September 6, 2017VB Masonry Plus were hired by complainant to Stucco Finish the outside of their new construction house in May of 2017. Work began in June of 2017. During the month of June 2017 VB Masonry applied the following steps to customers house: Applied fiber mesh and expansion... joint over the [redacted] that was previously applied by either the customer or their framer, first coat/scratch coat of Type S mortar and second coat/brown coat also Type S mortar. This is an application that the owner of VB Masonry Plus has performed for over 20 plus years for not only homeowners but many building contractors also. At this point at the end of June 2017 VB Masonry Plus did have another job that needed to be completed. VB Masonry had scaffolding, miscellaneous tools and a mixer at customers jobsite. The only item every removed from the job site was the mixer that was needed on the other job. The scaffolding, plank boards and other miscellaneous tool NEVER were removed from Customers job as customer states in complaint. There are several text messages between VB Masonry Plus and the customer keeping her appraised of when they would be returning to the job.On July 5, 2017 the customer sent a text saying they just saw cracks all over the house in the first two coats. On July 7, 2017 the owner of VB Masonry Plus sent a text saying he would like to get together with the customer to walk around the house due to the cracking. VB Masonry Plus met with customers on July 13, 2017 concerning the cracking issues. Customer wanted to proceed with application of third and final coat of Stucco material after this meeting. Again VB Masonry Plus never threatened to stop work. On July 18, 2017 the customer was informed that the stucco was on back order. VB Masonry Plus returned to work on July 31, 2017. Once the third coat was being applied Cracks Continued showing through material. VB Masonry Plus was in contact with the customer at all times during this process being that they live in front of the house under construction and are currently doing work in the house themselves. On August 8, 2017 customer texted that they would like the stucco finish to be applied thicker. VB Masonry Plus asked how much thicker customer stated 1/8" - 1/16". VB Masonry Plus replied via text “that's no problem I can do that” not “if you don’t like my work I'm not Coming back" as per stated in complaint. As per standard stucco application all three coating layers are to be between approximately 7/8"-1" thick by accommodating the customer request of 1/8" - 1/16" VB Masonry Plus would still be within the allowable amount per application standards.Since VB Masonry Plus knew this was not an application issue they consulted some building contractors to inquire about other reasons these cracks may be happening. At this point on August 9, 2017 VB Masonry Plus did not want to continue applying more product to the house if the customer was going to be unhappy with the finished product. VB Masonry Plus did not believe applying the stucco finish thicker would fix the cracking issue. VB Masonry Plus expressed with the customer that they did not believe applying the stucco thicker would fix the issue. After several unpleasant text messages and phone calls from the female customer on August 9, 2017 VB Masonry Plus wanted to meet with the male customer to again go over the job. VB Masonry Plus met with the customer again on August 10,2017 the day this complaint was filed. During this meeting the customer was provided with information regarding if the house has structural issues such as foundation issues or inadequate bracing of the structure that cracking can occur. They were also provided information on stucco exteriors being applied over wood frame construction resulting in more cracking because of shrinkage. The customers were provided information stating that cracks that are less than 1/16" wide will occur and are expected. The customers were provided information stating that these cracks generally do not leak or indicate substandard work. At this meeting in the evening of August 10, 2017 customers expressed they did not believe it to be an application problem but their thoughts were possibly the product dried too quickly. Again homeowners wanted to proceed with application of the stucco finish. It was agreed by homeowner and VB Masonry Plus that a small test section would be done then covered with a tarp in order to dry at a slower rate. On August 11, 2017 VB Masonry Plus did the smaller section as asked by the customer. Text messages were sent again by VB Masonry Plus to female customer to say the section was done as asked by the customer and once it dries the decision can be made to whether to proceed. On August 12, 2107 VB Masonry Plus received at text from the customer that the finish looked much better and to please move to the two huge walls on the side. Customer also asked to use VB Masonry Plus's scaffolding to paint the sides once dried. On August 13, 2017 received another text from female customer saying it looks so much better and eventoned. VB Masonry Plus asked if she would like them to continue tomorrow or next week customer replied "yes please". After this time Customer Sent other requests that VB Masonry Plus accommodated. After this point VB Masonry Plus received compliments via text about the beveled edges that were done around the window being beautiful. VB Masonry Plus completed job as per all customer requests on August 18, 2017. When VB Masonry Plus completed job on August 18, 2017 customers were supposed to be getting prices on stucco paint to correct any areas they felt it was needed. VB Masonry Plus in good faith left two sections of scaffolding for customers to use for painting. On August 24, 2017 VB Masonry Plus contacted customer to see if they got paint prices as previously agreed upon so final payment can be made. Customer informed VB Masonry Plus they will not be making any final payment. As of this time VB Masonry Plus has received $13,000.00 in payment not $14,000.00 as stated per customer complaint. First payment of S7,000.00 made at start of job. Second payment of S6,000.00 made after second coat/brown coat was finished on June 29, 2017. On August 24,2017 VB Masonry Plus was also sent a text saying that if we were to try and come and get our two sections of scaffolding that she would have us arrested, scaffolding remains at customers house. On August 28, 2017 VB Masonry Plus again received a text from Customer saying she was having two product representatives come to the house which VB Masonry Plus asked if he could also attend the meeting and was denied. VB Masonry Plus does not nor ever did believe this to be an application issue. VB Masonry Plus did everything possible to comply with customers requests to complete job.Desired Settlement as per complaint filed on August 10, 2017 was stated as finish the job. Job was completed on August 18, 2017.
