Company states: We have provided the As-Is contract with the customer. I tried to help her. I found a reasonable price to repair your transmission. After 2 thousand miles she wants me to pay $9,000 to their mechanic. They checked the car and drove it.

?

as you read from the customer , she used the car as she said for 62 days without problem and she made more than 2 thousand miles on it as they told me , and no way that any car can make 2000 miles or even 50 miles with bad transmission without a problem , the transmission could be burned by the user...

for example driving it in low gear for long distance with high speed and many other reasons.
in addition to all the above we are selling a used car without waranty and the customers they know that and they sign for it . means they accepted AS IS .
she paid for the car less than what her mechanic want to charge her for fixing the transmission
I talked to somebody from her side ( her father in law as he said ) I told him there is a transmission repair shop can fix your transmission for $ 3800 with one year waranty and they will rebuild the transmission with [redacted] dealer parts . and he shoukd pay for it because they broke the transmission in some how , I think they know what they did . he refused that and he want me to pay almost $9000 to there mechanic .

I am rejecting this response because: In fairness to Mr. [redacted] and UTU Auto Sales I took my vehicle to two other mechanics for repair estimates. I finally found a shop in Anderson, CA (near Redding, CA) who estimated repairing the transmission for $3,500. When the mechanic in Anderson did the repairs, he also found that the Front Engine Mount had been cracked in multiple spots, there were multiple loose bolts and that someone had shimmed the broken engine mount so that it wouldn't rattle when test driven. He also stated that someone had appeared to repair the Front Engine Mount at some point by gluing it together, but the gluing repair did not hold. As far as the transmission goes, the mechanic said that it was slippage in 4th gear and that this was the reason why the vehicle completely lost power when I tried to drive it on the Sunol Grade the day that I had to have it towed home. Come to find out the manufacturer recommends that a service should be done at 100,000 and that at the time of the sale that service was OVERDUE. The entire transmission had to be rebuilt and the Radiator Support and Front Engine Mount and to be replaced. The total of the repairs was $4,183.51. Not only did Mr. [redacted] lie and mislead me as to the condition of the vehicle, but he also sold me an UNSAFE vehicle. Mr. [redacted] may try to hide behind the law on this, but he knows WHAT HE DID. By the way, as far as his claim that insinuation of driving this vehicle low
gear for long distance with high speed is preposterous, this vehicle is an automatic and why in the world would I spend almost $10,000 only to turn around and do something damaging to a vehicle that has been my dream to own? That is an illogical statement. If the vehicle was actually in the condition that UTU Auto Sales "claimed" it was in, then it should not matter whether I drove the vehicle 2,000 miles or 200 miles. I guess if the Revdex.com can't help us settle this matter with UTU Auto Sales I will be forced to take this to court and I will be bringing all of the old parts with me as evidence. My Step-Dad ([redacted]) asked Mr. [redacted] on the phone only one question: Did you, a mechanic or anyone else look at this vehicle before you sold this to my step-daughter? He could/would not answer the question. Mr. [redacted] knows what he did and what he didn't do. I am attaching the vehicle profile from the UTU Auto Sales web site and the Invoice from [redacted].

Review: I contacted UTU Auto regarding a Craigslist ad for a [redacted].On July 14th, I contacted the owner of the business, [redacted], to get information on the vehicle. He advised me the vehicle was in excellent condition and no accidents. I requested photos of the vehicle identifying any flaws, dings or dents. He advised me the vehicle was in excellent condition with no flaws and he emailed me a car fax.We negotiated a price of $8,000 including tax, fees and delivery. I was unable to make the 2 hour trip to Sacramento until the following week and also decided to arrange financing during this time.On July 19th I offered to put a refundable deposit of $500 on the car and advised that I would be up the following week to inspect the vehicle and make final payment. On July 24 I drove to [redacted] to inspect the vehicle and found dents and paint scratches on several of the body panels. Most concerning was the obvious fact the vehicle had been in a front end collision with missing and mis-matched body part serial numbers. Basically a salvaged vehicle that somehow has not identified as such.I advised the owner the car was not even close to the description he had provided me and requested my $500 refundable deposit back. The owner at first refused and accused me not wanting the vehicle due to financing issues, which, was not the case as I had brought the full payment with me.I asked the owner several time for my deposit back. He became argumentative and gave me $240 cash from his wallet and belittled me as I walked left his store. This has been by far the worst car buying experience of my life. I am requesting the balance of my deposit in the amount of $260.Sincerely,[redacted]Desired Settlement: The balance of my refundable deposit in the amount $260 returned to me.

