To Whom It May Concern: Vail Tax and Accounting does not agree with the attached complaint. The tax return was prepared
and filed with the information provided by the ***The Colorado Department of Revenue later sent a verification letter dated 2/16/to the *** asking for copies of W2s to be sent to verify against the electronically filed returnThe client delivered this notice to *** ***, their tax preparer, whereupon the requested documents were faxed immediately and again on 5/24/(per client request) to the Department of RevenueThe State's subsequent but delayed verification confirmed that the tax return that was filed by our company was correct and complete and the client eventually received their refund. We agree with Mr*** that the delay from the State was inconvenient and frustrating, however, Vail Tax nor any other Tax Preparation Services Company can control the time it takes for the Department of Revenue to process these responsesFurther, without a power of attorney submitted to the Department, the Department is not allowed to contact anyone but the taxpayer, making the taxpayer's direct involvement a requirement. In regards to the demanded payment that Mr*** has not paid, the following paragraph is in our engagement letter that was signed by Mr***: "Fees for our tax return preparation services are based upon the appropriate market rate for the level and value of services renderedOur hourly rates vary from $to $per hour depending on the individual providing the servicesOur bill for this engagement will be due and payable upon completion of these returns and additional services will not be performed until the bill for these services is paid in full." To clarify, it is regular practice at Vail Tax and most Tax Preparation Firms to require payment from clients upon completion of the return, prior to the electronic filing of the return to the government entityThe *** were initially given an exception to this requirement to pay upon completion of their return on 2/7/after claiming that they were in dire financial straitsHowever, monthly statements were mailed via ** *** *** to the client on 2/28, 3/31, 4/30, & 5/to remind them of this outstanding obligationOnly after the client's balance remained unpaid over 150-days did I, the owner of Vail Tax (not the "receptionist who handles all his accounting"), contact Mr*** via email (attached) and also by phone to request paymentIt was agreed over the phone that all finance charges would be waived upon payment of the initial $chargeTo date that payment has still not been received.As to the Mr***'s encounter with *** *** in our office actually on 8/3/17- the reason he had to wait 10-minutes is that he came in 10-minutes early for a scheduled meeting with me, not ***, and *** was already engaged in a client meeting*** had the client in his office wait while he addressed Mr*** whereupon many profanities and nothing of real value ensued and Mr*** leftI called Mr*** back as soon as I arrived at the officeHe apologized for the encounter, thanked me for contacting him, and said he would be in that day with the agreed upon paymentTo date, he still has not showed up to pay said billThe basic facts are this, the engagement was completed as agreed to in writing (and signed by Mr. ***); per this signed agreement payment of our tax preparation services is not dependent on the timing of the client receiving their refund; we continued services even though the client had still not paid for the tax return filing; Mr*** is upset we didn't call in to the State ourselves- which is not actually allowable- though we did fax the needed information twice; and we have given the client over half a year at this point to pay us interest free. I appreciate Mr*** taking the time to express his frustrations in a constructive manner and I absolutely hate for any client to be this unhappy with us but I am not willing to discount our bill for tax return preparation nor will I acknowledge the State's lack of efficiency as anything my firm has control overI do regret the poor communication all around and the fact we lost the confidence of a client.
