Compliant #: ***To Whom It May Concern,It has been brought to my attention that a neighbor is concerned and is unhappy regarding the fees associated with terminating their lease contractI did receive a letter from the Revdex.com, in the letter it stated "we knowingly withheld relevant information"
from the resident, this for us is in violation of the privacy policy act, and Fair Housing LawsWe are not allowed to steer prospects to and from a particular areaAlso, we are not aware of what residents may be sensitive to "barking dogs", and even if we knew, this information could not be disclosed, or that the neighbor worked from home this applies to the privacy policy act as wellWe were not aware that the dog would bark all day, and I would assume nor would the neighborOur TAA pet policy agreement states in section "Disturbances: The animal must not disturb neighbors or other residents, regardless of whether the animal is inside or outside the dwelling"All residents are liable for their petsWe did not ask the neighbor to move, all that was asked was to find a way to remedy the situationThey voluntarily chose to break their lease agreementThe lease becomes a binding contract once it Is signed, regardless of how long you lived in the apartment home.I don't think this office was given time, or the chance to rectify the situation, nor do I think the resident gave it chance with trying different options to keep the dog from barkingThe first day the neighbor came in regarding their dog barking, the neighbor commented about breaking their leaseI, myself reassured her that we could work through thisThis is not the first time an issue like this has happenedThis is however the first time a neighbor decided to break their lease due to their barking dogIn the past when a situation like this has occurred, it wasn't an overnight fixIt did take time, but it worked itself outI do not believe that in any way, that this situation caused a "constructed eviction"The situation on hand, does not even apply to constructed evictionAs a landlord, I don't think we provided the neighbor with inhabitable living conditions.If they neighbor would like to come by the office, I can discuss Lease Termination options that might suitable for them_Sincerely,Brittany Hardin
