Paradise Decks entered into a contract with [redacted] (see attached retail sales agreement #***) on November 21, for the construction of a cedar deck at their residence at [redacted] **This agreement was for $6, Due to elevation situation with the existing concrete patio, installing a deck would require a step up from the existing patio, and at customer's request, we had a change making the two areas adjacent to the sides of the existing concrete, added concrete instead of deck This required a change in the original contract to reduce the price of the deck from $6,to $4,611, with an additional contract for the concrete in the amount of $2, (see attached sales agreement #and Work By Others contract for the requested concrete work) bringing the total project price to $6, The same as the original contracted amount At the time of the premeasure, at the customer's request, additional cedar posts for the future cloth covering of the patio area were requested, resulting in an additional charge of $350, bringing the deck portion of the work to $4,961, for a total project price of $7, After completion of the project, an invoice for the work in the amount of $7,was submitted for Wells Fargo financing, and was accepted and signed by [redacted] *** At no time did Paradise decks make any changes, other than requested by the customer Additionally, the customer requested added skirting to the deck area after the project was completed in the amount of $(see change order) which was to be paid separate from the Wells Fargo financed contract as a cash payment to Paradise The customer tried to dispute the amount with Wells Fargo as well, but has been declined as Wells Fargo agrees all proper documentation was signed and agreed upon by [redacted] and [redacted]

Complaint: [redacted] I am rejecting this response because:the repairs that were agreed upon were not completed only part of them were done and those were done and look horribleThey are scheduled to come back out on Wednesday the 28th to look yet again [redacted] is coming not Rick as I requested to handle this issueI was assured by Rick it was not going to be a problem , but as with all my other dealings it's not done and frustrating to have to spend more of my time trying to get this fixed! After I deal with yet another go around with them on repairs I still need the city to inspect and get a permit issued so very stressful dealing with this for months and still not resolved Regards, [redacted]

We are currently working with Mrs [redacted] to get everything requested taken care of We will be replacing the lower deck that was demoed by mistake at our cost The pillars and additional mistakes have been taken care of or are in the process of being take care of as we speak

As my response required several supporting documents, I chose to write the response and attach the supporting documents and mail them direct to you I wrote a page response and attached documents to support my position I mailed the documents on Saturday, certified with return receipt requested I look forward to any assistance you can provide me to get paid the $9,(and now add $for the cost of filing a lien) Should you have any questions, either email me direct [redacted] or call me on my cell phone at [redacted] As Mr [redacted] has requested arbitration, I have not copied him on any correspondence He is well aware of my position on this matter Thanks, [redacted] ***

I am rejecting this response because:The company did not do the work described, specifically the posts against the bricks that was priced differently than the original quote receivedChanges were made without prior discussion or authorizationThe contract attaches the drawings that show the postsThe deck has not yet been approved by the cityThe lien appears premature as the job is not complete until approved by the cityI need to see the response from the business and request immediate arbitration to present documents and information

I met with Mr*** on Monday, October at am. I reviewed his concerns regarding the spacing on the balusters (a few of which were too far spaced) as well as an issue where the steps transition to the yard. We agreed to correct all issues, and had a service technician out at his
home the next day. Unfortunately with the rain, we did not get all issues completed, but will be back out there Monday the 26th to complete the repairs

The *** have a legitimate complaint. The spa we delivered to them has had some problems. We have had a service technician make several trips to attempt to fix the problems, it seems as if we get one fixed, another pops up. The *** have contacted an attorney who wants any
correspondence with the *** to go through him. I have asked him to arrange for another service technician to inspect and repair the spa. Although I no loner sell Cal Spas products, and they in fact have terminated my dealer agreement, I am committed to making sure the *** are satisfied with their purchase. I have asked ** ***, owner of Bell Pool and Spa to perform this service. He will contact the *** and make arrangement to inspect/repair the spa once I hear back from their attorney

I am rejecting this response because: The Sales Agreement incorporates the drawing provided showing the posts against the b*** wall into the agreementThe posts were to be anchored into concrete foundationsI have an email from the company saying they would be done (only different size)Looking back I think there was never any intent to do that work as there was no wood included for them in the materialsThere never appeared to be any effort to complete the work in a timely mannerWhen the work did not get started prior to vacation, I requested it be started immediately after returnThat did not happen for several weeksThe issue with the engineer is they told me it usually takes several weeks but it appears to have been a very fast turnaround and the extra time was used as an excuse The city [permit was not even filed until The lien was filed prior to the final approval by the city and while his right, not necessary. I am willing to pay the $now if the company will release the lien, provide proof of doing so and provide written warranty for the new homeownerThen we can continue this complaint to resolution with arbitration

We entered into a contract with Mr*** to construct a deck addition, a hip patio cover, an arbor, and a freestanding deck with a gazebo roof. I have included a copy of the drawing depicting the scope of the work, as well as some notes regarding what we contracted for. As you'll
see, we were to construct a patio cover over a portion of the deck, with an arbor covering the rest of the deck. In order to support the patio cover, we clearly showed a support post required in the middle of the cover, with the arbor to be supported by posts at the outside edge of the deck. When Mr*** saw the post, the objected, so we offered to eliminate the support post by building a cover over the entire deck, eliminating the shade arbor. We did not charge Mr*** for this change order (as he was very stressed out by the death of his mother). We absorbed the additional cost, and even stopped construction while he dealt with his mother's death. (Obviously a mistake in hindsight to "give him something for nothing" as I believe that set up a precedent he expected us to follow. When we went back to work to complete the project, we built the freestanding gazebo out in the yard, which unlike the upper deck, is flat on the ground. As I noted on the drawing, there is no detail showing this is to have any type of rail, just benches. When you look at the other attachment (*** contract) which is the specification sheet, and you will notice that the section marked handrail has a large "X" drawn across it. Now Mr*** expects us to put a rail around it for FREE! We told him we would be glad to provide a rail, but not for "FREE". We bend over backwards to make sure our customers are happy with us, but unfortunately some customers are just unreasonable!
