This customer fails to mention a few things about her order that specifically marks it as non-returnable, one of them being present in all iterations of our policy that we've ever posted or sold merchandise withFirst of all, the customer ordered a swimsuitAs retailers of intimate merchandise, we
have never allowed for the return of panties, swimsuit bottoms, or adjacent itemsThis is a simple principle and standard for handmade retailers throughout our industry due to hygienic concernsSecond, the customer claims that she didn't know the item was made to order, but she specifically ordered her set as "custom sized" through our websiteIt is perfectly clear following logic that any item which is ordered as custom is understandably only available "made to order" -- how else would it be distributed? ***'s argument that she failed to understand her custom-ordered item was being made specifically for her -- when she specifically ordered it precisely to be made for her according to her measurements -- makes absolutely no senseTherefore, it does clearly fall under the policy stated on our website*** is correct that the exact language of our return policy varies slightly depending on whether it is accessed through our store policy page or the return policy popupHowever, the stipulations that the terms are expressing does not differ, and ***'s order still clearly falls under the language of the one she prefers -- "Final sale items include panties, custom orders, and sale items." ***'s order clearly falls under both "panties" and "custom orders," and regardless, our usage of the word "include" clearly indicates that we still reserve our protected right under NY state law to issue a refund in the manner we find appropriateI have included text from the NY State Division of Consumer Protection which attests to the fact that we clearly have followed and exceeded instructions for handling this refund*** was offered the refund in the form of exchanged merchandise or store credit multiple times and refusedShe has since threatened to file an illegal chargeback claiming that she didn't receive merchandise which is clearly in her possession, which is stealingWe have gone above our duty and stated exchange policy to continue discussing her refund, carefully and compassionately explaining our policy and the reasons behind it, and extending our stated deadline on returns for her multiple times to continue the discussion when she was not satisfied with the solutionShe was welcome to accept her refund in store credit but chose not to accept it, so in our eyes, we have already offered the resolutionWe are a small business putting immense amounts of work into our craft and are highly regarded among our customers and peers for our level of product and service*** is upset because she clearly did not familiarize herself with our completely fair, legal, logical, and understandable return policy before purchasing, and is now looking for a reason to back up her unfounded claim towards a special solution she was never promised or entitled toWe simply and respectfully can't offer that with respect for our work and principles*** is still welcome to discuss with us an exchange for store credit or consult with us regarding the fit issue she experienceHad she approached the conversation differently, we would have happily worked to resolve this with the creative and customized solutions we are able to offer through our handmade work -- as is stated emphatically throughout our return policy.
