[To assist us in bringing this matter to a close, you must give us a reason why you are rejecting the responseIf no reason is received your complaint will be closed as Answered] Complaint: [redacted] I am rejecting this response because: We called [redacted] to let him know that we are out of the size he ordered,This is false, however if true and given that my card was charge it reeks of a bait and switch I received a call from the Customer Service Rep to be informed that VARCO would not be able to sell me the product I had already purchased (see attached receipt) at that price and that the actual price was higher than what I had paid...to which he threatened legal action. This is also false, I informed the Rep that we had a contract and that such business dealings were unlawful; that I had already paid for the product and expected that the contract would be honoredOur rep went ahead and offered the price below our cost to appease [redacted] ***, something I would not have doneBut as our reps are empowered to provide excellent customer service, I support his decision. This is partially true, the Rep "checked with the Manager" and returned to the call to inform me that he would honor the existing price of the hoseHOWEVER, the cost of the shipping was going to increase by about 200%...an amount which was curiously close to the amount they wanted to increase the price of the hoseThis is also CLEARLY marked on our web site.I have attached the document which shows the screen shots of the purchase experience to verify that there is no mention of pricing nor shipping being estimates We are not a retail web site,I would argue that a website open for business to anyone with access to it is exactly that, a retail site We sell to industrial Customers which means industrial productsAs all shipping is now dimensional, what is ordered will determine how many boxes and at what dimensional weight the customer will pay [redacted] Ground has long been providing shipping estimates and along with the business that Varco is in, shipping products (e.g., hose) one should expect that the estimate would be closer than double the amount charged at the time of the transactionPer the screen shot we were letting him know the shipping would be more, due to the number of hoses he ordered and the size of the boxes they would fit inOur product does not fold down and fit in small boxesAgain, he threatened legal action Again, MrS [redacted] is speaking out of turn, as he has yet to be involved in the communications with meI feel strongly that MrS [redacted] has helped illustrate my concerns about Varco's business dealings After having accepted payment from me, a position he previously denied, a Varco representative phoned to raise the price of product and, once unsuccessful in that, the shipping to try to strong arm just a few dollars more We had a contract and consideration was given by both partiesIf we can give the benefit of the doubt to Varco, that it is simply a lack of knowledge about proper/legal business dealings, perhaps some instruction on how to improve their ecommerce site would suffice In a retail ecommerce environment, I expect higher standards from companies where I spend my money, I hope the Bureau agrees and holds the business to a higher standard if not the minimum standard of the lawAs for legal action, I was hoping to proceed here before pursuing a small claims action in Minnesota and forcing upon the company the additional expense of traveling here to defend their positionRegards, [redacted] ***

Revdex.com K St NW 10th Floor Washington DC 20005-Re: Complaint Id ***January 16, 2017To Whom it May Concern:In regards to the first complaint from this customer, We CLEARLY mark the product he ordered with the following disclaimer:"*COLOR REQUESTS WILL NOT BE HONORED, FIRST COME FIRST
SERVEDWHILE SUPPLIES LAST."We sell this product at a price lower than our cost because it is scrap hose which remains after We cut up a roll of hose; therefore they are only available when we manufacture rolls of hosePlease see the Screen shot below from Our Web site.We called ** *** to let him know that we are out of the size he ordered, to which he threatened legal actionOur rep went ahead and offered the price below our cost to appease ** ***, something I would not have doneBut as our reps are empowered to provide excellent customer service, I support his decision.Regarding his second complaint about the shipping:This is also CLEARLY marked on our web siteWe are not a retail web site, We sell to industrial Customers which means industrial productsAs all shipping is now dimensional, what is ordered will determine how many boxes and at what dimensional weight the customer will payPlease see the Screen shot below for that as wellPer the screen shot we were letting him know the shipping would be more, due to the number of hoses he ordered and the size of the boxes they would fit inOur product does not fold down and fit in small boxesAgain, he threatened legal action. At this point I called the Customer back and let him knoW We had voided his authorization and Cancelled his order as he was unhappy with the shipping chargesOf course ** *** paid more BECAUSE WE WERE SELLING THE SCRAP PIECES BELOW OUR COST- BECAUSE THEY ARE SCRAPAS to advertising, all of this is clearly marked on our Web site and We did exactly what the website says we would doWe called to inform and get his permission** *** has the right to cancel the order if he disagrees, and that is perfectly understandableAs to Contract law, ** *** is certainly Welcome to contact his lawyer as he told me he would do and proceed civilly.