I am a reputable contractor and all my work is done word of mouth I do not advertise and I turn down almost as much work as I do each year because my crew of eight guys can not keep up.[redacted] had a hail damage insurance claim and was insured through State Farm. Her policy allowed two years to make the...

repairs so we took care of the roof right away so there was no leaks and waited on the siding stuff, which I made her fully aware of. We had to concentrate on the hundreds of other damaged homes that had only one year to complete the work. It was not just her job anyone that had two years to complete there work was done exactly the same and in fact we had to file extensions on several jobs. [redacted] was trying to get money back almost from the beginning she wanted a refund because we had some left over shingles ( we always have extra material in-case some are damaged, or the waste factor was greater etc... ) We worked with the insurance company and there allotted damaged and repair costs. Like usual we had to be a bit creative in order to make everything turn out for the best. [redacted]'s policy only paid for the damaged siding so she was not given enough siding to do two full sides of the house or the garage ( the walls that had the damage ) The estimate was written to match the insurance company quote so that there was no confusion on that end, but we verbally made a agreement to install siding on one complete side of the house and garage and do a selective replacement on the other two walls using the removed siding so that it matched and was faded the same so the wall would not be all blotchy with old and new siding mixed. This type of install was a lot more labor intensive and made the final product look much nicer. We also did numerous other items at no charge so that things were fair and the house looked great without any additional costs to the homeowners. ( aluminum wrapped 4 extra windows, garage door framing and wrapping also did all the gable end aluminum fascia, even replaced some siding damaged by the homeowners. )[redacted] claims after the fact months later that the work was never complete and it was done poorly. No one would pay for something unless it was completed. Yes [redacted] has paid me in full for the contract amount but has not paid the invoice for the profit and overhead. Some insurance companies pay profit and overhead automatically and others like [redacted]'s you need to submit a additional invoice. That is what I did per State Farm's policy that a contractor can get that money. When I inquired I was told by a person from State Farm that [redacted] received that money and I will now need to collect it from her, they paid her claim in full including the profit and overhead invoice that I submitted. [redacted] refuses to meet to discuss this and prove that she did not receive the money and just continues to claim she paid me in full per the contract and than starts making up other accusations as to unfinished and inferior work ( kind of a normal response I have found over the years from people who know they are in the wrong. ) ( Makes things justified in there eyes ) So basically the evidence I have says [redacted] got paid my money and she just keep it for herself. I have not harassed [redacted] I just called her about three or four times in which during one of the last conversations I told her that if she continues to stall and wait that I will have to move forward with other actions to protect myself to insure I will get paid. I got a call from [redacted]'s boyfriend who was not making any sense on the phone, told me I needed to stop harassing them I asked to meet in person to discuss once again he just keep making up stuff so I had to just hang up the phone.So to sum things up all the evidence I have is that [redacted] received my money and has refused to prove to me otherwise and refuses to pay me. So yes she does owe me some money and I will put a contractor lien on her house as soon as I get time to get the paperwork filed. In the mean time interest and late fees are accumulating.
