Complaint: [redacted] I am rejecting this response because: Michelle T [redacted] works for both By Design Builders as well as [redacted] Design Kitchen and Bath— [redacted] Design is just the name for her design part of the businessHer statement that "we are not a construction firm nor do we handle construction, building schedules, or building costs" is purposely misleading because she was working with us on both aspects of the project, emailing us from both business email accounts, as well as from her husband’s account at By Design, and was fully aware of all details about the project, both design and constructionWe chose them because their main selling point was that they were a one stop shop, offering all services in one package To support this, the following is stated on their blog at [redacted] (italics mine): ABOUT BY DESIGN Creating and Building smart home, kitchen and bath design because every square inch matters We are Poggenpohl Hawaii, authorized reseller Designer and Builder: professional designer and remodel contractor specializing in extraordinary residential kitchens, baths and interior spaces in South Maui including Wailea, Makena, Kihei and Maui MeadowsTransform your Maui property into a fabulous Maui retreat with luxuryWe are continually seeking innovative products and exotic materials to incorporate into our renovation projects Wall-mount articulating faucets, shower drains that light when the water enters, [redacted] glass tiles, LED lighting, custom hand-crafted cabinetry; we have done it all and continue to pursue the highest of luxury and design Your project should not be by accident, it should be BY DESIGN Services Provided: Design, project management, construction, detailed completion The work was supposed to start on September 15th, This is noted on the invoice with [redacted] Design, which also clarifies that she was representing both companies For work to begin, all of the design and materials selection had to be completeWhen we learned from her on September 4th that the work could not happen on time, we had still not received any of the design materialsOn September 13th we wrote that “this is official notice that we do not plan to proceed with this renovation with By Design or [redacted] Design Kitchen & Bath LLCIn addition, because none of the services included in the $1,design fee we've already paid to [redacted] Design have been rendered, we request a return of that amount immediately.” (This email correspondence was sent to Revdex.com previously but I have attached it once again for your reference.) We reiterated this again on September 15th On the evening of September 15th, after business hours, we finally received design plans that were incomplete, after we’d already told [redacted] Design we wanted a refundAs can be seen in Michelle’s last correspondence with Revdex.com where she supplied the incomplete plans, the following items were incomplete or inaccurate: · Cabinet hardware: had never been discussed, we had requested chrome and she has listed brushed · Tile Wall (accent): there are many Vihara tiles that could be called green but we had chosen a specific color that is not listed here · Ladena sink: wrong size · Fixture – square drain: we had discussed and agreed upon a linear drain which is totally different · Fixture – toilet and toilet seat: there are question marks here which supports the fact that we had never discussed Toto and all Toto toilets would have been out of our budget, no question, a fact Michelle was well aware of Completed design plans and budget should never have question marks, missing or incorrect informationIn addition, Michelle had told us that the tile quote was “outrageous” and the recessed lighting quote was problematic, so these line items were obviously not finalWe were also given no opportunity to review these plans When we signed the retainer with [redacted] Design, Michelle told us the $1,would cover the scope of what we needed and we would only go above and beyond that amount if we made last-minute changes after decisions had been made, so her statement in her response to Revdex.com that the invoice had been adjusted to credit us $is incorrect Sincerely, [redacted]

RE: Complaint ID: [redacted] We are in receipt of the above referenced complaint.We are a design firm and provide design servicesWe are not a construction firm nor do we handle construction, building schedules or building costs.The complainant emailed on September 21, stating that they were in receipt of the packet we sent but did not open it because they felt the work was incomplete.On September 22, we replied to the complainant including a copy of the signed non­ refundable design agreement entered into July 28, We also included detailed accountability of services rendered (numerous site meetings, materials sourcing/research, CAD drawings, and email correspondences) on the paid invoice [redacted] dated September 16, We did not offer a refund for services rendered nor do we now.Enclosed for your review are:•copy of email correspondence to complainant dated September 15, and from complainant dated September and 21, 2015•copy of email to complainant dated September 22, 2015•copy of letter dated September 15, addressed to complainant which included the following:•floor plan•elevation design•specifications noted on plan•budget worksheet•full set of materials specifications for all fixtures as noted on the budget worksheet (not included in this response due to the amount of paper which would be wasted)•signed non-refundable design retainer agreement•invoice [redacted] dated September 16, - PAID in FULL**The invoice was adjusted with a credit for $per the design retainerTypically we bill for additional hours at a rate of $per hour, clearly specified in the agreement.With aloha,Michelle T [redacted]
