Review: On or about May 28, 2015, our legal office received a shipment from Victory Transportation. The office materials were originally ordered through Office Depot., however, Office Depot contracts with 3rd party vendors to deliver. When the delivery driver showed up to deliver our order, he was greeted at the door by our small office dog, a yorkie, weighing approximately 4 lbs. The dog proceeded to follow the delivery driver through the office. The dog was not exhibiting any signs of aggression. I was standing behind the delivery driver, [redacted], and could tell that he was becoming very aggravated by the dog. I leaned down to pick the dog up and get him out of the way, when Mr. [redacted] kicked the dog out from underneath my hands. The dog was kicked so hard, he was thrown about 5 feet across the office, hitting the upper thigh of a co-worker of mine, before falling to the grown. The dog began to run to my direction and I immediately reached down to grab him again to avoid Mr. [redacted] from kicking him again, but was unable to before Mr. [redacted] kicked him again from underneath my hands.

I yelled grabbed the dog, looked to Mr. [redacted] to stop, and Mr. [redacted] yelled at me (in a language I did not understand). Immediately after Mr. [redacted] left the building, I took his license plate and contacted Office Depot to identify who the delivery driver was, and for what company. Office Depot was not able to locate and/or provide that information immediately and I was advised that they would call me back once they have retrieved the same.

The following day, Mr. [redacted] returned to the office and proceeded to apologize for his behavior the prior day. When I questioned Mr. [redacted] about the nature of his actions, any why he kicked the dog not once, but twice, Mr. [redacted] responded that "the dog was in his way". I then asked Mr. [redacted] if he believed the more appropriate and/or professional manner in which to handled the situation, would have been to ask one of the 3 people standing there to pick up the dog, before taking it upon himself to use unnecessary force.? Mr. [redacted] agreed and apologized again. I informed Mr. [redacted] at that [redacted]e that I would be contacting his superior and that I have not ruled out taking the dog to be seen by a veterinarian in effort to rule out any potential internal injuries the dog may have sustained as a result of being kicked twice by Mr. [redacted]. Mr. [redacted] laughed at me and stating "uh huh... ok" and walked out. I have not seen or heard from Mr. [redacted] since the incident.

I attempted to locate any information pertaining to Mr. [redacted] and/or the company he works for. I contacted Office Depot on or about May 28. 2015; May 29, 2015; June 1, 2015; June 5, 2015; and June 8, 2015.

I received a phone call on June 8, 2015 from Keith Seager, the Senior Transportation Director for Office Depot. I was given the name of the driver, together with the business he represents.

On June 8, 2015, I spoke with [redacted] with Victory Transportation regarding this incident. I contacted them in effort to give them the opportunity to resolve this issue. Unfortunately, I was told that they were already aware of the situation, that they have taken remedial measures to remove Mr. [redacted] from our route, and that as far as they were concerned, that the issue was resolved.

I do not believe the issue has been resolved. I do not believe that removing Mr. [redacted] off one route, will be an effective measure to avoid an incident of the like occurring again. Mr. [redacted] acted negligently and recklessly, and does not represent the company in a positive manner.Desired Settlement: I am requesting a formal written apology from Victory Transportation. I am also requesting that any medical follow up for the dog be at the expense of Victory Transportation.

Victory Transportation has no liability or responsibility for this shipment, Victory Transportation works with 3rd party independent contractors such as in this case. If any requests are to be made they need to be to the independent contractor.In this situation the 3rd party was taken off the route and measures were taken to rectify the complaint.

I was a owner op driver for Victory transportation in hesperia ca. They lied to me about what states I would be driving to. They lied about what they paid permile. And the last straw was that three out four of my pay checks were posted dated and when I went on the day to cash them they didn't have enough money in the bank to cash the checks. These are the reasons I don't drive for Victory transportation any more. I just want other drivers to be careful and think about it if you are planning to drive for Victory transportation.
