I have spoken to Mr. [redacted] to work toward a resolution with his bank. I am waiting for him to provide me with someone to communicate at his bank so we can explain the sequence of events to try to reverse his insufficient fee charges. [redacted]

Mr*** did purchase the *** *** on 07/03/He traded in a *** *** *** for which he received $When he made the decision to trade the *** *** for another *** vehicle the contract to purchase along with the transfer of title on the *** *** had already
been executedThe application for title was already in the system on the *** so in order to transfer that vehicle back into Valdosta Toyota we had to show the *** as a trade in on a totally separate transaction to purchase the *** ***We are not able to unwind title merchandise after the lien has been recorded and contracts negotiatedI'm confident that Mr*** was explained this at the time he decided to purchase another vehicle from us only days laterWe executed a totally new purchase order and payment contract with the bankI'm not sure how Mr*** can say that he "thought" we could do it another way when all of this was disclosed to him and he had new documents he had to signI'm sure Mr*** wished that was the case but when we transfer ownership through title legally it is not that wayWe are sorry Mr*** is uncertain about his transaction at this point and we are definitely willing to go over all the figures so he can feel more comfortable about the numbersWe would not be prepared to renegotiate the request for $on this transaction

I personally have reached out to discuss Mr***'s experience on Friday of last weekUnfortunately we didn't effectively communicate with Mr*** the available options on a new car purchase and financeThe Zero percent option is available although it is only available for a shorter term
than his current loanThere is a month program available but the information obtained at the time of the visit to our showroom was there was/is a desire to lower their current paymentsThe Zero percent option would not accomplish that however, if Mr***'s only desire is to get zero percent we can submit his application to the lender for thatThe current payment Mr*** has is $for monthsIn order to lower the payments we would not be able to duplicate the term @ zero percent for monthsI am certainly open to discuss the options to lower the ***'s payments but our lenders do not offer a zero percent APR for extended terms or advances.I left a message for Mr*** to call me and he has not returned my callI can't help if we don't communicateI do feel there is a solution *** *** ***Valdosta Toyota Scion

that I could bring it back and I would just be charged for mileage and a rental fee

Valdosta Toyota has processed a change of address from ** to ** for Mr. [redacted]. He has signed a ** title application. Along with the title application he has also signed the cancellation of the products he purchased on his contract. The cancellation process on average takes about six weeks to process...

, not 3-5 days, for the funds to be returned to the lender. The $4950 cancellation is in process. The State of [redacted] controls the temporary tag process. The system will not allow us to reissue another tag after the initial 45 day temporary tag is issued. We are unable to control the license and tag process and find it unfortunate that Mr. [redacted] was unable to acquire a [redacted] Drivers License to properly register his car in [redacted] within the 45 day allotted time. We are working to complete these processes with the assistance of Mr. [redacted].

The contracts and registration do take time but all are submitted electronically. The loan for the [redacted] had already been funded which means even though you did not have any verification, we did. So that [redacted] loan had to be paid off with a check from us. You signed a new bank loan for the [redacted]. There was a separate document signed referring to bringing the vehicle back and paying rental fees. That separate document is protection for Valdosta Toyota that states if for some reason the lender fails to accept the contract on the [redacted] as written, then we can ask you pay the funds that are included in that contract in order to keep the car or you return the car upon demand to the dealership. If the vehicle is not returned upon demand then you pay a $49.95 fee per day and .35 cents per mile until the vehicle is returned should you try to keep it without the vehicle being paid for. That document is called a Bailment Agreement and is not a part of the loan agreement. The events surrounding this second transaction seems to be a little unclear and like I stated in my previous response, I would be happy to go over and explain everything that you have in question. Your Retail Purchase Agreement reads: " I have read the terms and conditions of this agreement and hereby acknowledge that this agreement is complete and accurately reflects the negotiations and agreement between the Seller and myself. If I did not understand any of the above, I have had my own representative and agent read and explain in my native language (or have had the opportunity but have elected not to do so) all of the above foregoing."Valdosta Toyota is in no position to ask you to pay us additional dollars for a vehicle after a contract is negotiated and signed. Equally as a consumer you don't have a position to ask us to pay you additional dollars on a transaction because you thought you could do something different than what the contract actually states.
