Dear Ms***I have read your complaint and I have a few questions regarding your concerns as I investigate what happened. 1) How many miles were on your C-Maxx?2) Where did you have your C-Maxx's maintenance performed and can you please provide me with records? (any maintenance that

I am rejecting this response because:I am going to work with you mr m*** as to how to resolve this issuefirst of all mr m***, thank you for your response and all due apologies for the troubleboth I and my mother have met you before and have dealt with you before as I know you do appear at the Alamogordo dealership from time to timemy mother has never had an issue with your dealership and in fact prefers your dealership over any other which is why it's hard to believe that this happened at allI know from knowing you as I and my mother have, this issue would have never happened, so its strange to me it happens all of a sudden.2nd you will find the maintenance records at the Alamogordo dealership, at the *** *** on north white sands blvd in Alamogordo, and at the *** *** on central ave NE in Albuquerquethere at the *** *** we had some brake work done to the carbut as far as engine work its your Alamogordo dealership and *** *** that would have those records.3rd, the car had over miles on the odometerand I know that's a lot for a car for yr ownershipbut during this time I had plenty of medical emergencies with my mother that required the use of the car that muchat one point in this ownership, my mother suffered a mini stroke that went undiagnosed for a while until we found a dr to find out what was happening with her condition. 4th, Charles town was the dealers name that did this but was quoting he put the deal together with victor the supervisorand the whole thing just centered around what to do with the cmaxx at first and get it off the roadwe didn't have the money required for a tow on us right then and there and we reached out to ford to helpfirst we reached out to Darla in service and former dealer frank P*** for helpwe were gonna meet frank in the dealership to speak with Darla about getting the car in on a service charge and make payment arrangements for the tow billreason for this is the car is still under warranty but the warranty service only covers $for a towthe rest is customer responsibilityso we were gonna work that out with Darla with frank by our sidethe original plan was to get the car in and inspect it to see if the warranty would fix the car or scrap it depending on whether or not the cost to fix the car was more than what the car was worththen after that determination, if the car had to be scrapped as a result of the broken engine, see what we could do about trading my mother out of the car so she wouldn't have to be paying for something that is not or would not be in working condition at that pointand that was the over all plan of actionbut that never happenedinstead, sales steps in and tells us that ford is not going to honor the warranty because we cant get it in and is unwilling to help us get it towed in leaving us further stranded in what to do about the cmaxxthen Charles t*** tells us the only way to do this is to stop payment on the car immediately and get herself into another car and default the cmaxx back to the bank and make it the banks responsibility from then onthat's how we ended up with this Hyundai accentCharles t*** said that he and his supervisor deemed this the only plausible solution to this deal which of course hurts my mother in the event she never got the warranty honored and 2nd on that, the car breaks down and she feels she's being faulted and blamed as though to say this is all her fault that the car broke down to begin with as it seems like both dealership and bank are trying to put this whole thing on my mothers shoulder that she owes not only the car but also the damage to the engine and ultimately the tow charge it took to finally get it to el paso where the dealership there was more than happy to try and honor the warranty for the bank, but what about the purchasermy mother is still being charged for this and was told the warranty would not be honored for her unless she got the Hyundai where she would receive the warranty on a used carbut what about the cmaxxwhen we asked to speak with Darla about this, all we got and frank got is that service had nothing to do with the deal or the warranty by Charles t*** who spoke the supervisor backed that wordso my question here is that if the dealership wasn't gonna help her honor the warranty and the bank wasn't going to either, wasn't she in the right to stop the payment until the warranty did get honored instead of being told she had to buy a car and default where the default ends up on her record for something that should have been warrantied? according the the lemon law statute, if a consumer has a warranty and the warranty is not honored, then the carrier of the contract or warranty would be in breach of contractI understand sir that this is not your fault but the breach is not with my mother on this issue I don't believe who now as a result of this is being called on a breach herself in which she's being penalized for non payment when neither one wanted to honor the warranty and left her stranded with a payment for a car that at the time was not functioning due to that blown engineand what makes it worse mr m*** is that the bank also owns the contract to the Hyundai accent in which my mother is being sold that if she doesn't bring herself current with the cmaxx, then due to a cross collateral right the bank reserves, the bank would count both vehicles as repossessed and come and get the Hyundaiwhat that does mr m*** is it takes the cmaxx away from my mother by way of a mechanical failure and dealership and bank refusal to honor the warranty at the timeand payment failure along with default goes on her record as money owed bad creditit also takes the Hyundai away doubling that bad credit recordit also lands her out of a vehicle that she needs for medical purposes and an inability to afford another as to get into another car would require a large down payment she cannot affordfurther more it takes the warranty away from her in which she doesn't see the benefits of the warranty at all throughout this default processand last mr m*** it gives an impression that the bank is using now that my mom is unwilling to pay her payments and gives the impression that she's not willing to keep the car maintained when she did keep up the maintenance and did keep the car paidand in the end with all this coming on her shoulders leaves her with the impression that she just got screwed out of not only her warranty but also her car by way of this one entire deal which is seemingly turning into one big nightmarecan you help her with this? you've shown us yourself we can count on youcan we do that againwhat can we do about his whole situationall due apologies for the trouble sir but I need this straightened out so my mother doesn't have to keep thinking that both the bank and the dealership screwed her on this entire dealthank you mr m*** and hope to hear from you soon
