After employing vip rentals to manage my property they first refused to use the home warranty for the property,after multiply attempt to communicate with them no improvement were made.after termination of contract.Tim a owner of the company told me I couldn't legally do so,after speaking with a lawyer I was inform that was incorrect.vip rentals continued taking commission after there termination

This firm and the undersigned are counsel to VIP RENTALS LLC (" VIP") with regard to Revdex.com ("Revdex.com") Case No. *** ("Complaint"). The Complaint is meritless and is a brazen attempt to exto11 fees due to VIP under the property management agreement ("Management Agreement") entered into by *** ("***") and VIP. All allegations made in the Complaint are patently false. In the Complaint, *** alleges VIP refused to use ***'s home warranty. This is not correct. The Management Agreement gives VIP the authority to move forward with emergency repairs. Under this authority, VIP repaired the hot water and air conditioning to the rental property on an emergency basis so the tenant could take possession. Working air conditioning and hot water were provided for in the tenant's lease. Furthermore, if not supplied, *** and VIP were potentially in violation of Va. Code Ann.§ 55.1-1328 and its successor statute Va. Code Ann§ 55-248.22 (repealed effective October 1, 2019). In addition to the necessary emergency repairs to the air conditioning and hot water, there were other requested repairs during the rental term. The home warranty company was contacted each and every time for these repairs, but only covered one of the issues. Perhaps *** should file a complaint against the home warranty company for lack of coverage, instead of against VIP for properly caring for the tenant and ensuring ***'s compliance with the Virginia Residential Landlord Tenant Act. VIP acquired the tenant for ***. Under the Management Agreement, VIP is due commission from every rental payment made by the tenant it acquired. *** attempted to breach the Management Agreement and intended to wrongfully withhold earned commission from VIP. The tenants acquired for *** failed to abide by the terms of their lease by not submitting a notice thirty (30) days prior to the end of the lease term. On behalf of ***, VIP enforced the terms of the lease and required tenant to pay additional rents. VIP rightfully collected commission on the additional rent. ***'s complaint is meritless. Rental prope1ty cannot be viewed as a "turnkey" business. An owner of rental property has a responsibility to ensure the tenant resides in a safe, habitable environment. VIP knows this. VIP acquired the tenant for ***, abided by the terms of the Management Agreement, and protected ***'s interests, all while properly serving the tenant's needs. Please let me know if you have any additional questions or concerns. I look forward to this complaint being dismissed soon.
