Unfortunately I cannot speak to this specific incident without having the vehicle information I can respond to the general claim of "price gouging" Our rates are monitored by three local law enforcement agencies to ensure that rates are fair and correct for our area We follow the civil code and vehicle code in regards to how storage is calculated If this vehicle was towed off private property the customer can take the property owner to small claims court if they feel they were wrongfully towed The owner of the private property signs a form before the vehicle is towed releasing our company from any liability and advising that that vehicle is unauthorized

Complaint: [redacted] I am rejecting this response because: The business offered no resolution to either give another diagnostic since their first one was wrongThe business also offered no refund to compensate for their incorrect diagnosisThe business would not even put an OBDII reader on my car without charging me for another 'diagnosis' which seriously it takes less than minutes to clear codes and pull the new ones how is that worth $when you couldn't even do it right the first timeAlso your service writer does not know what I do and do not understand, so don't make statements about me that you literally cannot backupI've honestly never been treated with less respect by any institutionIt was not my 'choice' to not get my work done by you because I literally do not have the funds to pay those outrageous pricesIf it were a new coil to be replaced you know that even with your 'warranty parts' it takes no more than mins to do all the suggested work don't kid meAlso the coil I purchased has a lifetime warranty and it was less than half the price of the one on your estimateThe prices are neither here nor their thoughThe real issue is that you are treating me like garbage just because I didn't have my work done in your shopI still paid you $the least you could do is make an effort to right your wrongs Regards, [redacted]

I am sorry you feel as if we are not offering a resolution, the problem at hand is that you left William Wells Tire and Auto after a diagnosis and had no further work done hereYou paid for the service we provided which was the diagnosisIt’s like going to get an x-ray at a doctor’s office, then choosing to do the procedure at home yourselfThe procedure doesn’t work and you have to go back to the doctor’s office a second timeYou cannot blame the doctor’s office for a procedure that didn’t work if they didn’t do the procedureThey simply ran a test. You didn’t allow us to work on your car any furtherI am sorry you are upset, and we would like to make you feel like a valued customer, please feel free to call us so we can make things rightPlease call 662-*** and ask for *** ***

Due to unfortunate circumstances the customer's vehicle required recovery from the center divide and our company was contacted by the California Highway Patrol. The recovery and towing of the vehicle require payment. This vehicle has been claimed by the Legal Owner. We request the
customer please cease the harassing phone calls

First of all, we do not have horrible business practiceWe have been in business for over twenty yearsI have talked with my service writer and the technicianMy service writer told me you could not understand why there was a check out feeThe reason why there is a fee is because we have to buy
the machine to diagnose the cars and we have to continue to update themWe charge everyone a diagnostics fee to pay for the equipmentWe told you what was wrong and gave you an estimate. You may have been able to buy the coil for cheaper but we have contracts that allow us to have warranties on parts and the labor work that we do. You chose to leave and not let us work on the car, we don’t know if you bought the right coil, we don’t know what you’ve done to your car once it left the shopIf we would have done the work and it not fix it, we would have taken care of it but you chose to leave and not let us work on it after we did the diagnostics

the civil code and vehicle code in regards to how storage is calculated.  If this vehicle was towed off private property the customer can take the property owner to small claims court if they feel they were wrongfully towed.  The owner of the private property signs a form before the vehicle is towed releasing our company from any liability and advising that that vehicle is unauthorized.

I am rejecting this response because:  I first contact the office of William Wells Auto on Sunday 10/18 at 7am.  He told me to be at the shop at noon to pick up my car.  I, and several other people, arrived at noon and continually called the office without any replies.  I even contact the local police department and the county sheriff who offered to contact the owner of William Wells Tire and Auto.  It wasn't until 1:15 pm that the owner finally answered the phone to say he was on the way.  As it turned out, a few of his employees were already in the parking lot before him and did nothing to help the customers waiting to obtain their cars.  I found the owner to be rude, disrespectful, and argumentative when questioned as to the inability to stand by his word when he told me he would be at the shop at noon.  I, and others, waited over 90 minutes for him to arrive.  I find that unacceptable for any business owner.

Kim Scasny

I am rejecting this response because:I am not disputing that my son was parked on the business' property.  He thought it was a public road, but he was wrong. My complaint is that Smitty's Towing is charging an outrageous amount for Towing and storage. We did not choose to use this company, and when my son found out where his car was towed, he went immediately to retrieve it. He did not have the $370 and was told they were going to sell it, while adding $92 a day to the cost.  The business owner states this is a fair price for one day of storage, which is outrageous. This business is taking advantage of people with this price gouging. My son asked for my help on Wednesday (his car was towed on Monday).  I paid the amount due immediately on Wednesday, but my son was in class and could not get the car until Thursday morning. And then he was charged another $92!  I do not know what recourse I have, this business needs to be regulated or some other way to stop taking advantage of people. I was forced to pay $647 for a 10 minute tow and 4 days of storage, or they were going to take his car.

Complaint: [redacted]
I am rejecting this response because: The business offered no resolution to either give another diagnostic since their first one was wrong. The business also offered no refund to compensate for their incorrect diagnosis. The business would not even put an OBDII reader on my car without charging me for another 'diagnosis' which seriously it takes less than 5 minutes to clear codes and pull the new ones how is that worth $100 when you couldn't even do it right the first time. Also your service writer does not know what I do and do not understand, so don't make statements about me that you literally cannot backup. I've honestly never been treated with less respect by any institution. It was not my 'choice' to not get my work done by you because I literally do not have the funds to pay those outrageous prices. If it were a new coil to be replaced you know that even with your 'warranty parts' it takes no more than 30 mins to do all the suggested work don't kid me. Also the coil I purchased has a lifetime warranty and it was less than half the price of the one on your estimate. The prices are neither here nor their though. The real issue is that you are treating me like garbage just because I didn't have my work done in your shop. I still paid you $100 the least you could do is make an effort to right your wrongs.

William
Wells Tire and Auto is contractually obligated to tow any vehicles that are
illegally parked at The [redacted] Apartments upon their request. We are not responsible
for the availability of parking spots in any of these lots. We were contacted
by The [redacted] to tow-away this illegally parked...

car. The customer was contacted
on Social Media exactly two minutes after she messaged us and was told when an
employee would arrive.

We do acknowledge that Ms. [redacted] was told that she could
pick up her vehicle between 12-2pm. The employee, who was supposed to be in the
shop, had his phone die during this time. He had been out during the night
working, and had fallen asleep. The person that Ms. [redacted] is referring to as
the owner is not the owner of William Wells Tire and Auto and she in fact never
spoke to the owner. Again, she was told over Social Media when an employee
would arrive. We do sincerely apologize for this unfortunate event.
