Mr [redacted] took out an auto loan in when he was a member of Best Advantage Credit Union in Brillion (Best Advantage Credit Union merged into CitizensFirst Credit Union, which is now Verve, a Credit Union, in 2014) In December 2011, Mr [redacted] had his car repossessed for failure to pay the loan After the car was sold at auction, the remaining delinquency was Mr [redacted] responsibility and Mr [redacted] was informed of that fact.On January 1, 2016, Two Rivers Community Credit Union merged into Verve giving Verve its first credit union branch in Two Rivers Verve does not have a branch office in Manitowoc, Wisconsin, where Mr [redacted] lives.On February 3, 2016, Mr [redacted] contacted Verve via telephone to discuss the settlement of his loan delinquency with Verve We declined Mr [redacted] settlement offer at that time, which was substantially less than what he owed on the loan debt, and suggested that Mr [redacted] enter into a monthly payment plan to pay his loan debt in full Mr [redacted] declined to enter into any monthly payment plansOn or around February 6, 2016, Mr [redacted] went into our Two Rivers branch and demanded that we settle his loan debt at that time The branch staff at our Two Rivers location declined his offer and directed him to our Member Solutions department, the same department he had talked with onFebruary 3.On February 12, 2016, Mr [redacted] again contacted Verve via telephone to demand the settlement of his loan debt Again, Verve declined Mr [redacted] offer of settlement.On March 8, 2016, after a letter that was sent to Mr [redacted] was returned to the credit union as a wrong address, Verve again talked to Mr [redacted] via telephone about his loan debt and Mr [redacted] demanded that we settle with him for less than he owes Verve again declined Mr [redacted] offer of settlement and requested the full amount owed.At this time, Verve is still willing to work with Mr [redacted] on setting up a monthly payment plan to pay his delinquent loan debt in full We understand that Mr [redacted] may be in a difficult financial situation and we sympathize with his plightIf you have any further questions on this matter, please feel free to contact me.Sincerely,***

Sorry for my delay in responding to your voicemail from Wednesday. I was out of the office at a conference on Wednesday and I did not get the message until yesterday. The document that Ms*** is referring to is our Account Card. This is document shows all of the pertinent information for the members on an account, including their full social security number. As a financial institution, we need full social security numbers of our members, in addition to other information, for proper identification and reporting purposes. This Account Card needs to be updated any time there is a change to the account and then the document is signed by the member showing their authorization to make the change It is also an additional way for us to make sure we have complete, correct and up to date information for our members. With respect to this transaction, *** spoke with a branch team member about adding his mother, Pam, to the account as his agent under a Power of Attorney documentSince *** was in jail and was unable to come into a branch to personally sign the Account Card, *** directed Verve to give the Account Card to Pam so that she could take it to *** in jail so that *** could sign the Account Card and authorize Pam being added to the account as his financial agent. The Account Card was not mailed to *** through the U.SMail as Amanda claimed. Also, just to be clear, this was not new information to *** or Pam. Both *** and Pam had previously seen Amanda’s social security number and other information when previous Account Cards were executed (when Amanda was added to the account, when Pam was taken off the account, etc.). On April 26th, Verve contacted Mr*** about a negative balance in his checking account and he said that he was hoping to have enough funds on that Friday (April 29th) to take care of the full balance. Mr*** contacted Verve on April 29th and
he agreed to start paying $payments bi-weekly starting that day then asked about getting some fees refunded. Mr*** was told that Verve would look at refunding some fees at a later date after he made the payments as agreed. He was also made aware that if the checking account was negative for days in a row, it would be charged off Mr*** never made a single payment towards the negative checking accountVerve contacted him on May and he promised to pay $that day or if not that day then on May 13 for sure. Mr*** contacted Verve on May 14 and told Verve that he didn’t get paid until May 15th and he would do a RDC for $that Monday (May 16th)No payment was ever received, messages left from Mr*** on May and May 18 were not returned and the checking account was eventually charged off