A furnace part needed to be removed and replaced. The entire plumbing was replaced and reconfigured without permission.Actual removal and replacement of furnace part was less than 1 hour. When I arrived home from work he was still there and had replaced other parts and rearranged and replaced most of the copper pipes. This was done without giving a reason or estimate or permission to do so. He was here for 7.5 hours. I did not sign anything regarding the changes or cost. This took place in March 2013 and [redacted] did the job. His bill for 7.5 hours came to $1700. I would never accept any work done without an estimate for cost. [redacted] refers to my marital separation and this would be especially a good reason to want a cost estimate. When I came home the first time there were pieces of plumbing strewn all over the floor. He didn't even give me a price for the part that was the original concern. As he refers to my separation as an excuse not to pay him, it seems more likely that is why he took advantage of me. I am offering to pay for the part he referred to and the one hour to take out the bolts. I don't have any other money to give him that is why I needed an estimate.Business' Final Response June 26, 2013Revdex.com6 Park Avenue, Suite 100 Worcester MA 01605Attention: [redacted]To whom it may concern:This is my response to your complaint activity report case #234895 concerning [redacted].Customer states:"A furnace part needed to be removed and replaced".My response:As stated in Finance Charge invoice #[redacted] (please see copy attached),[redacted] called me in February for service on boiler for cleaning. I cleaned the oil burner on 2/20/13. During the cleaning, I found a problem with the tankless water heater (which works off of the boiler) and said to [redacted] that I would like to explain the problem to her husband **. I spoke to ** and he said he wanted to replace the tankless water heater coil.Customer states:"The entire plumbing was replaced and reconfigured without permission".My response:Please refer to response above. The piping that was replaced was necessary during the replacement of thetankless water heater coil and the additional parts as described below.Customer states:"Actual removal and replacement of furnace part was less than 1 hour".My response:While I was replacing the tankless water heater coil, [redacted] came home from work for a short time to check in with me and we discussed the work that I was doing which at the time was going ok. However, after she left and I continued to work on the boiler the additional mechanical problems surfaced. The backflow preventer and feeder valve would not feed water to the boiler. After that [redacted] then came home a second time and we discussed the additional problems and she gave me permission to continue with the work. The entire job took me seven and one half hours. The time to replace the tankless coil alone is at least three hours - not the one hour that she claims. If I had replaced only the coil, the boiler and water heater would not have operated - there was no other solution to the problem. In fact, if the problem with the water feed to the boiler had not been repaired the boiler would simply not have operated at all.Customer states:"When I arrived home from work he was still there and had replaced other parts and rearranged and replaced most of the copper pipes."My response:Please refer to response above. The other parts were replaced after [redacted] gave me permission to do so. Their replacement was necessary in order for the boiler and water heater to work. Customer states:"This was done without giving a reason or estimate or permission to do so".My response:Please see above.Customer states:"He was here for 7.5 hours. I did not sign anything regarding the changes or cost".My response:Yes, I was there for 7.5 hours because it was a big job. [redacted] did not sign anything because she gave me verbal permission to do the job. In hindsight, I wish I had left the house and returned with a contract for her to sign before doing the work so that I would not be in this situation. However, I did not want to leave her there with no heat or hot water so I did the job on verbal approval.Customer states:"This took place in March and [redacted] did the job. His bill for 7.5 hours came to $1700. He listed the different pipe parts and plumbing but did not itemize each piece."My response:I did the job on April 2, 2013. Please see invoice #[redacted]. Upon the advice of my accountant, my invoices are billed as a lump sum price instead of itemizing. All of my invoices are done this way. This is done because I pay MA sales tax to my wholesaler instead of billing the customer for sales tax on an itemized bill and sending in quarterly state tax payments.Customer states they want the following resolution:"I pay for the one part and the one hour it took to replace it".My response:Replacement of the one part (assuming she means the tankless coil) is a minimum three - four hour job with no removal issues. This job was far more complicated and required additional work to bring the boiler and hot water tank back to normal function.Customer states:"Today 6/6/13 I received a letter from [redacted] stating that he added a late fee of $40.33 and wants full payment $1745 by 6/10/13. If not received by that date legal collection will commence immediately."My response:Please see copy of invoice #[redacted] and invoice #[redacted] from the February oil burner cleaning. Both invoices clearly state that the terms of payment are due on receipt and that past due balances will be assessed a monthly finance charge of 1.5%Prior to assessing the late charge, I made several attempts to discuss the status of payment with [redacted]. On May 28, 2013 (two days before [redacted] filed the complaint with you) I called her house twice. I spoke to a young man who identified himself as [redacted]' nephew. He said [redacted] was home but did not want to talk to me. There was no mention made during that conversation of her claims that I performed unauthorized work to the boiler and water heater. Instead, the nephew said I should call her husband ** about the bill and he gave me **'s cell phone number. I called and left a message on **'s cell phone and have not received a return phone call to this day. Customer states:"The sections of his letter mentioned my garage code as well as that fact that my sons were home and some of their things were in the basement. I don't see any of that has any bearing on the situation or price or the fact I feel taken advantage of because my husband was not living at the house."My response:Please see copy of invoice #[redacted]. I mentioned in the invoice the fact that she gave me her garage code and that there were things in the basement belonging to her sons to illustrate the fact that we had a conversation about the boiler and the water heater and that she gave me permission to enter the house when she would not be there in order to do the work. I also described in the invoice the fact that I found further problems with the boiler when I was working on it and that she gave me verbal permission to do the job.This invoice with these details was written after my attempts to secure payment of the invoice by trying to reach [redacted] by telephone, after she refused to speak to me on the telephone and instead had her nephew talk to me, after the nephew referred me to the husband ** for payment, and after I called ** for payment and did not receive any return phone call. At that point, it seemed quite clear that [redacted] did not intend to pay the invoice. I prepared it with the knowledge that I would probably be sending it for legal collection and wanted to include all the details pertinent to our conversations during which she gave me permission to do the work.For those reasons, my statements have a great deal of bearing on the situation. I was asked to do the work regardless of whether or not her husband was living in the house. The boiler and water heater would not be working if I had replaced the "one part" as she claims.Please note that, after [redacted] came home (for the second time) on the day I did this job, she asked me to do more work and look at a toilet that was not working. The water was shut off to the toilet because it had apparently overflowed and ruined the ceiling below. As a courtesy, I looked at the toilet and determined that it was ok to use and turned the water back on. I did not charge [redacted] anything for this.It is my opinion that I am caught in the middle of a marital dispute and this false claim has been filed as an attempt to avoid payment.
