Initial Business Response /* (1000, 6, 2015/06/04) */
I have had an opportunity to review the concerns from the complaint as well as discuss the transaction with both the Sales Associate and the Sales ManagerAlthough I do empathize with the situation, the vehicle was sold "as is "implying NO
warranty for any repairsThe vehicle was priced based on its condition and was considerably discounted to any similarly equipped vehicle on the market for this reason
In an effort to insure customers are confident in their purchase, we review all warranty options with them whether they be from the factory or from the dealershipWe have policies in place to insure customers understand what is and what isn't warrantiedAfter reviewing the deal jacket I see that these procedures were followedAlong with the mandated Buyers Guide, the customer signed additional documents indicating that he understood what would or would not be covered as well as if the dealership had promised to perform any work to the vehicleThe Buyers Order clearly states the vehicle is being purchased "As Is" along with the Due Bill which covers any work promised states in the section for promised work that" Nothing Promised Unit Sold "As IS"This is a hand written section that we require the customer to sign and acknowledge on every vehicle purchased from our Dealership (Please see attached documents)
We give the right to every customer to Drive the vehicle, have it inspected by a third party or review any service records we have on the unitMy understanding is that the customer did spend a considerable amount of time looking over the vehicle but did not have anyone perform a mechanical inspection on his behalf or ask to review the inspection form mentioned in his statementOur decision stands - we are not responsible for any repairs on a year old 180,mile vehicle clearly sold "AS-IS"
Initial Consumer Rebuttal /* (3000, 8, 2015/06/14) */
(The consumer indicated he/she DID NOT accept the response from the business.)
We do not disagree with the fact that we signed several documents, saying that the vehicle is sold "as is." However, we were of the understanding that the vehicle in its "as is" condition was safe to drive miles to our home in Illinois
In addition, we were not told or made aware that we could have a third party look at the vehicle before buying it nor that we could review any service recordsThe sales associate only printed a copy of the car fax for us, which we had already viewed online because Vision Ford had made it availableBy making the car fax available online, they made it appear that they were being honest about the vehicle, which we found to be untrueAlso, we did drive the vehicle and look under the hood, around the body, and under the body of the vehicleHowever, we can only see little things that may or may not deter us from purchasing the truck, which is what we stated in our earlier complaint
In the end, though, the price did not reflect the major damage to the engine of the truck as Vision Ford is claiming in their defenseThe body of the truck has enough rust to warrant the lower price that they were offering as well as the need for new rear tires and a missing wheel well coverWe have provided some pictures of the body damage to the truckWhen the engine problems are added to these costs, the vehicle should be another to cheaper than Vision Ford was trying to sell itThey were able to hide the engine problems from the consumer and make it appear that the price reflected the body damage and minor, non-life-threatening issuesTherefore, we were led to purchase a truck that we would not have purchase had all of the information been availableThey never told us about the engine issues and let us drive home in the truck which could have left us stranded miles from home or worseVision Ford told us that they could not pay the cost of fixing the truck in prior phone conversations about the issue because they only made $overheadVision Ford implied that we were some how more able to absorb the cost of the engine repairs than they were as a company
Last, from the above response from Vision Ford, they have made it clear that they knew about the engine problems and chose not to make us aware, as seen by their statement: 'This vehicle was priced based on its condition." Not only that, but their statement is completely because of my above points about body rust damage, minor non-life-threatening issues, and engine problemsAs previously stated, we would like $to pay for the repair cost

Response received via fax to Revdex.com -- includes copies of 'Due Bill' 'As Is' / Buyer's Guide disclosures, purchase contract. Scan is attached; text of accompanying letter reads as follows: "ID *** Ms *** contacted Scott ***, a sale representative with Vision Ford Lincoln to...

look for a used Ford Edge. At that time we did not have a vehicle matching her needs but indicated we could try to find the vehicle she was looking for. We located a 2007 Ford Edge for sale at Image Auto Sales in Alexandria MN. After negotiating the wholesale purchase, we provided Ms *** a purchase option for this vehicle with the understanding we are purchasing the vehicle for her and the cost given was "As IS". Below is our timeline of events: 10/29/2015 Ms *** visited the dealership to review the vehicle found. She approved us purchasing the unit for her at the price negotiated and signed a deposit form for the transaction. 10/29/2015 Vehicle purchased for Ms *** from Image Auto Sales 10/30/2015 Vehicle reviewed, driven and purchased by Ms *** "As IS" 11/13/2015 Called indicating there were a few things she wanted checked out on the vehicle. 12/14/2015 Scott *** followed up with Ms ***, she indicated again she was having some issues that need to be addressed. 01/07/2016 Ms *** came into the dealership, handed the keys to Scott indicating she was not keeping the Edge. 01/07/2016 Ms *** opted to exchange her 2007 Ford Edge for the 2005 GMC Envoy. 01/11/2016 Ms *** returned to the dealership indicating something was squeaking. We brought the vehicle into the shop and found the noise was coming from a belt. To fix the issue we replaced a belt and tensioner at our cost. Ms *** indicated she wanted to find another vehicle that was smaller. Scott informed her he would keep an eye out. 01/23/2016 Scott followed-up with Ms *** and was told the repair had taken care of the noise and indicated she would still like to find something smaller without a 3rd row seat. 01/23/2016 to 03/09/2016 Scott has contacted Ms *** to go over additional vehicle options on at least three occurrences. Ms *** was not interested in them. No contact from the customer since that time. 05/06/2016 Letter dated from Revdex.com of Minnesota and North Dakota received 05/11/2016 Letter dated and received from the Office of the Attorney General of ND received. From the initial purchase of the 2007 Ford Edge, we have attempted to satisfy Ms ***. The initial vehicle was purchase for her from another dealer "As Is". Ms *** was given the opportunity to review the vehicle, test drive it and she made her buying decision and took delivery. On Jan 7th, Ms *** entered the dealership and proceeded to demand we take back the 2007 Edge. We discussed her options and offered to assist her into getting a different vehicle. She reviewed the vehicles on the lot and opted for the GMC Envoy. She was provided a deal on the Envoy that would require no additional money out of pocket. Ms *** again accepted this offer and contracted the vehicle. Vision Ford Lincoln reviews the Buyers Guides with all customers and reinforces it throughout the contracting process. Items Attached 2007 Ford Edge: Due Bill -- Indicating no work was promised and unit sold As IsBuyers Guide -- As Is -- No WarrantyBuyers Order -- dealers Disclaimer of Warranty Sold As IS 2005 GMC Envoy Due Bill -- Indicating we would fix the belt squeak nothing else was promised.Buyers Guide -- As Is -- No WarrantyBuyers Order -- Dealers Disclaimer of Warranty Sold As IS  Jeff ***General ManagerVision Ford Lincoln LLC###-###-#######-###-####"
