Initial Business Response /* (1000, 5, 2014/03/05) */
Mr*** had a home he wanted to sell, and when they was ready to close they found out that he did not have the home winterized, and the copper pipes in the bath had busted and water ran everywhere, including to the down stairs
foyer of the home, and the ceiling of the garageHe was not able to closeAs a General contractor I have seen this type of problem before and know even after the repairs are made you will still have stress points in the copper lines that could rupture and break at any timeMr*** did not contact me, I contacted him, out of the kindness of my heart to help him redeem a $deposit that he had lost, to my company on another project he and I had entered intoHe was very happy to have the chance to redeem his money and ask me if I could assist him in the repair of (as stated in the agreement-contract bath copper water lines)Mr*** was not at the home when I made the initial assessment to repair the copper pipes in the bath, so he gave me the key code to his garage so that I could enter the homeUpon entering I could see that the water had damaged the lower foyer ceiling and water stains were in the ceiling of the garageI also noticed someone had already removed the double vanity sink, but the toilet was still in placeBecause he did not winterize the home, the toilet was also cracked at the tank and seat junctionI gave him a Quote of $3,to do the repairs to the copper pipes in the upper bath, and all the damaged ceiling and wall repairs, minus the $deposit that he would have lost to my companyThe contract totals came to $3,We started the job with no money down because he had a problem with his credit card, but finally he made a payment of $1,$was due on completionOn the morning of Jan 23rd we started the job under the assumption that since he had returned to winterized the house, we would have flowing water
I found blue car antifreeze bottles in the house when we started and also found out that his furnace had stopped working, which he had never mentioned, and that his pipes were still frozen through-out the entire house! I sent Mr*** a text to let him know that the pipes were frozenWhen I finally spoke to him
by the phone I let him know that it was no way for me to repair copper pipes without the water flowing in the house, and that he would have to repair his furnace for that to happenI also informed him that since I was already there with my crew (That I had to pay for that day), with nothing to do, that I would have them to clean
up the mess that his other people had left, and that one of my crew members had a small portable heater in his truck, and maybe if we plugged it in and closed the door the pipes in the bath would thawI in no way contracted to thaw the pipes in his house, and I told him that was not part of my contract, and he must fix his furnace to restore full flow to the bath pipesThe small portable heater did not thaw the pipes as it was very
cold during that timeHe brought in a radiator type heater the next day, and the pipes still did not thawHe had others to look at the furnace, but they could not get it to run, so he asked if my company repaired furnaces, I told him yes and that I would have my furnace man to come over and take a look at the problemWe gave him
our price to replace the board for $1,with no warranty because of the age of the furnace, or replace the entire furnace for $2,materials and labor which included a yrtransferable warranty, but he declined, we still had no heat, and the water pipes were still frozenThis back and forth lasted for (6) SIX days, finally
Mr*** had others to repair his old furnace, and we started the repair of the copper bath room pipesThis is when Mr*** ask me to renegotiate the terms of our agreement, from $3,down to $3,making his final payment $1,100.00, he also asked me to deduct $for the work that others had
started, making my final due from him to be a total of $At first I thought he was asking to much, but I agreed because others had removed the double sink vanity, and soldered two of the copper pipes while they were
frozenKeeping in mind that Mr*** wanted us to rush as he still wanted to close on this propertyAfter we finished the 1st day, the next morning we started repairing the dry wall areas and that's when stress points on the copper ruptured, in other places, re-damaging the dry wall areas we had already started making
repairs toI had to have my crew tear out the dry wall areas again and this time we found out the upper bath tub faucet connections had cracked from stress and started to leak, this is when we had to tear open the foyer ceiling completely to make the repairsI called Mr*** and he showed me no compassion as I had just showed him the other dayHe stated that it was all my problem and not hisSo again I had my crew to do all the repairsAfter closing up the upper bath wall for the 2nd time, another leak started, and we had to repair the dry wall for a 3rd timeAfter closing up the upper bath wall for the 4th time, another leak started, and we had to
repair the dry wall for a 4th timeAfter this round we were on or about Feb3rd, another leak started in the bath room on the other side of the wall, but this leak was from tub faucet in a third bath room on the same floorI told the worker to do the work I paid him to do, but do not re-install the toilet as it was bustedI asked him to shut the main water off so I could inform Mr*** that we were finished with our
portion of the contractMr*** spoon called me and said that when he turned the main back on he had water leaking againThat is when I informed him that he would have to have others to change the faucet in the 3rd bath, and that was not part of my contractI also told him that if he purchased a new faucet I would install it
at no costHe asked me to buy the new faucetI told him I did not want to choose the new faucet for the 3rd bath because he may not like the styleHe said just get one, and he would live with itI also told him that he would need
some new replacement tiles because I would have to break the tiles in the 3rd bath tub wall to replace the tub faucetHe said I could go by one of his other workers place (who lived near me) to get some tiles that were left over, to match what he had, and I agreedThe next morning I called Mr*** and told him it would be a one day delay because of the traveling conditions had deteriorated because of the bad weather, and that we could not make it to his house for another hrsbecause my crew was not in the areaThis is when he insisted that we show up immediatly, and I told him I could not, and that he could keep the $he owed me if he could not wait hrsHe agreedWhen he decided to finish the job himself, he found that one of my workers had tried to keep the dry wall from getting wet, until we could return to pull the faucet from the 3rd bath
side to replace the faucetMr*** has tried to portray this as fraud, but I have explained to him that I talked to the worker and the he explained to me that he inserted the receptacle as a precaution as we would
have returned to remove it from the other side, as I had already paid him to complete the original wallI let my year record speak for me and I would never-ever and I would never try to defraud a customerIf he had not locked me out of the property because of the hour delay, I would have completed the jobAs a matter of fact
I am considering filing a slander suit on Mr*** for sending the pastor of my church a letter full of lies the has slandered me and the name of my companyWhy this man would involve my pastor with a personal matter like this is an outrage to me!!
