Reply To: VIA EMAIL ( [redacted] ) August 10, [redacted] Dispute Resolution Specialist Revdex.com Servicing Northeastern, Ohio Euclid Avenue, Fourth Floor Cleveland, OH Re: [redacted] vJared Z [redacted] and Amy F*r of Howard Hanna ODRE Case No: [redacted] [redacted] , I represent Howard Hanna Property Management and the other Respondents to this ComplaintPlease direct any future communication to my attention [redacted] was the owner of a property at [redacted] *** [redacted] retained Howard Hanna Property Management ("HHPM") on December 26, to manage the rental of the propertyThe terms of the management agreement are contained in the attached exhibit [redacted] rented this property on February 1, through the assistance of Jacob D [redacted] and agent in Howard Hanna's [redacted] officeThe property was leased on February 1, The tenants remained in the property, and at the end of the lease, [redacted] authorized HHPM to sign a one year renewal of the lease with the tenantsThe water bill was the tenants' responsibility and at times the tenants struggled to stay current with the paymentFor a short term the water bill was uploaded into HHPM system to make certain the bill was paid [redacted] subsequently requested that HHPM no longer process the water bill and required the tenants to pay the City of [redacted] directly for their water usage [redacted] contacted Amy F [redacted] to notify her that he wanted to sell the property and instructed her to inform the tenants that he would allow them to terminate the lease earlyThe tenant responded on June 19, that they would move out early if [redacted] paid for their move [redacted] declined to pay for their moveOn July 9th, the tenants notified Amy F [redacted] that they would not be paying their last month's rent and Amy notified [redacted] shortly thereafterThe tenants vacated the premises on July and HHPM conducted a walkthrough move out inspection that same dayAt the time of move out the tenants owed a total of $1,249.60: $for July rent, $HHPM is holding $security deposit which will be credited to [redacted] on August 15, with his monthly statementWe made a generous offer of $to resolve this disputeThis regards one half of [redacted] 's financial lossThis offer was made not out of a belief that we have any liability but solely as a good faith effort to keep a customer satisfiedThis offer was rejectedThis offer is no longer available [redacted] made two requests which caused him unnecessary financial lossThe first was the request for HHPM to no longer pay and track the water and sewer billsBy removing our oversight and payment of these bills they were removed from our accounting system and ability to effectively track the balance dueThe second was asking the tenants if they would consider vacating the home and being released from their lease agreement which was scheduled to end 1/31/This course of action immediately changed the dynamic between the landlord and tenant relationship which [redacted] was advised may occurPrior to these instructions, the tenants had paid their rent on time except for one day for the previous month rental periodsThe following sections of the agreement are important to note based on his claimsPage first paragraph: "Landlord agrees to hold broker harmless for any failure to secure Tenants for Landlord, any cancellation by the tenants and/or failure to collect any rents or monies due from tenants for any reasonLandlord understands and agrees that a tenant cannot be forced to pay anything" Page Insurance /Fees/ Taxes /Charges: "Landlord agrees to and does hereby indemnify and hold harmless broker, its employees, agents and assigns, from any and all claims, suits, damages, costs, losses and expenses arising from the management of the property and from any injury to persons and/or property occurring on or about the premises unless due to Brokers negligencePage Tenant's security deposit, Damage or Missing Items: "Broker is not responsible for damage to the premises under any circumstance..." I have attached bank statements showing all the payments that I have paid to Howard Hanna starting with the first rent payment on 11/03/to the most current dateI have also attached my payment ledger from Howard Hanna again, and I have attached the lease documents from Howard Hanna showing all the utility bills that they have submitted to me so farIf you look at the lease document dates that Howard Hanna uploaded and emailed the utility bills to me you can see that the 12/- 1/water bill was emailed to me on 1/18/2016, and on my tenant ledger I paid the 12/3-1/water bill on 01/19/16, but for some reason they charged me again on 02/01/for the 12/3-1/water billIf you look at the dates from the lease documents and see when they emailed the water bills to me and look at the dates on my tenant ledger you will see that every time a utility bill was submitted to me I paid the bill either by the next day of receiving it or a few days after it was submitted to meThe only bill that was not paid right away was the first water bill for $because I was disputing that billBut for some reason they continue to lie and will not accept that they are charging me twice for the 12/- 1/6 bill

Complainant, *** ***, listed a piece of vacant land at *** *** ***, *** Ohio with Howard Hanna through its agent Lynda G***The listing agreement was signed on August 29, for a six-month term from August through March 1, In DecemberLynda notified her manager Kimm B*** that she was leaving Howard HannaLynda and Kimm spoke in late December as to whom she would like to handle her current listings/transactionsLynda told Karen that she would like Linda W*** to complete her transactions and cover her listings, except for one transaction that Lauren M*** was currently working onKimm B*** told Lynda that she would contact each seller and let them know that Linda was taking over and plans made to have the Designated Licensee Change form completedThe Complainant is a friend of Lynda so Lynda offered to speak with them directly and follow up with Linda. Who is Amy F*? Amy A***? Please note that I never instructed HHPM to stop oversight of the water bill, that request came from the tenant who refused to follow the process outlined(I do have emails from Amy A*** that confirms)This was after I paid a water bill on behalf of the tenantLet's put this in perspective, this is not a $bill, it was more than $The water bill disconnection was sent to HHPM several times by me and I requested several times that HH work with the tenant to develop a plan to address (I have those emails) plus HHPM continued to get water bills and disconnection notices for the duration of the tenancyAlso note that I facilitated a way call with Amy A*** and the tenant because of the outstanding issues with the water billThis was not my responsibility.Please note that Amy A*** did not inform me that the tenants would not be paying July's rentThe letter stated Amy was notified on 7/by the tenantI was only told about this situation when I specifically asked on 7/17/HHPM should be advocating for their clientThe offer was rejected because HHPM required me to sign a release which I assume would have taken away my ability to file any complaints and I do not consider this generous based on my lossesHHPM did not act properlyI was told that quarterly inspections would occur on the property by HHPM, and this was advertised in their brochuresThere was only one in the month tenancyIf this had occur as expected perhaps it would have uncovered damages, smoking/pet on premises and tenant using the residence as a business, all violations of the HH leasePhone calls and emails were not returned, self imposed HHPM deadlines were not met as outlined in my complaintAnd this continues, for example, I was told by Jared Z** on 7/28/that the security deposit would be credited in one week (I also have that email)The tenant was calling me directly for repairs because HHPM was not returning phone calls (I have those emails)The brochure I was given states "No Hassles no headaches no problems"Thanks for efforts in this complaint but please note that I do not accept this response as resolution
