I am rejecting this response because: Dear Bertha Bejarano Re: Claim 25PA [redacted] Chevrolet Camaro 2SS Dr Convertible Complaint against Victory Collision Repair assigned ID Bertha, I'm disputing the statement that Victory Collision Repair is statingVictory picked up the car from our house, and took it to the shop end of MarchMy husband went to shop and signed authorization form to start on repairs, on 4/14/which on the form it did not have the vehicle information; it only had my husband signature he told us it would take about a month and half for repairsOur contact person was [redacted] we waiting for about a week to hear from them and since we didn't we went to shop, and spoke with [redacted] , he stated that he was waiting on parts, that he had order them, but where not availableOver two weeks went by still haven't hear from themWe then received the insurance check for $9458.95, so decided to go to the shop and find out why the delays and gave [redacted] the check [redacted] stated that parts were on back order, by this time It is now sometime in May and we haven't t hear from the shop, but yet the shop cashed the checkI had my son [redacted] get involve since it was his car anywaysHe contacted the shop and once again he was told the same, that they couldn't get partsMy son contracted other body shops and asked if parts were available for this kind of car (Camaro) they told him yesOn June my son and daughter called the insurance company Mendota and spoke with adjuster [redacted] ###-###-#### and told here what was going on, she stated that she was waiting on the body shop to submit a supplementWe then decided to go my son, daughter and myself on Juneand when we got there we spoke with [redacted] asked him to show us the car and also what was the update on partsHe showed us the car which we took pictures when we got there, all they have done is the tear downMy daughter asked [redacted] what is going on he very clearly said that he was waiting on parts and that he had not yet got a hold of the insurance company waiting on them, for a supplementMy daughter replied how can this be after almost two months, you haven't got with insurance for supplement, this doesn't sound right, all you have been telling us all this time that there is part delaysWe asked him to show us were he has order the parts, he couldn't provide that he only should us the file with our informationHe then said he was waiting for insurance to call him backSo my daughter called the adjuster right in front of him and the adjuster answered the phoneHe got surprised, we she did, we told here we were at shop and that [redacted] is saying that he is waiting on the adjuster for the suppl its why he hasn't complete the repairsThe adjuster was on speakerphone and said that that wasn't true told [redacted] , she told him that its been about three weeks since he called for a supplement and that she told him to send invoices and pics for the suppl and that she still hasn't received it from him [redacted] had no answer for her he stayed quiteWe also asked him again with adjuster on phone what about the other repairs why haven't you started on them since the car has been here for almost two months you even cashed the check for the repairs, once again he didn't respondThe adjuster then asked [redacted] what would be the charges for us to move the car from the shop, since customer wants it repaired somewhere else, since it cant been done hereHe said we needed to pay $for storage a day from the time it came in and how much for teardown, he stated that he didn't know that amount for the teardown that he would have to calculated, she stated to him that should be a flat feeHe couldn't come up with the totalThe adjuster stated that just for storage was too much it was around $She also told him that the car has been at shop too long without being repaired and want to charge so much for storageShe told him she would send a field adjuster to look at the car for the supplementWe also asked [redacted] to show us on his board for his charges break down, He only had it for storage posted, but not for teardownThe authorization form my husband signed it has a teardown fee of $350.00, so why he wants to charge so muchBefore we left we told him not to touch the car that we don't trust him and that we would call the BAR and file a complaint, he can't not hold the car since they have not been doing anything to it and all they have is lied and cashed the checkOn June we received a call from the Adjuster letting us know that a field adjuster went to inspect the car and it is a total lossWe asked her then what she said to call body shop so they the insurance company get it picked upWe called and spoke with [redacted] and told him we are releasing the car to the insurance company, because it is a total lossAround the end of the week of July we called the adjuster to find get status, the adjuster stated that the shop was charging a lot of money for storage and teardown fees, and that they could not pay that amount, plus she said that when a car is there at shop with the agreement to get repaired and if at one point it becomes a total the shop couldn't not charge storage from the date it was at shop, that charges for storage start when it becomes a total lossHowever the shop will not release the car to the insurance till they get paid for over $on feesShe asked the shop to send the money that they cashed back to the insurance company, the refuse tooThe adjuster told us that since the shop is not willing to release the car, unless we pay them over $that they will have us retain the car and deduct the check we gave them from the settlement plus the storage and teardown feesThis is why we are reaching out to the BAR, because what the shop is doing is not rightWe want to pick up the car and have the body shop give us our money back since they did not do the repairs and it became a total lossThey never order the parts so it's the body shops fault for delaying the repairs, so why now charge so much storageShop never got a hold of the insurance for the supplement until over a month later, but yet still did not send what the insurance asked them to which was the invoices and pictures, until we went there on June Its how the insurance go involved and per our request send a field adjuster to see what was going on with car and supplementWhich at that time it was total per adjusterSo we feel that do to the shop delays we do not owe them storage from the time the car was there and also the amount of teardown fees there are charging since on the form we sign it stated $teardownPlease advise and check the authorization form we signed it doesn't state anything about storage fees and it only has $for teardown, it doesn't even have all our information of the car on the form we signedIf you have any question or need to get a hold of me please feel free to contact my son [redacted] ###-###-#### Thank you [redacted]

