I am filing a complaint against Vacation Transfer Unlimited for a Breach of Contract, and Misrepresentation, and request a full refund.

My family received correspondence from the Law Office of *** earlier this week including all relevant documents relative to the Class Action Lawsuit against ***, et al by which our deceased Mother was a part of.

A review of all of the documents sent by Mr. indicated that the lawsuit to remove her and relieve her from the *** Timeshare Ownership Contract had been dismissed due to an Attorney hired by Vacation Transfer Unlimited not having the jurisdictional authority to practice in the U.S. District Court for the ***, for incompetence for not responding to motions, and for a lack of response by Mr., the alleged expert from Vacation Transfer Unlimited that guaranteed her removal from the timeshare obligation.

Unfortunately soon after my Mother began paying on the Service Agreement in *** with Vacation Unlimited Transfer she was killed in a car accident (***). As daughter and Executor, I contacted *** in late *** and he informed me that my Mother would still be a part of the suit albeit as the "estate of..." and that I should pay the balance of the $*** owed to them. He guaranteed that the*** Timeshare would be terminated and furthermore, the heirs to the estate would realize several thousands of dollars in refunded payments and fees that my Mother paid over the previous 18 months. We agreed to this and paid the balance requested by *** of Vacation Transfer Unlimited. We also provided him with a certified death certificate as he requested. From *** through *** we received no written correspondence from Vacation Transfer Unlimited, Mr., or the Attorney's he retained relative to the case. My sister and I personally contacted him several hundred times by telephone and text message regarding the status. His answer each time was "it is going though the process, it is in court, the case will get resolved soon, not to worry...". Then in *** we received a letter from the Law Office of *** mentioned above. Upon receipt I immediately contacted Mr. by phone and requested a refund of the full amount of the fee ($***) paid to Vacation Transfer Unlimited based on the contract between his firm and my Mother and his Company's guarantee "to get their client out of their timeshare ownership or 100% money back". He told me that my "Mother's" contract was cancelled based on his firms efforts. That was a total lie, as I contacted*** that same day and was told otherwise.

Since then, I have been unable to get Mr. or any representative from Vacation Unlimited Transfer to respond to my phone calls and text messages. This man and this firm took total advantage of my elderly Mother (***) and now me as her Heir. The firm is involved in the same deceitful tactics as the company they "guaranteed" relief from.

I am thankful to the Revdex.com for allowing to file this complaint against Vacation Unlimited Transfer for their Breach of Contract, and Misrepresentation. Furthermore, I am requesting a full refund ($***), the amount of the fee, paid by my Mother including the final payment made by me in good faith after she passed. Their paperwork and website clearly states: "Money Back Guarantee: We'll get you out of your timeshare or give you your money back".

Vacation Transfer is still in the process of terminating the timeshare for the client. Obviously the process is taking much longer than expected due to the developer stringently fighting the complaint and the matter has ended up in court proceedings. We have pursued the fight against the developer with no additional expense for the owner.

I do not accept the response provided by Vacation Transfer Unlimited (VTU), as it is once again, based on deceit. First, VTU is not in the "process of terminating the timeshare for the client". In fact, I took it upon myself to contact *** regarding same. On ***, I called *** Legal and inquired about terminating the contract directly, given the circumstances involved. On ***, *** acknowledged that we had the opportunity (previously) to terminate the contract if we had contacted them directly, and that we "could have done so without the support and expense of a firm such as VTU". *** also agreed to allow us to cancel now, especially in consideration of the circumstances surrounding our personal situation. Therefore, on ***, *** and I entered into an agreement, by which the company "expressly and unequivocally canceled the contracts without any further financial obligation".

On the other point of VTU's response, that "the process is taking much longer than expected due to the developer stringently fighting the complaint and the matter has ended up in court proceedings" is again totally false. Any litigation that was pursued on our behalf was recently dismissed in court. We were advised that if we (as complainants) wanted to pursue further litigation we would need to hire our own legal Counsel.

In conclusion, and once again I reiterate, this firm not only took advantage of my elderly Mother (taking money from her and leading her to believe that they could exonerate her from the relative debts of these contracts), but they continued to do so with our family (the estate) after our Mother was killed in a car accident. Their tactics are despicable and again in all due respect, I believe we are owed the full fee reimbursement of $*** from Vacation Transfer Unlimited.