Review: I bought this 1997 Toyota Camry for $3,800. cash from Mr. [redacted] on 09/03/2013.The owner promised me if the car has any problems he will fix it for me free. On 09/14/13 on a Saturday as I was driving on the freeway to work the check engine light came "on".When I talk to the dealer Mr. [redacted] said his friend who has a auto shop next to his dealer will fix the problem. ** auto Repair charge me $50.00 to diagnostic. The light is still "on". I want UTU Auto Sales to fix check engine light or return his car. Mr. [redacted] did not adjust the valve motor noise as promised either. Desired Settlement: Fix check engine light, adjust the valve and troubling noise or return the car.

Initial Business Response

I sold this car to the person mentioned in this complaint after he check the car more than one time and took it for a drive test. the car was in good condition with new smog and without check engine light, there was very simple lifter noise . he wants the car even with this noise and asked me can we get rid of it and I told him to bring it later to check it in a mechanic shop ,

he held $100 for this reason , he came after one week we took the car together to the mechanic and the mechanic explained to him that this is not a big thing and doesn't affect the engine , he satisfied with that and paid the $100 that he held before.

I didn't promised him to repair any future problems and I sold the car AS IS without WARANTY and he signed the buyer guide showing as is no waranty.

when he bought the car , he said that he is without job and he will find a job soon , and he has personal problems and shortage with the money.

I told him if you need any help with the future repair I can help you doing it with good prices in some shops that I know.

it is impossible to promise the customers to be responsible for the cars that I sell for ever and it is used cars.

he came after 2 weeks with check engine light on

asking for help, I checked the code for him , it was evap code and most probably is the fuel tank cap cause this problem , I reset the code for him

and told him if it will come back again change the cap.

he called me after one week he said no more check engine (good news)

he called me after 2-3 days , I was out not in my office , check engine again , I sent him to the mechanic to check it for him and solve the problem

as I promised him before to lead him to a good mechanic with reasonable prices not as waranty .and the mechanic told him you have to change the fuel cap.

after that he came and wants me to pay $50 for the diagonestic .

I refused to pay it , he told me that he doesn't have money and he didn't find a job then I decided to pay him $25 half the amount and I told him this is for help and I don't have to pay it.

he refused and he want the whole amount and he start to shout and talk in different tone and he will go and sue me.

this is the whole story

Final Consumer Response

Dealer UTU Auto Sales, Owner Mr. [redacted] do not agree on the Better Business Decesion. The car 1997 Toyota Camry still has the check engine light "ON", after changing the new gas cap. If the dealer ship refund me $850. I will fix the car y my self. Mr. [redacted] did not adjust valve as he wrote on the contract paper. There is trumbling noise caming from the front when I drive the car. If Mr. [redacted] cannot fix the car he should refund the money and take his car back.

Review: I paid $8,400 cash for a 2006 [redacted] from UTU Auto Sales on June 16, 2014 and 62 days later, on August 17, 2014 as I was on the freeway coming back from the Bay Area, my transmission went out. The contract with UTU Auto Sales was "As Is - No Warranty" and I did not purchase the Two-Day Sales Contract Cancellation Option or extended warranty. In the Sales Profile of the 2006 [redacted] it was represented as: "The transmission in this vehicle still shifts smoothly." After two attempts at communication and sending a DEMAND LETTER with a repair estimate of $8,862, UTU Auto Sales finally contacted us and stated that they are not responsible for the vehicle whatsoever and that it was sold "As Is - No Warranty." We asked the gentleman from UTU Auto Sales if anyone or a mechanic had looked at the transmission and/or engine before it was sold. He could not give us a straight answer. His only offer was to bring the vehicle to a mechanic that he knows who would fix the car for $3,500, that I would have to paid for by me. His offer was declined since I would only be willing to take it to a mechanic that I would trust. Evidently UTU Auto Sales feels some type of responsibility towards the repair of this vehicle since they contacted a mechanic. Should a Used Car Dealer be able to represent a car for Sale as: "Transmission in this vehicle still shifts smoothly" when evidently no one even looked at the transmission? The mechanic that we took it to stated that they transmission fluid was "burned" and that couldn't have happened in the amount of time that I owned the vehicle. UTU Auto Sales knowingly sold a faulty used car to me and basically ripped me off. I'm a starving college student and I'm working to put myself through college and used my inheritance money that I received when my grandma passed away, and now I have no money and a car that doesn't run. I don't believe that shyster used car dealers should be able to hide behind laws that doesn't seem to protect consumers, many of them low-income.Desired Settlement: I am requesting that UTU Auto Sales make this right and pay $8,862 to have the transmission repaired at my mechanics shop.
