I have reviewed the response made by the business in reference to my concern, and find that this resolution is satisfactory to me

Business states that customer was contacted and both parties came to a mutual agreement in the resolution of the issues. The proposal was made by the customer and the business, in the end, decided to accept it.

We did sold this vehicle, at the time of the sale it was having issues of a high rpm but it was never hidden from them and they understood and agree to wait till we get it all fix. We did had to change the first contract but we had no control of a returned contract from the lender because of their...

credit and not because we made a mistake. The second contract was made with [redacted] and [redacted] and it was fully approve but they fail to disclose that [redacted] had a suspended driver license but they did brought in copy of his driver licence but never told us it was suspended we knew untill the lender did a check on it, again it was not our fault that the lender returned the contract once more but it was because of them and they understood that. The third and final contract was made under [redacted] and [redacted] also this one was fully approve and it was send to lender once more, on this contract everything was correct and we were in the final process of finishing the financing all they had to do is speak with lender and everything would have been done. On every contract the customers were brought in and explain in both englis and spanish exactly what was the situation and they all understood and agree to sign, again nothing was NOT disclose to them and on every contract there was a foreign language acknowledgement sign which we have, by the way they speak and write perfect englis. We also have a contract cancellation agreement sign that we did with every contract which they actually sign to not have this option. The interest that is issue on every contract is control by the lenders and is base on nothing else but their credit. We have interest as low as 1.89% so lenders with good credit we have, but that was not their situation.As far as the repairs we went be on of what most used dealers would do. From the beginning we have told the customers that we will send this vehicle strait to the dealer of Nissan to insured them and us that the job will be done correctly. We took it to the Nissan dealer in Davis CA to get diagnose and repair. The Nissan dealer in Davis told us that it was the throttle body that was at fault and we bought a brand new original manufactured part from them and we installed it. We then called the customers and told them it was ready base on what the dealer had told us, after the repairs it was returned back to the customers. After they drove it the customers came back because they notice it still had the same issue. It was the very fault of the actual Nissan dealer because they miss diagnose the vehicle, the very thing we were trying to avoid happen and it was not just any repair shop that told us it was the throttle body but it was the dealer of Nissan. Then I brought the vehicle back in and thats when I agree to the customers to put everything in writing that we will get this vehicle fix correctly and if not we will refund them all the money back because we understood that it was getting frustrating for the customers and us. We invest money and time to the Nissan dealer in Davis to insured that the customers had a good vehicle. After the vehicle came back the second time we didn't trust the Nissan dealer in Davis to finish the job. We decided to take it to the Nissan dealer in Elk Grove CA. They diagnose the vehicle once more and found out that the computer of the vehicle was the one that its faulty. We authorize the dealer to get the computer in and install it. I had told the customers that if by the the 15th of August the vehicle was still not ready we would be happy to returned all their money back and I put it in writing once more and I and [redacted] sign the paper on the 11th of August agreeing. We had put a rush on the dealer of Elk Grove to fishing it for the customers. The very next day the vehicle was done and I called the customers that it was done 3 days before our promise date of being completed. But the customers decided to not even come and test the vehicle one last time, they completely stop contacting us and didn't even gave us that last time to drive the vehicle that we have both agreed upon. We gave them all the copys of all the repairs we had made here at payless auto care and all invoices of both the Nissan dealer in Davis and Elk Grove with all invoices of all parts that were purchase. In a final note, no used car lot has cosmetic warranty and on this deal we even promise them to fix the little rip part of the driver seat and got a new sun visor for them. We did everything possible to help them and went be on our warranty of repairs. At the end they broke our promise to them. Instead they never told us in word or letter that they wanted their money back instead they went to every place possible DMV, BAR, and Revdex.com and make complaints. BAR rep. came in and showed everything to them and they said we did nothing wrong.

