The company claims that I never contacted them, which is untrueNot only did I contact them over and over again, in a four year period, not a six year period, Because they would not answer their telephone), I went there in person and spoke to Randy, not Jeff, verbally on several occasionsRandy was privy to every inquiry that I had, and he knew the situation, but he never said anything about selling off the furniture or a warehouse storage fee, on a Warehouse the company no doubt ownsWhy Would I, deliberately, not show up about my merchandise if I didn't care about my deposit? And why would this company, especially Randy, who on ***(see link Lauter's Fine Furniture - - Easton, PA) is "very knowledgeable" not Contact me about merchandise I paid a $1,deposit on, that was being sold? The letter states that I was called, that messages were sent to me, and letters, with no responses; I never received a call, nor a letter, nor a message, even when I continued to travel to the furniture store, as they refused to answer my telephone calls, which are no doubt on their caller ID historyIn addition, no final letter, or call, was afforded to me that stated the bedroom set was back in the store to resell it, and that I would lose my deposit, because I would have been up at the store the minute I got the letter or call, to try and negotiate the discounted price, so I wouldn't lose my $1,If this letter was sent, and it was sent certified, then I want to see the return certified card with my name and signature on itI did not come into the store after this letter was sent to me, on my owntraveled back up to the store on another occasion to see What was going on; and that is when I was told by Randy, or another sales person, that was sitting at the sales desk, at that time, that the bedroom set had been soldYes, there was an initial verbal payment arrangement made between Randy and I, but because of the financial situation, and circumstances beyond my control, I Was unable to keep the initial verbal arrangement madeIn addition, a payment arrangement, after it was known that I could not meet the initial payment arrangement, was not offered, instead I was asked to fill out an application for a store credit card, twice, in order to pay on the furniture, but it was declined, twice; so that is untrue as wellAt no time, was it ever made perfectly clear that I would lose my entire deposit, in writing or verballyThere was not, at anytime, a document that I signed that said, "Deposits are Non Refundable".In closing, I spoke with Randy, not Jeff, the entire time, until I found out that my furniture was sold, and that is when I asked for my deposit back; in addition, why would a company that has been in existence since rent a warehouse, they did not have to pay for storage, nor was that ever an issue relayed to me, in writing or verballyWhy, if they sold the furniture, at a discounted price, was that offer not afforded to me, the depositor? Because it was not sold at a discounted price, and they lost no monies on it, whether it was in storage or not, they still were given the right amount for that furniture, and my deposit as wellI, personally, feel that an investigation should be conducted on the "Bill of Sale" of the said bedroom set, in order to ascertain if monies were made in excess of what was the initial sale, because beds do not depreciate in four years, they go up, not downEven a mattress that cost $four years ago, is not $todayWe are talking about an entire 'bedroom Set".I am entitled to my full deposit, as there is nothing in any contract that I signed that stated that there are no refunds on one's deposit.I thank you for your time.Sincerely,*** ***

The bedroom set was displayed in our showroom, marked as clearance, and priced at our own cost in an effort to try and sell it, when Mr. [redacted] purchased it in 2009. At the time of purchase, he gave us a deposit and he told us he was not ready for delivery. We graciously agreed to hold the bedroom in...

our warehouse under the impression that it would only be for a few months. Throughout the following four years, we called Mr. [redacted] numerous times leaving messages, and sent several letters with no responses, while the bedroom set remained stored in our warehouse. With no attempts of communication from Mr. [redacted], nor any attempts at making additional payments for four years, we sent a final letter stating that we would be bringing the bedroom set back to the store to resell it and he would lose his deposit.After receiving that final letter in 2013 telling him he would lose the bedroom set and his deposit, Mr. [redacted] finally came into our store. This was our first and only communication with Mr. [redacted] after receiving his deposit on the bedroom set. During this visit, he expressed that he still wanted the bedroom set, but he was going through some tough times. Being sympathetic to Mr. [redacted]'s situation, I offered a payment arrangement to Mr. [redacted], which consisted of his Sending Lauter's Fine Furniture a few hundred dollars a month, and that in his doing so, we Would continue to hold onto the bedroom set for him until it was paid in full and could be delivered. I explained to, and made perfectly clear to Mr. [redacted], that if Lauters did not receive his monthly payments, he would lose his deposit and the bedroom set. I also told Mr. [redacted] that this was the last opportunity that we would give him to make good on his agreement of sale on the bedroom set. After generously offering to work with Mr. [redacted] and his agreeing upon our monthly payment arrangement, we never received a penny more, or any further communication from him. In 2015, two more years after making the payment arrangements with Mr. [redacted] and receiving no payments and no communication regarding such, we brought the bedroom set back to the store for sale.When we sold the bedroom set to Mr. [redacted] it was in good faith. We were more than reasonable and accommodating in storing the bedroom set for him for years, not the months that We had anticipated, and were sympathetic to his situation and offered him minimal payment arrangements that he agreed upon. Had Mr. [redacted] answered our attempts at communicating with him and made any kind of effort in making any kind of payment, we might have been Willing to work with him further. After 2 more years with no further payments or communication from Mr. [redacted], six years of this in total, we had no choice but to bring back the bedroom set for sale.Approximately 3 weeks ago, six years after the sale, Mr. [redacted] called us and asked for his deposit back. Storage costs alone for the six years we trustingly kept the set stored in our warehouse would have cost more than the $1,400.00 deposit amount that Mr. [redacted] had given us. With no luck in selling the bedroom set for a second time due to the outdated style, we were forced to mark the bedroom set below our cost and the total price that Mr. [redacted] agreed to pay, and finally were able to sell it during 2015 with Lauter's Fine Furniture losing money during the final sale. We unfortunately had to decline his refund request.Mr. [redacted]'s lack of responsibility, communication and payments left us with no other recourse. This is most definitely an unfortunate event that we wish could have worked out differently for both parties.Sincerely,Jeff Z[redacted]
