The following letter shall address the points made by Ms*** in complaint ID ***.Ms*** asserts that the $cash that she gave to Ms*** was “the balance of what was owed per our agreement.”First it is necessary to outline what this “agreement” entailed, and how it is different from a legally binding contract. Ms***’s kitten was gifted to her. Because he was born small and fragile, Ms*** hand-fed him and spent hundreds of dollars of her own money in veterinary bills getting him healthy; although he was deemed by the veterinarian to be in perfect health, Ms*** chose not to sell him as a full-priced, show quality Ragdoll cat. Instead, she began searching for an adoptive family who would provide him with a loving home, and she chose Ms*** who, at the time, was a friend of Ms***.The agreement was that Ms*** would reimburse Ms*** for the neuter surgery of this kitten, which totaled $150. Ms*** sent Ms*** a check for $50, and then paid the $cash balance, which paid for his surgery. A contract was not offered or provided, because this kitten was a gift. He was given to Ms*** free and clear of all legal bindings, and Ms*** received no money in exchange. I assert this because the money that Ms*** did receive, was simply a reimbursement of the veterinarian’s costs for his neuter surgery. If this kitten had not been a gift, but rather had been sold at the full price of $850.00, Ms*** would be entitled to his registration and pedigree. Ms*** did not pay the full price; he was gifted, therefore there is no contract and there is no entitlement to registration and pedigree papers.Ms*** asserts that there are “many more in the same predicament,” and that her complaint shows the “true vindictive character of a self proclaimed cat breeder.” Unfortunately, there are some individuals who have been making claims about Ms*** and who seem to be on a campaign to ruin her reputation. She has been slandered on social media, reported to several agencies, and has been cleared of any wrong doing by said agencies. The complaints to the Revdex.com are yet another example of this. Ms*** is in the process of commencing litigation against these people. The bottom line is, this is not an issue for the Revdex.com. Ms***’s kitten was given as a gift, not purchased as a business transaction. Should Ms*** believe that she has been wronged civilly, she is free to take this issue up in court

AGAIN, Ms [redacted] is very good at “flooding” the situation with other unnecessary information, and tries to change the subject, and distract others from her wrong doings. The complaint is, this “self claimed breeder” (not licensed) refuses to send registration and all vet medical records of my cat, NOT her cat. She is trying to distract the Revdex.com and others by her side-tracking the issue. This is her initial response: “I will state for the last time that I have done no business with a Sue Evans. No monies were given to me, she can produce no receipt & no contract. RM [redacted].”   As stated before, her lies and deception.Again, receiving the cat from her in person, money transactions, and her signing documents, is legal proof there was a “business transaction”.Her twisting ways trying to manipulate the truth is off tract of the subject and shows her unethical ways of a so called breeder. Her definition and belief of “doing business” is totally different from the true definition of  The laws of NY State: RECORDS - §402For each animal handled, whether by sale or by gift, the following records are required:? Source(s): name, address, federal identification number, if applicable.? For cats, state if source is unknown and include date, time and location received.? Date acquired? Description, including all identification and any available medical history information.? Disposition: Name and address of person(s) receiving the animal. Include date and method ofreceipt.ANIMAL PEDIGREE REGISTRATION - §753-c–Any pet dealer who states, promises, or represents that an animal is registered or capable of registration with an animal pedigree registry organization shall provide the purchaser with the appropriate documentsneeded for such registration within one hundred twenty (120) days following the sale of the animal. If the purchaser has not received these documents within this time period and they notify the pet dealer of this in writing, the pet dealer shall have an additional sixty (60) days to provide the documents necessary for registration with the stated pedigree registry organization. The 120 and the 60 days periods were both ignored by Ms [redacted]. The proof  of “doing business” has been stated as well as the Laws of NY, which Ms [redacted] has chosen to “redefine the laws.” Again she tries to distract everyone on the issue. If Ms [redacted] and any representatives of hers, are allowed to continue with off the subject statements, then this complaint will continue indefinitely.

I have purchased several ragdoll cats from all over the country and I've never gotten anything from any of them about being a licensed breeder. Most states do not require it. You should have a business license, but hobby breeders usually don't have any type of state license to breed cats. The fact that she's had inspections done is great. Selling a cat with a contract is a great idea, but I know lots of places that don't. If no guarantees of health or anything like that are made, a contract is basically a bill of sale. I agree that she should provide the registration papers, and hopefully that was resolved at some point. https://www.animallaw.info/topic/table-state-commercial-pet-breeders-laws
