Failure to pay me for consigned goods that were sold and not being able to access goods not sold.I have talked numerous times to [redacted] B.-no success.On [redacted] signed contract to sell a king size bedroom set. In [redacted] 2015 received letter stating they sold part of set in [redacted] 2014. I was never given my money. I called them after receiving letter in [redacted] because they still had the bed left. They wanted to buy it outright for [redacted] per [redacted] B. After several phone calls to [redacted] without no satisfaction (they kept saying we will check with someone and get back to you) I made my final call on [redacted] to call me to settle this matter. They did not return my phone call so I instructed them if they did not get back to me by 12 noon on [redacted] I would be taking legal action to recoup my money. I would like to file a Chapter 93A suit as this clearly is indicated as they have been deceptive in their business practices. Please advise.Desired SettlementI want the money they owe me for the complete bedroom set. Business Response - First and foremost, we are sorry that the complaint even had to reach your office, as we have been making great efforts and strides to address any and all customer complaints internally;- Having stated that, regarding Ms. [redacted]'s particular complaint, Vanguard acknowledges that she had to wait an unreasonable amount of time to receive her proceeds check from her consignment, and for that, we apologize. - The issue involved in her matter which has led to this delay is the fact that Ms. [redacted]'s particular Consignment Contract with Vanguard included multiple items of furniture, not just one. Ms. [redacted]'s furniture came into Vanguard in 2014, and it is true that some of it was sold that year. However, on the occasions when she may have called Vanguard to inquire as to the status of her contract, the software program used by Vanguard at that time would state that her contract was still "open", only because there was at least one unsold item remaining on the sales room floor. It was not until most recently that her last item was sold, and in fact, Ms. [redacted]'s final proceeds check will be mailed out to her by the end of next week (along with a copy of her Transactional Breakdown). - Although it does not address the fact that Ms. [redacted] had to wait for her payment, Vanguard is implementing various upgrades and updating its procedures so that such issues will not occur in the future. I trust this will address Ms. [redacted]'s concerns. Failure to compensate for items that were sold and failure to disclose a pick up fee.In [redacted] 2014 I coined furniture to Vanguard, a coffee table, sofa table and 2 end tables. On [redacted] 2015, I went to Vanguard to check on my furniture. When I got there I spoke to the owner, [redacted], and he informed me that 2 of the items had sold in [redacted] for [redacted] and I would be receiving a check for [redacted] He informed me that all checks are cut on Thursdays and I will be getting it in a week or so. By [redacted] I had not received the check so I went back to visit and retrieve my remaining furniture. Mr [redacted] said the check hadn't been printed yet and would go out that week. I also agreed to sell him the remaining furniture for [redacted] of which he was able to pay me cash. It has been 3 weeks and still no check. I called this morning and was told they would be taking [redacted] out of the check for a pick up fee. I have sold thru them several items since 2010 and have received over [redacted] compensation from them and never was there ever a "Pick Up Fee" if they sold the furniture. There is no such fee or statement that one would be chargedDesired SettlementAll I want is what I contracted for, which was half of the selling amount, which was [redacted] = [redacted] There is no "Pick Up Fee" listed or statement as to one on their contract.Business Response Yes we talked with Mr. [redacted] regarding his account. He was told there would be a [redacted] pick up fee due to the fact that we don't go anywhere with two guys and a big truck for FREE.... We have to pay movers and fuel. He continued calling our business several times one right after the other and we finally told him to do what he wanted to do for the [redacted] In the end it really wasnt worth dealing with someone like Mr. [redacted] who clearly had nothing better to do on a Friday morning and Friday Afternoon than to blow up our phone. I mailed him a check for [redacted] on [redacted] Hopefully this will make him happy and satisfied. Thank you

Complaint They sold my mother ([redacted]) furniture and are not paying her the money due from the sale$1149.00.Mother is selling her condo. I called Vanguard because they sell furniture on consignment. I figured we could at least get something for the furniture. They came and picked up the furniture which was dining room table w 6 chairs, dining room large cherry hutch, red sofa, white dresser w mirror, white metal headboard. In the contract, it asks to give them 90 days to sell the merchandise. Fine. 90 days have come and gone. They picked up the furniture on June 14, 2013. All the items have sold. I know because they told me and I have an item report showing that. They owe my mother ([redacted]) and 86yr woman on soc. sec. $1149.50.She paid they a $75.00 pick up fee when they came to get the furniture.I have called many times and got the run around i.e. we will get to it. Soon, By next week, etc.I must have called at least 10 times. I did ask them to send the check to me [redacted].(her daughter) I am taking care of all business dealings for my mother.So far no check. There is no reason why they should be holding on to her money. There are expenses involved in selling a condo and she could certainly use the money for this and also to help pay bills. Her husband is in the Holyoke Soldiers Home with severe Alzheimers disease and according to doctors his time is very short. Needless to say she does not need this unnecessary stress worrying about her money. She asks me everyday if the check came.We did our part and trusted them in good faith to do the right thing. When I mention to others about the trouble I'm having getting the money, many people said that it very hard to get your money from these people. Apparently I'm not the only victim.I happen to be talking to our lawyer and she suggested to tell them if they don't pay up that I could put a 93A deceptive business claim. I called and told they I may do that. The owner was supposed to call me back. No call. That is why I am writing you. This company failed to pay me my share of the sale of my furniture. On 9/10/13 I went into agreement with Vanguard Consignment to sell my dining table, chairs and hutch. In early December 2013 I noticed the items were no longer on their website. I called at that time and was told the sale was in process and I would be receiving a check shortly. I have since made numerous phone calls looking for answers as to where my check was. I have spoken to the owner [redacted] every week for the last few weeks. Each time is one excuse after the other. I spoke to him on Monday Jan 13 2014. He told me the sales of the items was final and a check would be cut that Wed Jan 15. He said I should have it early the following week. When I did not receive it by Friday Jan 24 I called him again. He told me he was to busy to look it up to see if a check actually went out. I told him if I did not receive a call I would have to take further action. He actually said, "Do what you must, do not threaten me" He then promised to call me back later in the day. That did not happen. At this point I wonder if I will ever receive my money.Desired SettlementAll I want is to receive the money due me from the sale of my furniture. I also want to know how much my furniture sold for.

