The customer signed a contract with our company to have the mentioned work completed. We subcontracted that work out, with a contract for the painters, jose T[redacted] Painting Co., as we have numerous times before. From what we were told by both parties Mr. [redacted]n decided to hire our...

subcontractor directly, after signing our contract, because it was cheaper to pay him directly. This is a breach of both parties contracts. Our company purchased materials for the job as well as paid a down payment for labor to Mr. T[redacted].

As mentioned, I was not pleased with the way Chris P[redacted] was handling our wallpaper stripping and painting project. Work began on 3/19/15. There was no oversight or support on his part. He did not show up to see how the work was proceeding. I did not ask for references or check him out with Angie's List before agreeing to let him do the job. So I called Angie's list to see what they knew of him. They said they never heard of him or his organization and they referred my inquiry to their brand enforcement department. I can provide copies of emails if you require them.I also asked the two painters about his company. They said they worked on other projects with him. They were not employees, but rather sub-contractors to The P[redacted] Group who were acting as a general contractor. I showed them the agreement I signed which stated I was to pay the cost of all materials, labor of $4,845.82 and to make a down payment which ended up to be $2,500. The painters reluctantly told me they were going to be paid $2,000.00 to do all the work.This is when I became angry because it was apparent The P[redacted] Group was going to make a $2,845.82 profit on this project. On 3/20/15 I called Chris P[redacted] mid day and told him what Angie's List said and that I did not want to continue this project with him. He asked what was the problem and I replied that the biggest problem was the cost. I asked his what was he paying the painters and he would not answer. He did state that he would make a counter offer and I stated I would consider it. He never called back and did not follow-up with a counter offer.I notified him quickly, by phone, that this agreement had a big problem and he agreed during that conversation to make a counter offer. I think that brings the validity of the agreement into question.I later asked the two painters if they had a written contract to do the work on our home and whether they had been paid anything so far. They indicated no to both questions. After seeing the reply from The P[redacted] Group, this week I contacted Jose T[redacted], owner of the sub contractor company and again asked him if he had a contract with The P[redacted] Group to do the work in our home or of if he had been paid anything by them for our project. He said he had signed nothing and was paid nothing.As things stand now, the work is complete. I provided all materials and paid the painters $2,500 for their efforts. I have all the receipts and cancelled checks.The P[redacted] Group reply also stated they incurred expenses for materials. In March I spoke with the Porter Paint store in Castleton where the materials were ordered and with the Porter Paint store on Michigan Road where they were to be picked up. The cost was about $525.00 as I recall.What I want is the return of my $2,500 down payment. I am willing though, to cover the Porter Paint costs so long as those materials are made available to me.