On May 27 Verve contacted Mr*** about his delinquent car payment. Mr*** said he would pay it that day, but payment was not madeMr*** contacted Verve on June and promised to pay $on June 15 for the vehicle loanMr*** contacted Verve on June 13 demanding that his late fee on the loan be waived. Verve declined to waive the fee. Mr*** became upset because he said Verve had agreed to waive his late feesMr*** was reminded that he was told back in April that, on the condition that Mr*** made payments toward his negative checking account that Verve would evaluate whether or not to refund any fees at that time. Because Mr*** did not make any payments or attempts to bring the checking account positive he was informed that Verve would not be waiving any fees. At no time did Mr*** mention to Verve anything about having to pay for any surgeries or any transmission issues. We empathize with Mr*** if he is in a difficult financial situation. are in receipt of your complaint filed with the Revdex.com (Revdex.com)  We are sorry to see that your dispute with ex-fiancée has lead you to file a complaint against Verve, a Credit Union.  Here is a recap of information with respect to this membership, most of which has already been explained to you or is known to you:               In 2005, [redacted] (“Mr. [redacted]”) opened a membership at Best Advantage Credit Union.  Later in 2005, Mr. [redacted] added his mother, Pam [redacted], to his account as joint owner on his membership.  In 2014, you were added to Mr. [redacted]’s account as an additional joint owner.  The Account Change Card adding you as a joint owner, and that was signed only by you and Mr. [redacted], clearly listed Pam as a joint owner of the account.  As you are aware, Pam did not sign the Account Change Card authorizing you to be added as a joint owner.  In early 2015, Pam was taken off the account as a joint owner by a document signed by Mr. [redacted] and Pam.  You did not sign this document.  In 2017, Mr. [redacted] was sentenced to a lengthy jail term and began serving that jail sentence on February 27, 2017.  In March 2017, you opened up your own individual membership here at Verve and during that process you told us that Mr. [redacted] was your ex-fiancée.  At that time, you were advised to transfer the deposit of your payroll check into your new individual membership instead of continuing to deposit your payroll into the joint account, but you did not follow the advice given.               In November 2017, Mr. [redacted] added Pam to this account as his agent under a power of attorney since he is unable to manage his finances from prison. Mr. [redacted] did not add Pam as a joint owner on the account, although I would like to remind you of and point out how you were added to the account in 2014. Unfortunately, the paperwork that was completed for this change, and of which you have been provided a copy of, is not clear and we apologize for that.  The internal documentation was filed out incorrectly and the wrong box was checked.  Instead of adding Pam as an agent, the paperwork appears to add Pam as a joint owner, but that was not the case.  She was only added as an agent under a power of attorney, the comments to the account correctly state this and there is a power of attorney on file with Verve.               Prior to depositing your payroll check in early December to the joint account with your ex-fiancée, you knew and were warned that Mr. [redacted] still had the legal right to use and access the account.  Pam, as agent for Mr. [redacted], was exercising the power given to her by a valid joint owner on the account.  I understand from your complaint that you apparently told your employer to change your direct deposit to your individual account here at Verve around that same time, but Verve did not have any notification of that change on December 8, 2017, and any issue with the deposit of your paycheck is with your employer, not Verve.              You have not made any further deposits to the account since your December 8 deposit and the joint membership in question is currently negative $1,085.83.  I would like to remind you that the primary reason the account is so far negative is that on January 6, 2018, you withdrew $900 from the account at an ATM when the account had a $0 balance.                At this time, Verve is unwilling to return any funds to you.  Further, Verve would like to respectfully request that you and your ex-fiancée figure out a plan for repaying Verve the negative balance that is currently in the account.  We understand that you may currently be in a civil dispute over who should be repaying these funds and we sympathize with your plight.                                   If you have any questions or want to discuss this matter further, please feel free to contact me.                                            ...
