I have reviewed the response made by the business in reference to complaint ID ***, and find that this resolution is some what satisfactory to me. I did not get charged with theft nor receive a ticket of any sort There is a permanent incident report on my home address that is very upsetting to me I am not a criminal and have a clean record I am a Mother, wife and student who was only trying to prevent any damage being done to my property The tools were returned within a few minutesI was honest with the police unlike the employee of Vannguard The employee of Vannguard set his tools down on my property and sat on my utility box. The tools were past the easement, on my property and it was at that point I felt I had the right to move the tools off my property and return the tools asapThe tools never got brought into my home They were returned to the employees car There was a misunderstanding otherwise why else was the ticket cancelled by Xcel and at that point Vanngaurds services were not needed Yes, I am pregnant and might of been emotional during the matter however I was trying to save my newly installed driveway from getting permanent red spray paint that was not necessary I also felt threatened by this employee who would not leave my property after being asked several times It was after that point that the employee of Vannguard refusing to leave and not giving me any information that I felt threatened as a citizen on my own property My whole point in contacting Vanngaurd the first time was to inform them of an employee who was disrespectful but as I can see it is not an interest to the CEO I have spoke to Xcel regarding the issue and perhaps they will think twice about who is representing them in the future. I understand Vannguard had a job to do however he had till the following day and could of come back within a few hours or the following morning He was not listening to me in the fact that I kept telling him there was a misunderstanding Tell me why the employee of Vanngaurd could not just come back so I could contact Xcel? Like I said the ticket was cancelled and Xcel did not know we had a new driveway installed and realized there was not going to be any digging and it was an error on their part for calling Vanngaurd. It is very sad that the CEO could not acknowledge my emails or letters with an apologize of any sort So in other words he is saying it is okay that his employee is walking around treating human beings with disrespect, especially woman The CEO did not take anything into consideration that I had said Like how the employee refused to give me any information nor listen to anything I had to sayAlso the employee was not even wearing any uniform or badge Now days its just not safe and we cannot trust anyone.This issue would of never got to this point if Xcel themselves would of came to my property to assess the situation before contacting Vannguard Also Vannguards employee could of came back to my property within a few hours so I could have the chance to contact Xcel.So it comes down to his word against mine I am an honest person and its upsetting when people straight up lies I have nothing to hide and I just pray to God no other woman experiences what I did I honestly thought I was doing Vannguard a favor by letting them see how they were being represented in Minnesota

Vannguard Utility Partners, Inc. is a contract locating company. This means we a contracted by utilities in various state to locate their underground facilities. This is for public safety and utility damage prevention when an individual or excavating company plans to dig in a given area. By law...

utilities and their contractors have a right to the public right-of-way (utility easement). My employee arrived at Mrs. [redacted] address to locate for some excavation that was going to be done by Xcel Energy (which was going to be near her driveway). My employee was getting ready to locate when Mrs. [redacted] came out to ask what he was doing. He explained to her the locate that was requested when Mrs. [redacted] became irrational and would not let my employee perform his job. My company is liable for utility damages if facilities are not located along with the discipline of employees if/when they occur. My employee did not stop her from getting her phone or husband. It was that she didn’t want to leave my employee if fear that he would begin performing his (by law) job. This whole situation escalated when my employee walked away from her and his equipment for a few minutes. When he returned she had taken his equipment into her house and that is when he called the police. When the officer arrived he sorted through everything and told my employee he was free to leave and had threatened Mrs. [redacted] with theft charges if she didn’t settle down. After my employee left Mrs. [redacted] was charged or given a ticket of some sort for taking my employees equipment. Mrs. [redacted] has made many attempt to contact me and I have refused to address the situation, in fear that it would escalate this even more. She has in letters said we have (not exact words) ruined her reputation because of the charges. She has asked us to get the charges removed. This is the second time I have come home to spray paint on my landscaping, not to mention coming in my fenced in backyard without permission and for no apparent reason! This is unacceptable and I would like a repsonse. The first time I complained about this directly to the company, they didn't act like they cared about it.

Review: I had the most unpleasant experience meeting [redacted] on Thursday, October 29th, 2015 at 2:00pm who works for Vannguard.He contracted through Excel Energy Company and was assigned a job to come to my property.Excel spoke nothing of ripping up my driveway and when [redacted] came to my property he told me Excel must be digging up my new installed driveway.When I approached [redacted] I was just trying to get information from him on what he knew. I then explained to him of the information I knew from speaking to Excel.[redacted] wouldn’t reason with me and see things from my point of view. I tried explaining to him that there was a misunderstanding and that I needed to get Excel on the phone ASAP.[redacted] explained to me that he was there to do his job and that he was going to spray my landscaping and a large portion of my driveway with Red Permanent Spray Paint onto my Newly Installed Black Top Driveway. [redacted] refused to let me grab my phone and husband and I feared if I walked away that [redacted] was going to spray my Newly Installed Blacktop Driveway with Red Permanent Spray Paint. While this conversation took place [redacted] was standing past my property marker which means past the easement and actually on my property.[redacted] himself could have handled this whole situation in a respectful matter but he chose not to. Several times he stood there staring at me telling me he had a job to do.He at one point for no reason sprayed the base of the Electrical Box while he was talking to me.He started to raise his voice at me.He was mocking me while standing on my property then would stand in my neighbor’s yard swaying his tools back and forth.He was acting very unprofessional, childish, sexist, out of line, disrespectful, threatening, intimidating, closed minded, arrogant and antagonizing me was not appreciated; he was unprofessional the entire time!He continuously refused to leave my property after being asked to leave more than once.[redacted] refused to give me any information & wasn't in any uniform.Desired Settlement: Acknowledgement for starters. I've been trying to contact the company CEO Randy Bern, President & CEO since 11/5/15 with no response. I emailed twice. I called the office and left a detailed voicemail. I typed a letter and mailed it in.
