveThe street issue was caused from hitting a mismarked water main on Friday (02-12-2016) around 10:00am. The Water Company didn't show up until around 2:00pm, so the delay caused extensive damage to the driveway from the water undermining the driveway base ( on *** *** ***.). Also, the water company excavated the road to make repairs to the main and apparently didn't saw cut the excavation hole. I talked with our damage prevention inspector and he confirmed that the damage was caused by the mismarked locates. The street repair will be the responsibility of either U.S.I.C(for the mismarked locate) or the water company.”
Based on the above information, how can one determine that from looking at the top of the driveway that there is no damage below. Furthermore, that is a brand new house, the owners moved into the home mid December 2015, and the driveway in question was poured about a month or two prior. The issues with only replacing two slabs are threefold:
1: The new concrete will not match the remaining driveway giving a patchwork display
2: The original driveway was covered by a year builders warranty, which is no longer valid
3: You cannot determine how much erosion was caused by the on rush of water until you remove the entire slab
This is not the fault of the homeowner; it is the fault and responsibility of USIC.Regards,*** ***

USIC did misread the location maps for a water line in the area and as a result, the line was struck by excavation. The escaping water flowed for about 4 hours before the utility owner was able to repair the line and stem the flow of water.
As a result of the incident, the complainant claimed that the flowing water caused cracks to his driveway. USIC investigated the claim and found that there were two small cracks found on two slabs along the drive approach to the driveway. These cracks could just as easily have been caused by weather extremes as well as normal settling, as was explained to the homeowner. Not wishing to bring any aspersions to our utility customer, USIC decided to consider the homeowner’s claim and offered to have the two slabs replaced, as settlement. However, the homeowner refused the offer and is demanding that the entire drive approach and driveway be replaced in their entirety.
USIC sees this as an unreasonable demand and is currently standing by its original settlement offer. I have attached photos of the drive for your review, as I believe it will help you to clearly see just how unreasonable the complainant’s demand is.

Good afternoon. I apologize for the delay in response to the complaint regarding USIC (ID# 11675389) Regarding the complaint: the area supervisor has been in contact with the homeowner. There is no evidence to support the claim that we cut down a tree in his yard. All the photos regarding this...

locate show all trees intact after the locate was complete. Furthermore, our locators do not carry the equipment necessary or the skill to cut down a tree. All trees in the area of the locate would have required a multiple man team to execute and our locators work alone. They also work on a production base and the trees in the area would have taken quite a long time to dismember. We were at that address doing a locate for Time Warner Cable and if the tree was in the way of their work, they have been known to remove them. We regret this has happened to his tree, but we are not responsible for the cutting down or removal of said tree. We have received the complaint about the damage to the homeowners fence.We were able to determine that the givendamage was done from our locator to the vinyl fence gate post.We take all complaints seriously and hav approved the claim-on a local leveland turned into our claims
department for final...

approval.Once this approval is complete a check will be issued and overnighted to the homeowner for theexpense listed on the invoice for fence repair.Thank you for t he mediation of this complaint. We will also reach out to the homeowner.
