To Whom It May Concern:Mr [redacted] purchased a pre-owned BMW from us at BMW of Milwaukee NorthShortly thereafter he became aware of an engine noise that he found concerningWe invited the BMW regional technical engineer to evaluate the condition at which time the engineer suggested a repair path to pursue that would be fully covered under warranty and the repairs would be performed at no charge to Mr [redacted] .Mr [redacted] refused to allow us to proceed with this factory authorized and recommended remedySince the car was a pre-owned car it was not going to be repurchased, but rather it could be exchanged for a like-in-kind modelAs one might imagine, no two pre-owned cars are exactly the same, but the dealership did pursue the exchange as a remedyMr [redacted] ’s original purchase was a BMW 320i X-Drive with 42,miles and the vehicle the dealership presented as a possible exchange was a BMW 320i X-drive with 40,milesThe exchange vehicle, in addition to being one year newer with fewer miles, had more equipment than the car originally purchasedSpecifically, the additional equipment included the BMW “Sport Package” which includes, among other things, upgraded wheels and upgraded interior seating.While the exchange offered included new finance terms which made Mr [redacted] ’s payment exactly the same as his previous contract with no additional cash at delivery, Mr [redacted] expected the three payments that he made while driving his original purchase (the ~ $to which he refers in his comments) to be subtracted from the terms of the new contractWe feel that by offering Mr [redacted] an exchange that included the benefits of a one-year newer vehicle with fewer miles and which included an equipment upgrade, that his request to essentially be also reimbursed for the use to which he put his original purchase is unreasonable and was deniedPlease remember that the repair in question was merely to remedy Mr [redacted] ’s opinion that the engine was too “noisy” and that the car was never rendered immobileMr [redacted] is now driving the vehicle we offered him at the terms described above as he has executed the appropriate documentsWe feel that we have been more than fair in resolving Mr [redacted] ’s concerns

We are willing to replace the brake pads on this car, but new rotors are never necessary unless it can be demonstrated that the brake pedal is pulsating upon application.When the owner took delivery of this car, the brake pedal was definitely not pulsating and the car met the BMW standard for... Certification.

We have agreed to install this piece of seat trim at no charge to our customerThe part was ordered on October 19th and is sourced from Germany, so there will be a delay in the actual installation

I'm sorry for the delay, we were waiting for this:  We have now received confirmation, from all three possible sources that are used for BMW direct mail marketing, that this addressee has been eliminated from all mailing lists.

When I took delivery of the car, the expectation set by BMW of Milwaukee North was that the brakes (pads and rotors) were new. Regardless of BMW's certification and current state of the brakes, BMW of Milwaukee North intentionally misled me before taking delivery of the car and is continuing to backpedal despite the fact that I have clear evidence regarding the matter at hand. The brake pads and rotors need to be replaced regardless of "pulsating." There is no justification for BMW of Milwaukee North to refuse to amend the issue. I was not told the brakes were "certified." I was not told the brakes were "inspected." I was told the brakes were "re-done." Again, I set the expectation that the brake pads and rotors are to be replaced.
