I am responding to the complaint letter that you received from [redacted] of [redacted]. Our firm was contracted by [redacted] Company to setup and administer a 401(k) Plan for the benefit of the employees of the...
company. When the plan was initially setup, we worked with [redacted]'s partner, [redacted] to establish the plan. At that point in time [redacted] and [redacted] were partners in the company and all three were named as Trustees of the plan. Please see the enclosed pages of the Plan Document reflecting the Trustees and the executed signature pages from the Adoption Agreement. In addition, I have also enclosed a copy of the Service Agreement between [redacted] and valley Forge Pension Management in which [redacted] signed and agreed to the fees associated with the administration of the plan.We provided administrative Services to the client for the 2012 plan year in which [redacted] failed to pay for our Services rendered. Please see copy of the enclosed invoice. We terminated our service agreement with [redacted] for the 2013 plan year and sent the amount owed to collections with [redacted] in Harrisburg.
As I have demonstrated, [redacted] was aware of the establishment of the plan and the fees associated with the ongoing administration costs. As a partner/owner of the company, we believe he is responsible for the payment of Services that were provided to his company and we are not asking for any additional accrued interest on the outstanding balance of $670.
