My name is [redacted] and I’m the owner of Valiant IrrigationI would like to respond to the complaint response submitted by [redacted] .Mr [redacted] has three separate issues with our company, so I’ll address them again below:Mr [redacted] alleges we have a contract and did not fulfill our contract.In Mr [redacted] ’ response, he states that we had a contract and that our foreman, Lee, required him to sign it prior to scheduling the workThis is completely falseMr [redacted] demanded that Lee put the quote/estimate in writing before leaving his property, and that they both sign itI referenced our typical procedures for providing estimates in our original responseWe do not provide handwritten quotes to our clientsWe have them typed up at our office and we email them to our clients so we can track the dates they are sent and openedWe sent our typical quote to Mr [redacted] on July 5, (please see [redacted] Quote2.pdf)This is not a contract, it is simply a cost estimate.I am attaching an example of our carbon copy contracts we provide for our installation projects (please see InstallContract.pdf)As you can see, it is a detailed carbon copy contract, created by our attorneys so that we can maintain a copy for our records, and our customers can maintain a copy for theirsWe did not have this contract with Mr [redacted] We simply provided an estimate for the work we anticipated to completeLee explained to Mr [redacted] that the handwritten bid was only an estimateMr [redacted] acknowledged that he understood(Not to mention that both the handwritten and typed versions of the quotes we provided are all labeled as “bid,” “estimate” and “quote.”)Furthermore, we did not simply refuse to complete the workWe were unable to complete the workAs stated in our original response, on three separate occasions, our foreman provided an alternative solution that would allow us to complete the work (cutting the drive to trench across it)Mr [redacted] refused this alternative solution on three separate occasions, so Lee explained we would not be able to complete that portion of the projectHe never stated that we were going to “repair” our machine and come back, once again this is a completely representation of what actually occurredLee explained that we would not be able to complete the install if Mr [redacted] would not allow us to cut the driveway to complete the trench, as explained in our original response to Mr [redacted] ’ complaint.Also, as stated in our original response, we provided an estimate for two separate projects on Mr [redacted] ’ propertyWe did not [redacted] Mr [redacted] for the portion of the work we were unable to completeOur estimate was $1,for both projects, and we only ***ed him for the portion of the work we completed successfullyMr [redacted] has not paid his now Past Due invoice in the amount of $808.40.Mr [redacted] alleges that we left a muddy mess on his driveway and refused to clean up.As stated in our original response, emails to Mr [redacted] and the video provided, our crew spent two full hours scrubbing Mr [redacted] ’ driveway with brushesAfter they scrubbed and washed off the driveway with hoses, they left to go to another job siteWe received a call from Mrs [redacted] that our crew did not hang up the hoses or place the [redacted] pot back in its original location (our crew had to move the large [redacted] pot in order to scrub the driveway) after they finished cleaning the driveWe called our crew, and they immediately returned to Mr [redacted] ’ home to hang up the hoses and replace the [redacted] pot within minutes of receiving their callWe absolutely went above and beyond to clean up the driveway and sidewalk, after we completed our workMr [redacted] alleges that we damaged his driveway.Mr [redacted] hovered over our crew for the entirety of this projectHe also took pictures of his driveway after we left on July 19, At no point during our project, during the time he documented his driveway (taking photos) or in week after, did Mr [redacted] notice or report to us any damage to his drivewayThere is no visible damage in any of the photos he provided, the photos our crew took while on the job site or in the video our crew took during and after our cleanup efforts.While Mr [redacted] hasn’t forwarded us any estimates on the supposed damage to his driveway, we did contact our liability carrier in August to reach out to Mr [redacted] A claims adjuster ( [redacted] with [redacted] Claims Solutions) met with Mr [redacted] on September 13, to inspect the alleged damage to his driveway(Our carrier is Columbia Insurance and the Claim Number is [redacted] William Oliver is the adjuster in charge of our claim, and he can be reached at ###-###-#### or [redacted] @ [redacted] .com.)We work VERY hard to provide our customers with the highest level of serviceWe are known for our dedication to quality and our professionalismWe feel that we went above and beyond to serve Mr [redacted] We have been very kind, professional and courteous despite his name calling, screaming, lies and harassment over the last several weeks.Sincerely, [redacted] Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this proposed action would not resolve my complaint For your reference, details of the offer I reviewed appear below.I was provided with a hand written bid by your employee that clearly states in his hand writing (Total Bid Price $1200) that means per our legal team that you and I agree that you will