I am rejecting this response because:In our opinion, the business response from Mr*** and RCM is unacceptableWe have reviewed our contract with Mr*** and RCM, and we cannot find support for many of Mr***’s claims in our contractAdditionally we would remind Mr*** that there is no reason to insult us personally We have no record of correspondence from Mr*** dated March 9th, and have no idea what “The mrscalled and asked me to deal with her and all would be fine,” is referring toIn any case neither my wife nor I agreed to pay Mr*** or RCM $1,on March 9th.We will not sign a release form to RCM for the windows, as 1) there is nothing forbidding taking possession of materials in the contract and 2) there is no waiver requirement in the contract if we decide to do soWe paid for the windows on Mr***’s and RCM’s behalf, and took delivery for them at my own personal expenseIt is our opinion that Mr*** and RCM bear any and all responsibility for errors in window measurement and costs to rectify, as it was he and RCM which submitted the designs and measurements to the manufacturerOther than arranging for payment, we as homeowners had no communication with *** ***t regarding our windowsMr*** and RCM will need to perform any necessary work at his and RCM’s expense to rectify this issue, we are not agreeing to increase the contract price for this issue.We are not agreeing to any changes to our contract, which Mr*** is attempting to force on us in his response below, or agreeing to any of his below demands in any wayI’ve attached our current contract and amendments with RCM, and we will not be deviating from this contract in any formWe suggest that Mr*** promptly get back to work so that he can collect the remainder of his agreed-upon fee based on contracts he has signed with usAny additional extended absences by Mr*** and RCM from this point will be treated as potential jobsite abandonment and as breach of our contract with Mr*** and RCMWe have been very flexible with Mr*** and RCM over the past nine monthsI would like to point out that, when he began work in July 2016, he indicated that our job would be completed within four to six weeksAt this point, all we want is for our project to be completedWe would remind Mr*** that we are in full compliance in our contract with him and RCM. I have attached our signed contract with Mr*** and RCM, which bear both his and our signaturesTo our knowledge, this represents everything we have signed with Mr*** and RCM.As a final reminder, we will not be issuing any further payment to Mr*** or RCM until our project is 100% complete

I am rejecting this response because:my husband and I have have been very patient with *** On days he said he was going to be there we left the door open or someone was *** We trusted his expertise when it came to design therefore leading to slight changes in the design (the glass block was the only design change we made) This project was to only take maybe months according to RNdy and it didn't get almost finished until months later *** was inconsistent in showing up for the job and he blames his personal problems on us I understand he was going through a tough time but he did have a job to do and to keep us informed of whether he was coming that day or not.in addition to the one design change hevean into some complications (water and electrical in the way, he moved insulation causing the pipe to freeze, and a pipe had to be adjusted that misaligned). as for his interpretation on the hinge and tile, our personal loss few is none of his business and we have been very careful about the door opening and closing the diir *** has promised he wanted to complete the job and we are still waiting on the register he promised. as for both duet, he did not keep us in the loop on where we stood when asked he said we were still within budget We negotiated the final cost and write him a check.I just like him to come fix the probkem, I have the materials he just needs to come and fix it.

Tell us why here...the customer altered the finished product.the complaint comes after the contract was finalized...this customer was very hard to please and as we can see, very unsatisfied with all work and progress.I gave discounts, free material, free labor.their scheduling made finishing there...

project very very difficult. I ate over 3500 dollars in material and labor at contract finalization. only to have them alter a glass door sweep, that binded the door and pulled it loose from the tile...the tile shattered, but not the door. (thank god)the complaint is not about fraud...not about shabby work...it's about a client altering a product, paid for, having terrible ramifications and looking for some one to blame.I went to assist only to be locked out and told I was negligent...the [redacted] thought the work to be done should be free, (not coinciding with warranty stipulation), the material involved should be free, as well...and now this...insults, changes and "free beez"...I offer a year warranty on all labor performed, not material.in the contract stipulation that was signed by the [redacted], "any deviation or alteration or changes of mind by home owner voids warranty"...negligent is not consoling them before work beginsnegligent is the thought mr. and mrs. [redacted] had, when that door they altered,  bound up and broke the tile ..."it pulled the hinges right out of the jamb"blame and condemnation are what is following...the pictures attached show work performed and the lovely product produced, (by me)...design through completion...the glass door was installed with pin point accuracy, not needing a sweep at all.long showers with two people led to water splashing.when they requested a sweep to help keep water from escaping during their frolicking, (after contract finalization) I assisted in producing door sweep at my own cost.I put the sweep on myself. adding extra sweep would put the door in a "too tight scenario"...the [redacted] took it upon themselves to go against my direction, and added extra sweep after I left.the results are clear...I refute this complaint.thank you,[redacted]RCM Construction

mr. [redacted], i'm notifying you at this time of project change and addition to our contract. I was notified today (fri) that you contacted [redacted] and took over the delivery arrangements of the windows, for your project. they describe you as rude and a “[redacted]”.   It's...