Review: We purchased a car 8/03/15 ago for $8,000. Before selling the car it needed to be smogged but the check engine light was on. Victory took it to 2bennet automotive and had the repair done to remove the check engine light, got it smogged and sold to us saying "it was in great working order." Now 10 months later this car is having major issues, we took it to 2bennet and were given a $10,000 estimate for repairs and were told that this vehicle was in a while back (when victory brought it in for check engine light) and was made aware of all these issues but chose to fix only the one problem to get the check engine light off. I went down to victory and told them of this situation and asked why they didn't do the repairs before selling us the car. and the Mr [redacted] the head maintenance man told me, without even looking up this vehicle in the computer "Well we did the remaining repairs here in our shop." I asked then if I could please see the work order showing the car had been repaired in their facility and he stated "Oh, well we do not keep those kinds of records." I do NOT believe the repairs were done because he should have records, not to mention those problems are now at a catastrophic point and the car is not driveable. He said he'd call the owner and discuss the matter and let me know if the owner would agree to paying for the repairs at my request. I was later informed that the owner would do nothing regarding this matter. I called later that day and asked a different employee if I could have the contact information of the owner Mr. [redacted] or his wife Ms. [redacted] this employee said the owner does not have a phone and could not be contacted. We have had roughly $6,600 dollars of repairs done to the car to make it driveable and it will still need more. Only 16,000 miles should not cause these catastrophic issues if in fact these were repaired in victorys shop before the date of sale. The owner and his wife have had countless claims against them and even arrests for tax fraud May 2016Desired Settlement: I feel like something very shady went down and we should have been informed of the major problems with this car and I feel victory at this point should reimburse us for repairs to this car considering they were known at the time of sale and should have been shared with us.

Review: We gave an $8,000 down payment and the first contact was made by [redacted] but them late told us that I wasn’t approved b/c of my credit history and this happened after about 4 days. They never retuned the down payment and we made a second contract with [redacted] and [redacted] with a high % rate of about 22% but them told us we weren’t approved because eof [redacted] license was suspended and then made a third contact on 8/1/15 with [redacted] and [redacted]. They didn’t show us a 2day- sales contract cancellation agreement, didn’t provide us with a complete inspection report. When asked and didn’t provide foreign language translation of consumer contracts. The car has been with them b/c it does not work, and we asked to give us a report of what they fixed and they didn’t.

We asked for our money back which we are entitled to by Law and the owner said he could exchange it for another car but wouldn’t give us our money back. I don’t feel safe driving that car and we just want out $8,000 down payment back.

We are paying for something we don’t even have..a car we haven’t driven b/c its faulty. We asked to receive our money for paying for defective lemon car. He laughed at [redacted] and told him we were covered by California Law and he told us to bring whatever lawyer and that they can’t do anything to him. The man in charge of the finances named [redacted] told us if the car still didn’t work and wasn’t ready until 8/11/15, he would refund all our money and instead of that they came up with another contract with the car in the same bad conditions (not working). My drove it the 8/11/15 to a local store in Woodland and the care would accelerate, and jump and in that instant we went to return it and ask for money back, he sold us a lemon.

He promised on 8/11/15 that next day he would personally take it to [redacted] to get it fixed and when we went in the next day, the car was still there and told us he ordered the computer and he would take it to [redacted] and install it. We tired of his lies and we just want our money back..and that way buy a car for my daughter which she really needs.

Review: I bought a car, BMW 530i 2007, When I took it off the lot, it stop working 3 traffic lights away from the business. So now they are asking me to pay for the repairs. They knew the car was not in working condition when they sold it to me. I put $2000.00 down, They have the car and now they want me to pay an extra $2400.00 for repairs, and another $3000.00 for the memory panel. Total cost of the car is $15,000.00. I' Just want my down payment back. It was a trade in so they paid off my car $4500.00 So now I will be left without a car and loose my money.Desired Settlement: I need them either to let me keep my old car or fix all the issues in the new car