perform the work stated above for $and I agree to pay you that sum for the work stated above.Your company did not honor its agreement.You state you were unable to complete the work,I had to hire another irrigation company to complete the work which you did not complete and they brought out the same size and the same mfgequipment and was able to bore under the drive in less then two hours.They had a experienced operator and their equipment did not require repairs to complete the task at hand.I was forced to hire someone to cleanup the muddy mess your crew left behind.I also have been forced to hire a asphalt company to repair the damage that your boring machine did to my driveway which was pointed out to me by the irrigation company I was forced to hire to complete the work that your company was hired to do.This will be going to court once my asphalt is repaired.The asphalt company has already removed the damaged portion and will be finishing the repair within a week.I am willing to let a Judge decide if this was a contract and the amount of monies your company is liable for.I would strongly suggest you obtain a legal opinion before this gets out of hand and your legal expenses start mounting up [Provide details of why you are not satisfied with this resolutionPlease respond here ONLY] Regards, [redacted]

[redacted]  I contacted this company for a quote on installing additional sprinklers and installing conduit under a sidewalk and boring under my 35 foot drive,The employee from Valiant showed up and told me he could bore under my drive,install the sprinkler heads and install the conduit under my sidewalk for $1200.I told him to go ahead with this work and he told me he needed a signature from me to schedule this work,He sat in his truck and hand wrote out the agreement and we both signed the agreement(per our attorney this was a contract)since we both agreed to the work and the amount I would owe them upon completion.I had previously had another company attempt to go under the drive with a plastic water pipe with a garden hose attached but they were  only  able to bore about 10 feet since they hit some stone. I told this to the Valiant employee and he told me no problem as they had a regular boring machine(that looked like a tractor) designed to bore under driveways. They arrived to bore under my drive and had many problems with this machine,at one point they left to go purchase some duck tape to try and hold the boring bit fasteners together.They were able to get about half way under my drive and the coupling between the boring bit and the machine itself broke.I was told that they would have to wait for parts to repair this machine and they would come back when it was repaired.They had to borrow my logging chain to remove the boring bits from under the drive since the machines couplers were broke and they could not attach the boring bits to the machine.They drove the machine back on the trailer and then they took a plastic pipe with my garden hose and bored under the sidewalk for the electrical pipe.This caused a muddy mess which I was told they would clean up and if necessary stay on the property all day long to restore the driveway back to the condition it was in before they started.I left for lunch and they told me they were going to be staying to clean up the muddy mess.I received a call from my wife about 15 min later and she told me that they had left and had just threw the two garden hoses that they had used on the ground under the hose hangers and also had left a large [redacted] pot blocking a overhead door which they had moved.They also did not complete the cleaning as I was told. .She called the company and was assured that this would all be taken care of to her satisfaction.A truck arrived with in 20 mins and the men threw the two garden hoses on the hangers(did not hook them back up as they found them)They moved the [redacted] pot back  and did not clean up the muddy mess.When I arrived I called the company and was told that is the best that they would do.I also discovered after retuning home from a trip shortly after when I met another sprinkler company that was looking to finish the work that Valiant left to complete that the driveway had been damaged by Valiant when they bored under the drive.The other company pointed this out to me so they were not held responsible for the damage.I have since contracted with another company to finish the contractual agreement I had with Valiant and have also hired a asphalt company to repair the damage on the drive.the sprinklers will be installed this week and the drive will be repaired next month.I have had this reviewed by our attorney and was advised to just pay for all of this myself and sue this company for the damages. Which I plan on doing, Valiant is welcome to inspect the asphalt damage by appointment.The hand written contract has been provided to the Revdex.com by Valiant which clearly shows both parties signature's along with the muddy mess pictures left behind after they  left.I have paid another man to clean up their mess the next day.If Valiant wants to contact me to settle up these costs before court I would be happy to discuss this

Please see attachment for response and additional documents.My name is [redacted] and I'm the owner of Valiant Irrigation. I would like to respond to the complaint submitted by [redacted].Mr. [redacted] contacted our office in June 2017 requesting that we provide a quote on additions to his...