** *** concedes both of these points in his complaint, so it is odd that he is filing a complaintIf he feels there was any tort created for which he would be owed money, because he had to buy hoses that Were selling on a “while supplies last" vs buying a hose priced at price, then proceed with a civil actionI am happy to defend and am most confident in our position. Please view both screen shots below, and also realize that ** *** was not damaged in any Way as his authorization was voided and he was placed in the position he was before he entered my websiteI Would welcome *** *** to practice his civil rights and order his hose from Whatever vendor makes him happyHe is Certainly under no obligation to order from my company, nor am I under any obligation to to provide a service or product to himShould you have any further questions please do not hesitate to call.Yours SincerelyRon S*President

[To assist us in bringing this matter to a close, you must give us a reason why you are rejecting the response. If no reason is received your complaint will be closed as Answered]  Complaint: [redacted] I am rejecting this response because: We called [redacted] to let him know that we are out of the size he ordered,This is false, however if true and given that my card was charge it reeks of a bait and switch.  I received a call from the Customer Service Rep to be informed that VARCO would not be able to sell me the product I had already purchased (see attached receipt) at that price and that the actual price was higher than what I had paid. ...to which he threatened legal action. This is also false, I informed the Rep that we had a contract and that such business dealings were unlawful; that I had already paid for the product and expected that the contract would be honored. Our rep went ahead and offered the price below our cost to appease [redacted], something I would not have done. But as our reps are empowered to provide excellent customer service, I support his decision. This is partially true, the Rep "checked with the Manager" and returned to the call to inform me that he would honor the existing price of the hose. HOWEVER, the cost of the shipping was going to increase by about 200%...an amount which was curiously close to the amount they wanted to increase the price of the hose. This is also CLEARLY marked on our web site.I have attached the document which shows the screen shots of the purchase experience to verify that there is no mention of pricing nor shipping being estimates.  We are not a retail web site,I would argue that a website open for business to anyone with access to it is exactly that, a retail site.  We sell to industrial Customers which means industrial products. As all shipping is now dimensional, what is ordered will determine how many boxes and at what dimensional weight the customer will pay.  [redacted] Ground has long been providing shipping estimates and along with the business that Varco is in, shipping products (e.g., hose) one should expect that the estimate would be closer than double the amount charged at the time of the transaction. Per the screen shot we were letting him know the shipping would be more, due to the number of hoses he ordered and the size of the boxes they would fit in. Our product does not fold down and fit in small boxes. Again, he threatened legal action.  Again, Mr. S[redacted] is speaking out of turn, as he has yet to be involved in the communications with me. I feel strongly that Mr. S[redacted] has helped illustrate my concerns about Varco's business dealings.  After having accepted payment from me, a position he previously denied, a Varco representative phoned to raise the price of product and, once unsuccessful in that, the shipping to try to strong arm just a few dollars more.  We had a contract and consideration was given by both parties. If we can give the benefit of the doubt to Varco, that it is simply a lack of knowledge about proper/legal business dealings, perhaps some instruction on how to improve their ecommerce site would suffice.  In a retail ecommerce environment, I expect higher standards from companies where I spend my money, I hope the Bureau agrees and holds the business to a higher standard if not the minimum standard of the law. As for legal action, I was hoping to proceed here before pursuing a small claims action in Minnesota and forcing upon the company the additional expense of traveling here to defend their position. Regards, [redacted]
