I have reviewed the response made by the business in reference to complaint ID [redacted] , and find that this resolution would be satisfactory to me I will wait for the business to perform this action and, if it does, will consider this complaint resolvedI am replying to the response from [redacted] : First of all the dates they had scheduled to perform the job the weather was perfectly ok except for Monday August the 9thThe driveway issues where it caved in has nothing to do with the car parking, even an unprofessional can figure this out by looking at the drivewayOne of my guest parked their car just about a month ago (in August) and the driveway work was done by Virginia Driveway last MarchI was told not to use the driveway for three days after the work was completed but I have avoided using the driveway for one whole weekI had to park my car across the street to one my neighbors driveway for that entire weekSo I do not understand how is this too soonAnyway I will wait for them to fix the drivewayI have received a call from the owner (Bill) that they will be here on September 15thThanks to Bill (owner) for calling me and scheduling the dateHe was very nice, apologetic and understandingHe is very nice to work with Regards, [redacted] ***

First of all, I would like to apologize to Mr***, if Virginia Driveway in anyway has not communicated effectively with him In this business, weather constantly dictates our schedule and in the case of Mr***, when we have scheduled to have his work completed, the schedule was having to be adjusted because of the weather We did contact Mr [redacted] each time we needed to adjust our schedule, so I do feel like we communicated adequately with him.In regards to Mr***’s driveway itself, it is technically not a warranty issue, as a vehicle was put on the driveway too soon after the work was completedThe tire indentations have nothing to do with the quality of work that was providedAccording to our contract the work was completed as promisedWe did remove the failed asphalt as needed and installed a #21A stone at the pot holes before we did the overlayThese areas are not failing whatsoever, and these areas are not the reason why Mr [redacted] has contacted us Because of Mr***’s frustration we are currently looking at new ways to approach any warranty issues we may have in a more timely fashion We are currently scheduled to have Mr***’s damaged driveway repaired next week Sincerely, [redacted]

I am replying to the response from [redacted]: First of all the dates they had scheduled to perform the job the weather was perfectly ok except for Monday August the 9th. THIS IS NOT A WARRANTY ISSUE. Virginia Driveway’s warranty
clearly states that we are not responsible for vegetation that penetrates
through the asphalt after we’ve completed our work.
Virginia Driveway uses a product called Permitol, which is
the strongest industrial strength vegetation...

killer on the market. When the
original work was performed, Virginia Driveway excavated and removed all of the
vegetation and thoroughly sprayed the area with Permitol.
The plant came back through the driveway for a second time. Technically,
this was not Virginia Driveway’s responsibility but since I was disappointed on
how the plant damaged the driveway I was concerned that we didn’t put enough
Permitol on the vegetation. Virginia Driveway then agreed to come out and fix
the issue even though we do not warranty vegetation regrowth. When the driveway
was removed, we used Permitol and Diesel fuel to try to kill all of the plant.
We then put the asphalt back in as per the contract we had with Mrs. [redacted].
The plant came back a second time and I, Richard Koehler,
made a special trip out to the property just to see the issue again. I
explained to Mrs. [redacted] at that we had used Permitol and Diesel fuel before we
laid the asphalt and that if the asphalt was removed and the vegetation
addressed again that this issue still might happen.
I told Mrs. [redacted] that when we had crews in the area we
would address the issue at no cost. Again, this is not a warranty issue.
Since this complaint was filed, I have spoken with Mrs.
[redacted] and Virginia Driveway has agreed to take out the asphalt again. It was
agreed that is would be Mrs. [redacted]’s responsibility to find a landscape
specialist to deal with the plant issue. Once the landscape issue has been
dealt with to the approval of Mrs. [redacted], Virginia Driveway has agreed to lay
new asphalt at no charge to her once again.
We are a company who stands behind its work and if this
doesn’t show how we are committed to standard, then I don’t know what does.

As owner of Virginia Driveway, I sincerely apologize to Mr.
[redacted] for our company not getting back and cleaning the sealer off the garage
and his mailbox. Virginia Driveway strives to provide excellent workmanship and
superior customer service. I’m embarrassed to the fact that Mr. [redacted] had...

respond 10 times and file a complaint to the Revdex.com to get our attention in this
matter. The employee that Mr. [redacted] mentioned, who was responsible for making
the right people aware of warranty situations, did not relay the multiple
messages that Mr. [redacted] left. They are no longer with our company and at this
time we are scheduling to take care of the situation at Mr. [redacted]’ by Friday
of this week.
Quality comes first with VA Driveway. We do not try to rush
in and do the fastest job we can and then leave. We strive to be best driveway
sealer in the [redacted] and if our customer’s aren’t satisfied, we’ll see to
it that we can accommodate them so they are satisfied.  Thank you,[redacted]

As owner of Virginia  Driveway is seems as though every year I deal
with a situation like this.  I’m sorry that Mr. [redacted] does not understand that our
company is in demand and that our sealing crew completing jobs is based on
weather conditions.Our schedule is constantly moving when it...

coating. And yes, Mr. [redacted] was pushed back several times due to the weather
affecting our ability to get to him on the dates we gave him. Our records
indicate that either he or his wife were contacted by phone every time it was
required that he be rescheduled.
On our estimate-contract which Mr. [redacted] signed, it clearly
states “weather consistently dictates our schedule. Because of the quality of
our work, our company, during the sealing season, is in high demand. We ask that
you be patient as the need to reschedule your work could occur several times
due to inclement weather. Trust us; it is very frustrating for us to have to adjust
our schedule, but it is something that is unfortunately unavoidable. We
appreciate your understanding if this does happen.”I'm not sure if Mr. [redacted] saw this on his contract or not but I  we had contacted Mr. [redacted] either leaving a voicemail or speaking with
him/his wife on several occasions.I believe that Mr. [redacted] is out of line and unaware of how I run my business to
come to the conclusion that we would bump his seal job to do a paving job.  Virginia Driveway runs separate paving and separate
seal coating crews and these two crews work simultaneously.

I’m not sure if Mr. [redacted] has all of the facts correct in
his complaint. What it comes down to is this: Virginia Driveway did the job
correctly. As the owner of the company, I personally went out to inspect Mr.
[redacted]’s driveway. The driveway was in terrible shape and it was recommended
that it...

be taken out and repaved. This was not something Mr. [redacted] was willing
to do.
We agreed to just seal the driveway. We went above and
beyond what we typically do for a driveway in that condition.   Mr.
[redacted] was upset that the crack filler dried darker than the sealer. His
contract clearly stated that: “crack filler will not make cracks disappear, nor
will deep cracks be flush with surrounding asphalt… These areas will dry darker
when the job is completed.”
The Virginia Driveway office, and the salesman, [redacted], had many conversations with Mr. [redacted] about his driveway and about how
poor of shape it is in. Virginia Driveway could not seem to communicate to Mr.
[redacted] in such a way that it was understandable to him, for him to be satisfied
with the end product based on what the contract stated, and therefore a refund
was offered.
It was an over-site on my part that the refund was not made
to Mr. [redacted] sooner. His refund is going out in the mail today.
Virginia Driveway fulfilled its contract 100% and I feel there
is not another asphalt paving/sealing company that does as good of a job as we
do.
