Unprofessional way of working
Dear Vitakem team,
As a first impression when we start communicating together, we were very excited to start working together as a long term business opportunities between your company and ours after we read about your way of working with clients and the fact that you support your clients and stay step by step with one hand.
But, unfortunately and suddenly, we were trying to connect via many emails and calls but all have been failed due to no response from you!

It seems you are not interesting in building business internationally, but at the end you should inform your client and not to keep them trying and trying for so long.

Review: On June **, 2013, we contracted with Vitakem Neutraceuticals, Inc., of [redacted] to produce our vitamin. Our existing manufacturer was experiencing difficulties and we decided to change. On that day we wired $4,500 as 50% deposit.

Our choice of Vitakem was not because they had the best price as they did not. We chose Vitakem simply because of representations on their website of “fastest turnaround time in the industry 4-6 weeks.” This product had begun to sell very quickly and we were running low.

That guarantee of a 4 – 6 week delivery was confirmed by 2 emails, verbally and on their website. I advised [redacted], [redacted]., we selected his company purely based on that promise. I advised my rep and my sales order so states we were in “dire circumstances” and needed product within 4-6 weeks.

I did not hear from [redacted] again. 30 days later I emailed him requesting a phone call to discuss shipments. He replied a phone conversation was not possible now nor would he respond in writing about their shipping choices.

Over the next week (week 5 from placing order) I left 4 voicemails for [redacted] none of which were returned. Then their [redacted], a [redacted], called and began a shouting tirade that my request for delivery information was premature.

Five weeks into this ordeal, my label proof came and the barcode was incorrect. I asked [redacted] to fix that. He replied “if you want this order to go out soon, sign it as is.” Under duress, I signed knowing the label was incorrect on 2000 bottles.

Over the next 3 weeks (weeks 6 – 9 since placing the order) I sent many emails asking for a delivery date. All were ignored except for 3 that simply said “next week.” At this point it was 9 weeks since order was placed. Finally in desperation we hired an attorney.

Our attorney wrote a letter on August ** demanding to know a delivery date. There was no reply. On my attorney’s advice, we placed an order with another company paying a rush fee and incurring an additional cost of $6,000. My attorney then wrote a letter to [redacted] demanding a return of our initial payment. On August **, a full 10 weeks since the order was placed, [redacted] phoned my attorney saying the product was ready.

[redacted] said there would be no “refund” because the product was ready. He then charged us for an “overage” of 100 bottles for an extra $450.00. He held the product hostage until payment was made. His initial invoice charged a freight fee of $785. I decided to arrange freight myself and the fee was $505.

Because of the delay of 4 weeks, we lost $40,000 in sales; we incurred an additional $6,000 to order from another company; attorney’s fees of $600; loss in sales; damage to brand, inability to refill orders; my company and product’s reputation irreparably harmed.

We anticipate losing an additional $40,000 in sales as we have to begin marketing again to bring sales back up and repair substantial damage from not being able to refill orders. Additionally, the labels are wrong on 2000 bottles and we have to incur the cost of having labels printed and placed over the wrong barcode.Desired Settlement: At the very least, I expect Vitakem to return $9,459 paid for a product that has cost us $40,000 loss in sales, damage to brand and reputation; additional costs to correct labeling.

Vitakem prides itself on delivering a quality product and immediately addressing any and all customer complaints immediately. Therefore, we are concerned that we did not receive notice of this complaint when it was received. Nonetheless, we welcome the opportunity to respond.

[redacted]’s relationship with Vitakem began in June of 2013. The initial production of the

product was delayed from the outset because [redacted] repeatedly changed her mind regarding aspects of the product. This is certainly her right, and we tried to accommodate her. However, it of course slightly slowed down production. These issues were minor and the production delay was short. See emails regarding these issues. At this time, our relationship with [redacted] was fine and she seemed content. Her attitude completely changed when she was notified by [redacted] that her product that she had manufactured elsewhere was expiring, and that they would be returning her expired product. Of course, we had nothing

whatsoever to do with the existing product or her relationship with [redacted]. It quickly became apparent that losing her presence on [redacted] had an adverse effect on her business, and she seemed to be holding Vitakem responsible for this. [redacted] supplied us with ready artwork which included a bar code. At the fifth week mark, we sent her a proof to sign off on which included the bar code she supplied. She then notified Vitakem that she wanted to change the label. She now decided that the three bottle sale did not need the barcode incorporated into the label. She now wanted the bar code to go on the outside of each shrink wrapped unit, since [redacted] would otherwise refuse delivery. She had done business with [redacted] before, by her own admission, and yet didn’t notify Vitakem of this request until the last minute. This was not part of the initial agreement. See emails annexed hereto. After about two weeks she agreed to sign off on the original label. The product was completed and readied for shipment. See the annexed document. The product was picked up by her trucking company on August **.