important that you sign a release for the windows for me. It will be described as “RCM Construction is not liable” for any and all problems, if any, with said window order, (to include height, width or any dimension, seals, glass or frame. This does include the screens) you mr.[redacted], assumes all and total responsibility. If alteration of window opening is required, extra cost is involved. As to the agreement in it's present state...   At the time of removal and replacement of the windows downstairs, the width of the new window fell short of wide enough to fit the opening. It's an “unknown”. meaning we don't know what we have in some scenarios, until after demo.   It requires a plywood filler and drywall patch to texture. Then paint. This will be required on every window. And door. Nobody offers windows of the width required and the patchwork can only be defined upon re-installation of said new window.   This at no time was included in any quote. so i'm quoting it now.   There will be an addition of 100. per window, 150 per door.   Other window companies don't offer drywall patch and paint, you would have to hire another contractor or contractors, (which i'm sure you have considered by now) to final your window install needs. Keeping in mind that if the patch work to be done, (by other contractors) touches any work that has been defined under this contract, all warranty is void under this contract stipulation. That is 2100 that needs to be added and initialed, (by you) in the contract.   In addition. The vents that were not covered in the contract were installed and that cost is 400. this too needs to be added and initialed.   In the text I had sent on the 9th of march, 2017. I clearly told you, for me to have any further dealings with this window order their would be a 1500 dollar addition to this contract.   The mrs. called and asked me to deal with her and all would be fine.         I agreed, After installing the windows, vents and picking up loose ends, I asked for that draw. The mrs. told me I would have to wait until you complied, mr. [redacted], and I find out after that no draw was provided. And here we are dealing with you again.   Now, you insult the people I work with at [redacted], (while using my name) to further your pursuit to run this project im on. i'm on this contract as well my friend. And here's a defining line for you to get on. This project scope has increased, by a hundred plus lineal feet of patchwork for the new windows The moneys needed to get the work done has increased. By 2500. dollars, (3000 if I touch your belongings at all)   The moneys needed to go further on your project are in your hand, not mine. We redefined the contract. Were redefining the contract now. If you want the project to proceed with my guidance, there will be no more discrepancy on your part.   With the addition of the new costs I worry now, that doing business with you further, needs absolute cooperation on your part and a deposit is needed to secure material and the labor needed to continue. I have to notify you in this fashon , because if you talk to me the way you talked the last time smart guy, well... “lets just say you won't”...   Giving you the right to the window purchase has turned out to be a very long delay and all funds acquired for your project have been exhausted. For some ungodly reason you believe, that theirs more money than what we had agreed upon. “I'm not supplying anything”, you are. If your going to handle purchase and delivery you need to make sure all that is needed is provided. If you have to ask me. And I have to be involved... “it costs money”. I have counseled for free up to here. I have saved you tons up to here. All cost for this project are in the moneys you control.   all furniture, by any window needs to be moved. I will not be responsible for any furniture.   The ceiling needs to be painted.   At the time we renegotiated our contract, you were going to paint. You occupied the floor All the furniture needs to be placed so trim and finals can commence. And covered. I will not be responsible for furniture. If you would like me to deal with moving, covering and replacing the furniture the cost is 500.         No body can be in the house when we begin the window project. I have stopped for you to make coffee in our work zone, I have helped little feets move away as I shoot my nail gun. I have been, and my little company has been as cordial and kind and careful as anything i've ever seen on a project. My help has been very well supervised and instructed, and clean. If there was a problem or a circumstance that needed attention...“i handled it with kid gloves”. I find your comments to depo and the reson you left behind in association with me and my company second rate, and the just complete improper behavior you drag around mr. [redacted]. Demands us coming to a conclusion on your project.   Due to the discovery of project scope and the large amount of patch and paint required to finish this project and the large amount of masking and clean up involved, it's important to allow 2 days for inconvenience. Every wall, ceiling and floor associated with this patch work around every window has to be protected. All furnishings need to be covered. You will be inconvenienced for two days. Theirs a chance you might get a chill, or have an uncomfortable moment as this process takes place. All those concerned need to get a hotel room. I, at this time care only in the final of this contract. The push that has been felt to get this project finished, is felt right now. All obstruction by any window to be replaced or that has been replaced needs to be moved and covered before any other work continues, anything obstructing the completion of painting needs to be covered and protected before further work continues The new changes to this contract need to be signed and dated. a check for 2500 dollars to be deposited before any work continues or you will subside in calling for my assistance. As soon as these provisions and updates are finaled by you, we will be back at our earliest convenience. If the delay on your part gets out of line or if you show up with your [redacted] poor attitude again, you can get some one else. I no longer care for your infection or your twisted point of view. Your insulting behavior is absolutely unexceptionable, and i'm ready to be done. I have completely run out of ways to over look you. I haven't forgot one thing on your project, you have. Thats me. I certainly appreciate the business and look forward to completion.
