I've received a letter concerning ID [redacted] After learning incorrect addition of sales taxon gratuity, I've immediately contacted the company that installed the POS system in my restaurantUpon looking into a issue, it was corrected immediately where sales tax will onlybe charged to sales transaction, but not on gratuityAs to issue with gratuity being chargedto party of 2(two people), it is our restaurant's policy that 15% gratuity be charged to all Bar-B-Que table dining regardless of number of partiesThe policy was established due toextreme amount of work and effort our wait staffs have to perform on every Bar-B-Que tablesas the customers who had dined at our Bar-B-que tables in our restaurant will agree, hopefully It is also stated in the Bar-B-Que portion of the menu that 15% of gratuity will be added to the bill on all Bar-B-Que table diningBut certainly, the customers have the option of declining the gratuitypaymentIf our gratuity policy have offended some customers, please accept my sincere apology.I would also like to thank the customer who pointed out the incorrect sales tax addition on gratuity, so that it can be correctedI would hope this explanation was helpful to resolve this matterThank you Joseph ***, owner of Mama's Restaurant

I have reviewed the response made by the business in reference to complaint ID ***, and have determined that the response would not resolve my complaint. For your reference, details of the offer I reviewed appear below.Two points: first, the server could not answer my question regarding the restaurant's unlawful practice of taxing the gratuity, nor did they offer to remove the gratuity charge or additional taxSecondly, this practice warrants an IRS audit to determine when the restaurant began overcharging its costumers and what amount the restaurant fraudulently took from patronsIf the restaurant paid the additional tax to the IRS then the IRS benefitted from the mistakeIf not, then the restaurant has been benefitting. Additionally, the restaurant has not offered to refund the overcharge to me or any unsuspecting customers This alone is grounds for a rejection of their response.

It is very unfortunate that my response to the complaint ID[redacted]
was not satisfactory. As it was questioned from the customer regarding
sales tax on gratuity, 100% of all sales taxes collected from the customers,
was paid to the IRS every month. If an IRS audit is necessary to resolve this
matter, then I will cooperate fully. I deeply regret this incident occurred, but it 
was not done intentionally what so ever. Just for the record, the POS system
which incorrectly calculated sales tax on gratuity was installed in September-15-2014.
As to the matter of refunding the gratuity and sales tax on gratuity, I am more than 
willing to do so to the customer who filed this complaint. I apologize for not offering
the refund when the issue first was reported. Once again, I, as a owner of the 
business, sincerely apologize that this incident occurred, but will assure it will never
happen in future. If there is anything else I can do to better this matter, please let me
know at anytime. Thank you.
