I am rejecting this response becauseI am rejecting this response because: The entire soil preparation was completed by Vergara Construction, Inc Furthermore, he was well informed as to the property across the street with the same issue In fact, he spoke to the homeowner who had the issue prior to accepting the job He also stated the following"if my concrete does that I promise you that I will come out and the job" I have a witness who is prepared to testify in court! Also, as for the dowels, I have never laid concrete How would I know what a dowel is used for??? He told ME he was installing them to "prevent" what happen across the street When I phoned the company I was advised that there were only two things that caused this issue 1: Water, and 2: Roots Neither of which I have I have a copy of my signed contract and no place in the contract does it reference expansive soil I have had other contractors out to review the work performed by Vergara Construction inc They all agree that there should have been felt installed prior to the pour between the existing sides of concrete to allow for expansion This was NOT done I arrived at the figure due to the damage that is being caused to the existing driveway that will also need to be replaced, the time and effort trying to get Vergara Construction to even look at he job they did (to this day they have missed appointments) and the demo and replacement of the job done by Vergara Construction The concrete is also beginning to destroy the sidewalk that is property of the City of Elk Grove!!!!! I believe since his work was the result of City property being damaged that he will be liable for that replacement work too This is not the first time this company has had issues similar to this Just review his *** reviews! I am willing to accept Vergara Construction to the job at their expense But I can not even get them to come out to look at the finished job! I have many photos that I am more than willing to share of the end result of their work I am also willing to provide a copy of the contract I have prepared all the paperwork to take Vergara Construction to Court I was planning on filing Monday November 9, However I will hold off if they are willing to the driveway at their expense

Mrs*** was already advised that the crew would be back to complete the project. They are scheduled to return on Sep 14, 15, or 16. The office will contact Mrs*** to advise the date

Review: Hired company to pour driveway extension. After 3 months the concrete has lifted over 1/2" above existing driveway and is putting pressure on existing driveway. So much so that the concrete on the existing driveway is buckling and cracking off in chunks. Contacted contractor and was told it was "Not his problem and that nobody ever threatens to sue him or he gets mean, like real mean"He won't even come look at the work he did. So I sent him photos.My neighbor had the exact same issue. My contractor spoke to the neighbor trying to get that job of repairing their concrete but they were not interested. I was told by my contractor and I have a witness: "if my concrete ever does that I will personally re-do it at no charge"I can't even get him to return my calls!!!!Desired Settlement: I want the contractor to re-do the driveway portion of the agreed contract at no charge to me. It is not my fault and the contractor did ALL of the preparation work involved.NOTE: I tried to attach photos and emails sent to contractor. File too large. I can send it to anybody via email....
