Re: Complaint ID: [redacted] Dear [redacted] ,Our firm represents Vienna Baptist Children’s Center (“VBCC”)Accordingly, please address all future communications in this matter to my attention.I am writing in response to the above-captioned complaintThe wife of the identified customer to this complaint (“Customer”) contacted VBCC earlier this year expressing an interest and intent to enroll their two daughters in preschool at VBCC for the upcoming school yearAt the time, VBCC indicated to the Customer’s wife that although there was a waiting list for the younger child, they expected the child would very likely be placedAbsolutely no guarantee of placement was made.The Customer received and completed a registration packet that clearly stated on the instruction sheet: "Deposit Fee/May TUITION (The last month's tuition is your deposit fee.) It is nonrefundable and cannot be applied to any other month's tuition." The Customer also received a contract that indicates that a registering family is required “[t]o pay a nonrefundable deposit fee equal to one month's tuition and option amount owed for May of 2015, that this deposit fee is not refundable under any circumstances and may not be applied to any other month's tuition and option payment."Although a spot in the Customer’s desired class for their daughter eventually did open up, VBCC did not have a place for the child prior to the time the Customer informed VBCC of their intent to withdraw and their request for a refund of the non-refundable deposit feeUpon consideration of the relevant facts (as stated herein), VBCC concluded it would not refund the deposit and informed the Customer of its decision.The Customer and his wife then engaged in a course of attempted intimidation and otherwise inappropriate and threatening conduct in an attempt to secure the refundSpecifically, the Customer and his wife used angry and/or excessively over-emotional tone and language when verbally communicating with VBCC representatives regarding this matterFurther, as can be substantiated by phone records, the Customer placed repeated phone calls to a VBCC representative’s private residence, after the representative had made herself readily available to the Customer by email.For this reason, and on the recommendation of the local police with whom VBCC filed a report, VBCC sent the Customer and his wife a demand to cease and desist in their harassing conduct and that the Customer and his wife refrain from entering onto VBCC premises, defined as where VBCC is operating during school hours, or where VBCC activities are being conducted outside of school hoursIt was clearly communicated to the Customer by letter that if the Customer had “a legitimate need to access Vienna Baptist Church premises, separate and apart from where VBCC is operating, either during school hours or while VBCC is conducting a school activity outside of school hours” VBCC would make arrangements with the Customer to ensure he was not denied access to the churchIt was clearly communicated to the Customer by letter: “To be clear, VBCC is not attempting in any way to limit your access to Vienna Baptist Church outside of school hours, when there is not VBCC activity being conducted on church premises.” Accordingly, the Customer's claim that he is no longer permitted to “even enter onto Church property” is blatantly and a telling indicator regarding the Customer’s general truthfulness and credibility in this matter.VBCC believes the Customer's complaint to the Revdex.com is simply the latest step in the Customer’s efforts to bully and harass VBCC in an attempt to secure a refund to which the Customer is simply not entitledI expect this response fully addresses the customer's complaint and resolves this matter, but if not, please do not hesitate to contact me.Sincerely, [redacted] ***ara *A***
