1/4 page ad for $695 and paid for this ad on 6/13/2016 via credit card over the phone. In the contract, both Venue magazines and [redacted] mutually agreed that her Ad would be showcased in the magazine no later than 6 months after the contract was sent to her on June 10, 2016, 12:36pm PDT. Furthermore, in the contract is the following wording, "Upon the signing of this contract, Venue Magazines agrees to reserve the adequate space in the publication for the Preferred Vendor's advertisement and the Preferred Vendor agrees to pay the dollar amount associated with this contract no later than the dates listed below.".Once the customer entered into agreement with Venue Magazines for an ad that they signed the contract for, Venue Magazines sets aside the advertising space that was contracted and paid for.Venue magazines has thus far fulfilled its contractual obligations.On August 16, 2016 (more than 60 days after signing the agreement) we received communication from [redacted] that she no longer wanted to participate in the magazine. It was explained to her that we are no longer selling space in the magazine and the layout at that time for vendor ads were already created. In this communication form [redacted], she explained that she no longer was in business in Massachusetts and was moving her business to strictly New York. After receiving her email, we did view her website on September 3 at 1:10PM EST (more than two weeks after her initial email) only to see that "[redacted]" was still advertising as "[redacted] in the New York and New England areas!" As a courtesy to [redacted], we did extend the offer to her that if she could find someone to take over her ad in the magazine (someone that was both in the same category and could past a proper vetting by the venue that the magazine was for) that we would allow her to to transfer her space to another company.Once [redacted] entered into an agreement with Venue Magazines we started to do work to place her advertisement into the magazine. Page layouts were created and her ad became part of a story-boarding process and we used her ad as we created many different possible layouts. The ad layout is complete and ready to be dropped into the final magazine which will go to production within the contracted period as stated in the signed and agreed to contract.We are sympathetic towards the situation that [redacted] is in but unfortunately work has already begun and the agreed to contract specifically states the terms that we intend to fulfill.