In response, first and foremost I understand this situation concerning Mrs. is difficult due to the passing of her mother suddenly and tragically. That being said, the position that Mrs. is taking by blatantly accusing VTU as deceitful, despicable, and taking advantage of the elderly is simply false and outrageous.
A fact that Mrs. is omitting is that the time that her deceased mother entered into the agreement with VTU at our *** location she (her mother) was accompanied with a friend who also owned with the developer ***. Mrs. mother and her friend (both were of similar age, circumstances and both were owners/members of the developer ***) were both in debt to the developer in excess of $***. VTU, like we have done for yrs and for all VTU clients, secured an attorney to facilitate the release from the debt/ownership that was owed to the developer *** as well as other developers. The process that VTU used was one based upon the developer *** sales representatives implementing fraudulent sales practices, misrepresentation of facts and blatant deceit. We accomplished this for her mothers friend successfully within a 6 month period which was generally speaking "a quick release" most take between 1-2 years. Why the developer *** choose not to do this for Mrs. mother at the same time is not uncommon. It has been VTU's experience that some clients are released sooner than others and there is "no rhyme or reason for it". This situation, which Mrs. has personal knowledge of occurring, is a direct contrast of her claims of dishonesty towards VTU.
Secondly, Mrs. claim that the developer *** stated that they would have released her mother without the aid of VTU. VTU strongly disagrees with. If the developer *** released every owner from their contractual obligations for reasons such as they didn't want it anymore for whatever reason the owner states. Then why is the developer *** suing individual families across the country for breech of contract who choose to accomplish this release on their own. VTU's experience is in direct contradiction to what the developer *** stated to Mrs..
Thirdly, as Mrs. stated that *** would release all future financial obligations especially after her mother's sudden passing. What did VTU do with the information when it was known that Mrs. mothers sudden passing? VTU had Mrs. send copies of the death certificate at which time it was sent to the attorney. The attorney sent the death certificate concerning Mrs. mother well over a year ago to the developer ***. At that time the developer *** never responded back to the attorney. Now the developer *** is doing this for Mrs. when they have been sitting on the same information for well over a year ago is puzzling to say the least.
Lastly, VTU started the process of securing a release for Mrs. late mother in "good faith". VTU has sent all the necessary information to the developer *** including copies of the death certificate for the release of financial obligations for Mrs.. It is VTU's opinion that we would have secured the release at some point in the near future.( which should have been done at the latest when the death certificates were sent to the developer ***) It is somewhat understandable that Mrs. is demanding a full refund. As stated earlier VTU acted in good faith throughout the entirety of the process. (like we have done diligently for all of our clients) VTU is open to a "good faith" resolution regarding this situation.

My case was dismissed in court due to rep from VTU not being available. Trying to hold VTU to 100% money back guarantee. Won't return my calls.
On *** entered a contract with VTU/ ***, to rid me of a timeshare with *** Vacation Resorts.Paid $*** to VTU over a six month period to exit *** contract. Was told by ***, that about the time we paid for contract with VTU, we would probably be out of contract with ***. Attorney for VTU is ***, ***. Mr. sent letter to *** to ask for *** to terminate our contract, which they refused. *** removed case to federal court. Mr. asked Mr. to take over case, since Mr. does not practice in federal court.
Mr. and partner *** address is ***. By the time these gentlemen took up our case, there was a motion for dismissal because Mr. had not responded to the motion.
Mr. was willing to go forward, because he was told that there was an expert on timeshare exit to assist him. Mr. was never put in contact or made aware who this contact was, so case was dismissed with prejudice on ***.
I didn't receive any correspondence from Mr. until *** and again on *** that case was dismissed due to not being able to confer with timeshare expert. Mr. found out the name of the expert after case was dismissed. Guess who? Mr. owner of Vacation Transfer Unlimited!
I have tried to contact Mr. several times, calling his office phone and his cell phone. He will not answer the phone, so I leave messages for him to call me. He is avoiding me and will not return my calls.
I will supply documentation later upon request.

Desired Outcome

Follow through on money back guarantee. VTU did not get my timeshare terminated as promised.

Talked to *** in person. *** assured me that VTU is continuing the exit plan with another attorney. Presently satisfied that VTU will eeventually prevail.

Outstanding company! This team of experts are knowledgeable and experienced in timeshares exiting. I hired them in September 2019 and received confirmation in March 2020 that I'm legally exonerated from my timeshare! With all the Companies out there that say they can get you out of your timeshare this company is legit and honest and life-changing for some of us. I can't thank the staff enough!

This company has called our home phone, cell phone and today even called me at work. We have asked them repeatedly to please remove us from their calling list. We are very happy with our timeshare at Wyndham Vacation Resorts and are not interested in selling, renting, giving away or suing Wyndham. But would be very happy if our numbers and names could be removed from Vacation Transfer Unlimited calling list.
