May 28, 2015Dear *** ***:I represent Vincenzo Coletta General Contracting and would offer the following in response to your letter of May 11, MrColetta had a contract with *** *** for $15,He unilaterally cancelled the contract while it was still in process on Tuesday, April
21stOn the Friday before he unilaterally cancelled the contract, *** *** gave MrColetta $2,Simply stated if *** *** had such serious concerns it would make no sense to provide additional funds two work days prior to cancelling the contract.The crux of the complaint made by *** *** appears to revolve around his opinion that work was not proceeding quickly enough*** *** made this determination just six (6) days into a multi-week jobGiven the scope of the work required and the requests by *** *** to painting MrColetta did not feel it would be possible to satisfy *** ***'s internal time schedule*** *** had notions that MrColetta needed to work into the night and perhaps on weekends as “North Jersey" contractors had allegedly done for *** *** in the past.When *** *** declared that he was terminating the contract, MrColetta agreed to return the $2,he had been given on the Friday before as an overall settlement of the contractIn simple terms *** *** entered into an accord and satisfactionBear in mind that MrColetta had every right to claim all of the money due under the contract but to avoid the time, effort and expense of the very process he is now engaging, he agreed to return $2,and leave the job*** *** cannot have things both ways, i.eaccept a settlement and then continue forward to ask for more.What MrColetta did discover while on the property was partially completed electrical work which likely was started by another contractor and abandonedIt may appear therefore that *** *** is no stranger to this process and we would be most interested in knowing whether has made similar complaints concerning contractors with your BureauIf a pattern is involved there may be serious issues present. After MrColetta first contacted me, I immediately left a voicemail for *** *** indicating that MrColetta had returned $2,and would not be returning any additional fundsThere was never a lack of clarity on MrColetta's position; *** *** just wants a different answerHe certainly has redress to the Court system but he may be aware that he faces a $10,counterclaim if he proceeds in this fashionI would encourage him to explore the law on accord and satisfaction and if he believes he can overcome the settlement he made with MrColetta and is willing to defend a counterclaim then he should seek redress to the Courts.Finally, *** *** has completed a complaint form in which he makes the unfortunate decision to accuse MrColetta of being “a crook"Under Pennsylvania law this is libel, per se and is actionable without proof of additional damagesI would note that additional publication of this type of accusation can be very problematic and in light of the facts expressed above it is my sincere hope that the matter will be marked closed in conformity with accord and satisfaction reached by the parties.Very truly yours, Timothy H

process on Tuesday, April 21st. On the Friday before he unilaterally cancelled the contract, [redacted] gave Mr. Coletta $2,500.00. Simply stated if [redacted] had such serious concerns it would make no sense to provide additional funds two work days prior to cancelling the contract.The crux of the complaint made by [redacted] appears to revolve around his opinion that work was not proceeding quickly enough. Given the scope of the work required and the requests by [redacted] to re-do painting Mr. Coletta did not feel it would be possible to satisfy [redacted]'s internal time schedule. [redacted] had notions that Mr. Coletta needed to work into the night and perhaps on weekends as “North Jersey" contractors had allegedly done for [redacted] in the past.

After Mr. Coletta first contacted me, I immediately left a voicemail for [redacted] indicating that Mr. Coletta had returned $2,500.00 and would not be returning any additional funds. There was never a lack of clarity on Mr. Coletta's position; [redacted] just wants a different answer. He certainly has redress to the Court system but he may be aware that he faces a $10,000.00 counterclaim if he proceeds in this fashion. I would encourage him to explore the law on accord and satisfaction and if he believes he can overcome the settlement he made with Mr. Coletta and is willing to defend a counterclaim then he should seek redress to the Courts.
Finally, [redacted] has completed a complaint form in which he makes the unfortunate decision to accuse Mr. Coletta of being “a crook". Under Pennsylvania law this is libel, per se and is actionable without proof of additional damages.