irrigation system, as well as running power to his exterior gate.On June 26, 2017, our irrigation foreman met with Mr. [redacted], surveyed the property and made notes on the project. He told Mr. [redacted] he would go back to the office, type up his quote and send it to him, per our typical procedures for providing written estimates to prospective customers, Mr. [redacted] demanded that [redacted] provide a quote on-site and sign it. [redacted] provided that written estimate to Mr. [redacted]. This was not a written contract to complete the project. This was a written quote, as detailed in the attached (please see [redacted] Quotes 1.png). When [redacted] came back to the office, we created and sent our written estimate to Mr. [redacted] (please see [redacted]Ouote2.png). As you can see on Quote 1, it's clearly labeled as a Bid. As you can see on Quote 2, it's clearly labeled as "Bid," "Estimate" and "Irrigation System Quote."On the estimates, you will see that there are two parts: boring under the driveway to install sprinklers on the West side of the driveway, and boring under sidewalk to run power to gate.On July 18, 2017, our crews went to Mr. [redacted] property to begin the install. They completed the project to bore under the sidewalk and run power to the gate, The crew then started to bore under the driveway to install a Zone on the West side of the driveway. Typically, when we bore under driveways, we span a distance of 20 feet or less, Mr. [redacted]' driveway is 35 feet across. (Please note that Mr. [redacted] hired another company in 2016 to bore under the driveway for this same project. Because the driveway is so wide, the other company was unable to complete the project, as well.)After several attempts to bore under the driveway, [redacted] explained to Mr. [redacted] that the distance was proving to be an issue for our machine to complete the boring across the 35 feet. He explained twice on the first day that our other option was to cut through Mr. [redacted]' blacktop, lay the pipe and complete the installation of the zone on the west side of the driveway. Mr. [redacted] said he did not want to do that. So our crew Continued, over a two day period, to complete the boring under the driveway. On the Second day, after countless attempts, it became clear that we would not be able to bore under the 35 foot driveway. Once again, [redacted] gave Mr. [redacted] the option of cutting the blacktop and installing the pipe across the driveway that way. Again, Mr. [redacted] declined that option, so [redacted] explained we wouldn't be able to complete the project.Our Crew cleaned up the area in which we had been working and swept off Mr. [redacted] driveway, as we typically do before we leave a job site. (We always make every reasonable effort to return a property to the way it was before we arrived.)Mr. [redacted] became irate and demanded that our crew scrub his driveway with brushes to remove the dirt from his driveway left from the tires on our trucks and equipment. After TWO HOURS of scrubbing his driveway, our crews left the property and moved on to our next job site.After leaving Mr. [redacted], our crew called me to discuss the [redacted] project. They explained that Mr. [redacted] cursed, name called, yelled at and badgered them over the two days that they worked on his property, Our office manager described similar encounters with Mr. [redacted] over the phone, as well. Our Crew felt so threatened by Mr. [redacted] that they actually recorded a video to thoroughly document their cleanup efforts. (Please see [redacted].)After our Crew left Mr. [redacted] property, he emailed me to demand that the crew come back and clean his driveway. I explained that our crew had spent two hours scrubbing his driveway, and made every reasonable effort to clean up. I also explained in that email that I was disturbed by the way Mr. [redacted] had treated our crew and office staff, and that we would no longer be providing services to him (please see [redacted]Emails 2.pdf). The way that he talked to our staff is completely unacceptable. They are good, hard working, honest people, and they deserve to be treated with dignity and respect.Mr. [redacted] responded to that email with 22 photos of his "muddy" driveway. Mr. [redacted] never even mentioned damage to his driveway in the email he sent with the 22 photos, in fact, he didn't mention supposed damage to his driveway until over a week later, when we refused to provide service to him and pay for a company to come pressure wash his driveway.As you can see in the timestamped photos taken by Mr. [redacted] himself, as well as the video our crew recorded to document their clean-up efforts, there is absolutely no visible damage to the driveway, as of the day we left the job site on July 19, 2017.In our last communication with Mr. [redacted], he stated that he was going to have his insurance company "go after your company." As of today, we haven't received any communication from Mr. [redacted]' insurance company. If we do receive correspondence from them, we will work with them directly and/or give them contact information for our local insurance agent and liability carrier, if necessary.We did invoice Mr. [redacted] for the work we completed (boring under sidewalk to run power to gate). We obviously did not charge Mr. [redacted] for the other part of our original estimate, as we were not able to complete it (please see [redacted] lnvoice.pdf). Mr. [redacted] invoice is now past due, and he has not paid us for the work we did complete.In summary:1. We did not have a written contract with Mr. [redacted]. We provided a quote to him, as shown inthe attached [redacted]Ouote1.png and [redacted]Ouote2.png,2. We made every reasonable effort to clean-up Mr. [redacted]' property prior to departure, asshown in [redacted].mov. Our Crew spent two full hours scrubbing and hosing off Mr. [redacted] driveway. 3. We provided an alternative to Mr. [redacted] for completing the project to install a zone on the west side of his driveway, and he declined on three separate occasions, 4. There is no visible evidence of any damage to Mr. [redacted] driveway in the 22 photos he sent to us after we departed from his property on July 19, or the video our crew captured on that same day, as shown in [redacted] Email2.pdf and Cleanup.mov.We work VERY hard to provide our customers with the highest level of service.
