Firm appointed Alain P[redacted] as the Sellers Listing Broker. As a result of our agency relationship with the Sellers, and according to The Law of Real Estate Agency, our office owes the Sellers all Fiduciary Duties. A different real estate office represented the Buyers. We understand that the Buyers are making a complaint against our office. Our office did not represent the buyers in this transaction. With that being said, we would like to take the opportunity to explain what happened with this transaction so that everyone involved can have a better understanding because no matter whom we represent, it is always our intent to act in good faith.The Buyers entered into an agreement to purchase the real property mentioned above from the Sellers. In that agreement, the refrigerator and stove were to be included in the sale. On September 18, 2015 the sale of the property closed and the Buyers were entitled to possession of the property. On the day of closing, the Listing Broker Alain, who was representing the Sellers, went to the property to retrieve the house keys so that he could give them to the Buyers Broker. Alain arrived at the property at about 1:35PM and discovered that the home had been burglarized and the refrigerator and stove had been stolen. He immediately called 911 to report this crime and then notified the Sellers and the Buyers Broker. The Pierce County Sheriffs Department told him that in order to have a police report completed, someone would need to wait at the home for the Sheriff to arrive. The dispatch informed us that they were experiencing a very long response time. Alain immediately volunteered to wait for the Sheriff to arrive even though he had just picked up his 2 year old son and still had him with him in the car. Alain and his 2 year old son waited outside the home in their car for over 4 hours so that a police report could be completed. Once the Sheriff arrived,[redacted]she completed her investigation and left. Shortly after that, the Buyers Broker arrived and Alain gave him the keys for the home. Since that day, the Sellers were working with their insurance company so that they could provide a new refrigerator and stove to the Buyers. It is our understanding that the Sellers filed a claim with their insurance company and were waiting for the response.Since the closing of this sale, our Listing Broker has spoken with the Buyers Broker on many occasions so that messages could be relayed between the Sellers and Buyers regarding the status of the insurance claim made by the Sellers. On October 3, 2015 the Buyers began contacting our Listing Broker Alain directly through email. We have records of our Listing Broker responding to the Buyers through email on 10/3/2015, 10/6/2015, 10/8/2015, 10/10/2015, 10/16/2015, 10/28/2015, 11/6/2015(1 day before the complaint was made), 11/9/2015, 11/12/2015, and 11/16/2015. On November 9, 2015 our Listing Broker received a call from the Sellers telling him that the insurance company was not going to cover the theft of the refrigerator and stove. The Sellers said that they would like to pay the Buyers $200.00 twice a month until the value of the refrigerator and stove were paid in full. The Sellers said that they paid a total of $2,200 for the refrigerator and stove about 4 years ago. Our Listing Broker included the proposed $200.00 twice a month in an email to the Buyers on 11/9/2015.We understand the frustration that the Buyers must be feeling at this point. We want them to know that our Listing Broker has responded to every email and phone call that he has received in regards to this incident and he will not stop responding until this is resolved. We also want to say that we can only relay the messages that we receive from our Sellers and that we are only a third party to this transaction between the Buyers and Sellers. We have communicated every message that we have received from the Sellers to the Buyers and vice versa since this all started. We are hoping that the Buyers and Sellers can come to an agreement and we at Viking Realty will do everything that we can to help.Below is a message from our Listing Broker to the Buyers:Dear [redacted] & [redacted], I know that the home buying experience is not supposed to be like this and I really want to say that I am sincerely sorry that this has happened to you guys. I have spoken with you personally and I really do get the feeling that you are truly good people and really care about your family. I promise that I will still be here to help you and the Sellers communicate with each other for as long as you need me to be. You can call or email me anytime.
