Review: We've been customers and happy with Valley Waste Disposal of [redacted] for many years. Recently Valley Waste changed their pickup schedule and vehicle type (now using a large, loud commercial garbage truck to pickup recyclables-had been using a pickup truck prior) and now enters our neighborhood shortly after 5am (before they had been coming in later in the morning). Contacted Valley Waste-spoke with Ms. Gwynanne Rogers to ask if they could go back to original schedule or original vehicle since the new one is much louder and my wife and I work late and this was waking our family. [redacted] explained that they could only adjust schedule slightly (5:15 am to 5:45 am) as this would disrupt their "route". This was not an acceptable remedy and I reminded her of the county laws regarding noise and business operation with commercial equipment prior to 7am. She explained that there was nothing she could do. Our phone conversations remained professional and although we disagree on the remedy, we both remained professional and polite over the phone. Despite numerous written and electronic mail requests (on file, dated and available) to [redacted] to please stop waking our family up and delay pickup until after 7am, the only correspondence to our written letters and emails was an email response from [redacted] canceling our trash service without request or refund or explanation. Even though [redacted] received similar requests from other neighbors and promising to adjust schedule to after 7am, the commercial vehicle was again observed and reported to the [redacted] County Sheriffs office as an official noise complaint as recently as December 24th, 2013 at 5:35 am.Desired Settlement: Provide explanation for cancellation of our service without refund or written notice after having been customers for many years.Delay pickup of trash and recyclables until after 7am or later as they had in the past and as other trash services do in our neighborhood as it is causing loss of sleep, loss of work and stress on our family.

Response:

Spoke with the business she states that they changed the time to 6 due to safely issues with children and school buses. This was not the time the customer wanted but again due to safety issues this was the only time that would work. They have tried to work with the what the customer wants and now they have even started in a different area so that their trucks are close to his house even later.

His payment of $72 was for services Sep 1 Nov 30, that was paid 9/27 check number [redacted] and his service was terminated on 12/1. No refund is available as the service he paid for was provided and no other service was paid for.

We have reviewed the offer made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.

We cannot accept Valleys explanation because she fails to address the main complaint that our neighorhood has with them. Valley chooses to ignore [redacted] County noise ordinance 654.02(b)-specifically the use of machinery for business that disturbs the peace prior to 7am and then cancels customers contracts for asking them to comply with the law.

This is the first time she has used the word "safety" in any exchange. She explained to me as well as other neighbors that moving the pickup would disrupt "their" schedule. Even when promising other neighbors that complained that they would not enter the neighborhood prior to a specific time, they continue to anyway. The reason the "safety" excuse with reference to children and schoolbuses doesnt fly is that regardless of whether they enter our neighborhood at 5 or 6 am, their route will inevitably intersect some school bus traffic at some point- its unavoidable. Is it just coincidence that the first schoolbuses enter our neighborhood at 7am? Valley wants to beat the bus traffic and chooses to ignore the law and complaints from neighbors and customers.

They adjusted their schedule for their needs and moved to an earlier time with a noisy commercial trash vehicle when their business got bigger-she told me this herself. Now they will not comply with [redacted] County law and cancel contracts of customers who dont agree. We will pursue legal remedies as our next recourse if they are unwilling to comply with the law.