Dear Bertha Bejarano Re: Claim 25PA[redacted]001 2015 Chevrolet Camaro 2SS 2 Dr Convertible Complaint against Victory Collision Repair assigned ID 12197990 Bertha, I'm disputing the false statement that Victory Collision Repair is stating. Victory picked up the car from our house, and took it to the shop end of March. My husband went to shop and signed authorization form to start on repairs, on 4/14/2017 which on the form it did not have the vehicle information; it only had my husband signature he told us it would take about a month and half for repairs. Our contact person was [redacted] we waiting for about a week to hear from them and since we didn't we went to shop, and spoke with [redacted], he stated that he was waiting on parts, that he had order them, but where not available. Over two weeks went by still haven't hear from them. We then received the insurance check for $9458.95, so decided to go to the shop and find out why the delays and gave [redacted] the check. [redacted] stated that parts were on back order, by this time It is now sometime in May and we haven't t hear from the shop, but yet the shop cashed the check. I had my son [redacted] get involve since it was his car anyways. He contacted the shop and once again he was told the same, that they couldn't get parts. My son contracted other body shops and asked if parts were available for this kind of car (2015 Camaro) they told him yes. On June 6 my son and daughter called the insurance company Mendota and spoke with adjuster [redacted] ###-###-#### and told here what was going on, she stated that she was waiting on the body shop to submit a supplement. We then decided to go my son, daughter and myself on June7 and when we got there we spoke with [redacted] asked him to show us the car and also what was the update on parts. He showed us the car which we took pictures when we got there, all they have done is the tear down. We also asked him again with adjuster on phone what about the other repairs why haven't you started on them since the car has been here for almost two months you even cashed the check for the repairs, once again he didn't respond. The adjuster then asked [redacted] what would be the charges for us to move the car from the shop, since customer wants it repaired somewhere else, since it cant been done here. He said we needed to pay $125.00 for storage a day from the time it came in and how much for teardown, he stated that he didn't know that amount for the teardown that he would have to calculated, she stated to him that should be a flat fee. He couldn't come up with the total. The adjuster stated that just for storage was too much it was around $7000.00. She also told him that the car has been at shop too long without being repaired and want to charge so much for storage. She told him she would send a field adjuster to look at the car for the supplement. We also asked [redacted] to show us on his board for his charges break down, He only had it for storage posted, but not for teardown. The authorization form my husband signed it has a teardown fee of $350.00, so why he wants to charge so much. Before we left we told him not to touch the car that we don't trust him and that we would call the BAR and file a complaint, he can't not hold the car since they have not been doing anything to it and all they have is lied and cashed the check. On June 9 we received a call from the Adjuster letting us know that a field adjuster went to inspect the car and it is a total loss. We asked her then what she said to call body shop so they the insurance company get it picked up. We called and spoke with [redacted] and told him we are releasing the car to the insurance company, because it is a total loss. Around the end of the week of July 12 we called the adjuster to find get status, the adjuster stated that the shop was charging a lot of money for storage and teardown fees, and that they could not pay that amount, plus she said that when a car is there at shop with the agreement to get repaired and if at one point it becomes a total the shop couldn't not charge storage from the date it was at shop, that charges for storage start when it becomes a total loss. However the shop will not release the car to the insurance till they get paid for over $8000.00 on fees. She asked the shop to send the money that they cashed back to the insurance company, the refuse too. The adjuster told us that since the shop is not willing to release the car, unless we pay them over $8000.00 that they will have us retain the car and deduct the check we gave them from the settlement plus the storage and teardown fees. This is why we are reaching out to the BAR, because what the shop is doing is not right. We want to pick up the car and have the body shop give us our money back since they did not do the repairs and it became a total loss. They never order the parts so it's the body shops fault for delaying the repairs, so why now charge so much storage. Shop never got a hold of the insurance for the supplement until over a month later, but yet still did not send what the insurance asked them to which was the invoices and pictures, until we went there on June 7. Its how the insurance go involved and per our request send a field adjuster to see what was going on with car and supplement. Which at that time it was total per adjuster. So we feel that do to the shop delays we do not owe them storage from the time the car was there and also the amount of teardown fees there are charging since on the form we sign it stated $350.00 teardown. Please advise and check the authorization form we signed it doesn't state anything about storage fees and it only has $350.00 for teardown, it doesn't even have all our information of the car on the form we signed. If you have any question or need to get a hold of me please feel free to contact my son [redacted] ###-###-####.  Thank you [redacted]