Vanguard picked up bdrm set 4/12/12 and I was never able to get info from them again. no ret calls rec'd from VM and msgs left with emp. tried for 8 m4/13/12 [redacted] picked up antique bdrm set: Vanity with mirror, full size bed with headboard and footboard, wardrobe, dresser with mirror. I was told they would call me with details as to selling price and I would be paid 50% of the selling price. Was told the set would sell for up to $1000.00 because it was in very good condition.I tried to reach them after 1 month. woman who wered phone could not find any info about my furniture, but she said it was her 1st day on the job. she would give msg to owner to call me. I never got a call. tried again in 7/12/12 and spoke with [redacted]. she told me she was new that week and didn't know how accts were found. she tolme she would call back the next day with my information. I tried again in a week and left msg on voice mail. no response. I started calling evy week or 10 days. Never got a live person that answered the phone. In Jan 2013 I again spoke with a female who was new and she would relay the message. Never heard from anyone. checked the website and never found my bedroom set shown. On sistMay 21, 2012, I consigned a glass & wrought iron dining table with 4 chairs and a matching glass & wrought iron hutch to Vanguard Consignment. The contract stated I would receive 50% of the selling price.I called from July 2012 to December 2012 asking if my set was sold. I was told there was no documentation indicating that it was, so on December 19,2012 I went into their store with a friend to see if my furniture was still there. We searched the store and did not find the furniture. I then went to the front desk and spoke to the owner, [redacted] who told me the table and chairs sold, but not the hutch. I asked for my money for the dining set and he told me their policy was to have everything sold before he would release a check. I tried arguing the point, but ended up leaving. My friend said to go back and demand the money for what was sold. He got very upset and wrote me a check for the dining set telling me to never set foot in his store again, so I lost out on the money for the hutch, not knowing if it sold or for how much.The fact of the matter is, I was intimidated and frightened to go back. Also I had purchased this entire set from him 5 years before, so I paid on both ends and he made out.... I have heard of others having bad experiences as well. I was vulnerable as I had just lost my [redacted] 5 days prior and was in a very emotional state.Desired SettlementI would like to have his records looked to see how much that the hutch sold for and receive the money I am owed.

Several pieces of furniture were picked up for consignment by Vanguard Consignment on 8/19/11 as we were moving. Term was 90 days, and did not hear from them. Called back and extended the time for sale after the 90 days. Called again to check and they said no one was there to check my account, to the computers were down. After some time, stopped into the store myself and asked to receive a statement. This was June 14, 2013, and it said a boston rocker had sold for [redacted] and a dining ro set was sold for [redacted] Looked around the store and saw the dining room set was still on the sales floor for sale. [redacted] said there was a deposit on it. Said to call back on Monday. Called back person not there. Checked today 6/13/14 because I will be going to the area today and would stop in.Desired SettlementPayment for the sold furniture. My account # is [redacted]

They came and picked furniture up for concignment in June 2013. In July 2013 I was told I could expect a check in 30 days. No check and no response.They picked furniture up at my home at the end of June 2013 in Southwick, Ma prior to my move to Houston TX. I called in July to see if I needed to renew contract, they put me on hold for a very long time and then said they confirmed everything sold they just needed to get numbers togther and I should have a check within 30 days. I waited 6 weeks, no check. I called again was disconnected twice. I wrote a letter and included a copy of the contract requestimg payment. I sent an e-mail using this site as well, no response. Desired SettlementPayment for the furniture they removed from my home as per terms of the contract 50% of what they sold it for plus interest since this has been unresolved since July 2013.

I placed with vanguard consignment x2 tiffany style table lamps, x1 tiffany style floor lamp and x1 medal wine rack for sale in august of 2011. No one expalin to me I was to pick-up my stuff after 90 days ,if it did not sell. I call vanguard in july of 2012 and was told that the lamps had sold ,but the wine rack had not sold. I was told at this time ,Iwould receive payment. Which I did not receive. I call again in june of 2013,and was informed they were checking into this. I never recieved payment for them. If you are no longer a cosignment shop,but are stealing other people property. No one even call me to pick-up my items after they didn,t sell.
