To this end, we’re committed to providing the best possible customer service—and maintaining a simple, transparent checkout process.When Mr. [redacted] selected tickets and was taken to our checkout page, they were directed to review their itemized order breakdown, which clearly displayed all fees, any ticket disclosures (including limited view), the price per ticket, and the total price in bolded text. Mr. [redacted] was then directed to review our terms and conditions—visible in a text box below this order total—and presented with the bolded message “All sales are final.” At this point, Mr. [redacted] was also presented with the message “I agree to the sales terms and conditions above,” and a check box that needed to be selected in order to continue with checkout. After checking the box and clicking “Review Order” they are taken to the checkout page which features an even more in-depth order summary that displays any ticket disclosures, the number and prices of their tickets, delivery and service fees, and the total charge.As a secondary marketplace, Vivid Seats is not directly affiliated with any artist or venue and does not generate tickets as a primary box office; rather, we act as an intermediary between fans and ticket holders. The prices of tickets on our site are set by the individual ticket sellers, not Vivid Seats, in accordance with their assessments of a range of market factors such as customer demand. This means that ticket prices can fluctuate at any time, and sellers are notified as soon as an order is placed. This practice is disclosed and made transparent throughout our website and the order process. Because customers are purchasing tickets owned and listed by individual resellers, we must ensure our policies are fair to both parties. This means that we are unable to offer refunds and must enforce an “all sales are final” policy—a standard throughout the industry. This policy is described in detail in our Sales Terms and Conditions (www.vividseats.com/terms.html) and during checkout, where the following message is displayed directly above a box that customers must check to authorize the purchase: “To complete your order, you must agree to the Vivid Seats sales terms and conditions and confirm that you are aware that you may be paying above face value for your tickets. All prices in US Dollars. All sales are final.”We have been in contact with Mr. [redacted] regarding this issue, but have been unable to reach an amicable resolution. As we have thoroughly clarified that the release date of tickets is dependent upon the primary issue, the estimated Ship Date of 10/24/2017 was stated prior to purchase, and we have attempted to resolve this matter by updating the shipping address to accommodate our customer's travel arrangements. Per our sales policy, “Vivid Seats will use commercially reasonable efforts to procure and timely deliver the exact tickets ordered. If those tickets are no longer available, Vivid Seats reserves the right to replace tickets with comparable or upgraded tickets, at Vivid Seats reasonable discretion.” As both sections are considered to be in the 300 level of the venue, Mr. [redacted]'s order was filled in accordance with these sales terms.Nevertheless, we have discussed this matter with Mr. [redacted] and offered two resolutions in the interest of providing exceptional customer service. As such, we are pleased to have reached an amicable resolution for both parties. This process provides customers with multiple opportunities to review the details of their order. Our site is completely user-driven and all order details are either selected or input by the customer. After selecting the event they were interested in, they continued to the ticket listing page. Next, our customer was provided an interactive drop down box to select the quantity which they desired to purchase. Once selected, our customer continued to the Login page which restated their order summary and another drop down box to adjust the quantity desired. Continuing through checkout our customer was brought to the final page. Here, they were presented with an in-depth itemized order breakdown which displayed the number and prices of their tickets, delivery and service fees, and the total charge of $258.75 highlighted in bold text. A final drop down box was presented to modify the quantity of tickets our customer wished to purchase. At this point, our customers are presented with the message, “I agree to the Vivid Seats terms and conditions,” and a check box that must be selected in order to continue with checkout. Our sales policies, including our “all sales are final” policy, are disclosed throughout the purchase process and displayed at checkout with the message, “To complete your order, you must agree to the Vivid Seats sales terms and conditions and confirm that you are aware that you may be paying above face value for your tickets. All prices in US Dollars. All sales are final.” Directly above the “Place Order” button, our customer’s order total was reiterated with the bold statement: “By clicking ‘Place Order,’ your [redacted] account will be charged $258.75.” Our customer then proceeded to select “Place Order”, at which time their order was complete.Because our customers are purchasing tickets owned and listed by individual resellers, we must ensure that our policies are fair to both parties. This means that we are typically unable to offer refunds and must adhere to an “all sales are final” policy—a standard throughout the industry. Nevertheless, as a one-time courtesy stepping outside of the agreed-to terms, we provided our customer with an amicable resolution in the interest of customer service. Directly below this in-depth order summary, Ms. [redacted] was also presented with her order total of $1,537.50 highlighted in bold, red text prior to entering any payment information. At this point, Ms. [redacted] was also presented with the message “I agree to the Vivid Seats terms and conditions,” and a check box that needed to be selected in order to continue with checkout. Directly below this Ms. [redacted]’s order total was reiterated, “By clicking ‘Place Order,’ your credit card will be charged$1,537.50.” Our sales policies, including our “all sales are final” policy, are disclosed throughout the purchase process and displayed at checkout with the message “All sales are final. All prices are listed in US Dollars (USD).” Because our customers are purchasing tickets owned and listed by individual resellers, we must ensure that our policies are fair to both parties. Our sales policies, including our “all sales are final” policy, are disclosed throughout the purchase process and displayed at checkout with the message, “To complete your order, you must agree to the Vivid Seats sales terms and conditions and confirm that you are aware that you may be paying above face value for your tickets. All prices in US Dollars. All sales are final.” Our customer then proceeded to select “Place Order”, at which time their order was complete.Because our customers are purchasing tickets owned and listed by individual resellers, we must ensure that our policies are fair to both parties. This means that we are unable to offer refunds and must adhere to an “all sales are final” policy—a standard throughout the industry.Although our customer has indicated tickets were not delivered, this is inaccurate. This order was placed on 7/17/2017 11:49 AM CST and our customer’s tickets were transferred at approximately 7/19/2017 12:14 PM CST prior to their event on 9/16/2017 to the associated email address on file. As tickets were delivered in accordance with our 100% Buyer Guarantee, we consider this matter closed. After Ms. [redacted] entered an email address to create an account, she then navigated to the Checkout page, which featured an even more in-depth order summary that displays the number and prices of her tickets, delivery and service fees, and the total charge of $1,093.32 highlighted in bold, red text prior to entering any payment information. At this point, Ms. [redacted] was also presented with the message “I agree to the Vivid Seats terms and conditions,” and a check box that needed to be selected in order to continue with checkout. Directly below this Ms. [redacted]’s order total was reiterated, “By clicking ‘Place Order,’ your account will be charged $1,093.32.” Our sales policies, including our “all sales are final” policy, are disclosed throughout the purchase process and displayed at checkout with the message “All sales are final. All prices are listed in US Dollars (USD).” Because our customers are purchasing tickets owned and listed by individual resellers, we must ensure that our policies are fair to both parties. As we have thoroughly addressed, Vivid Seats maintains that all pricing and order details were presented to Mr. and Ms. [redacted] prior to placing their order. No order can be placed without the customer having been presented with this information and agreeing to our sale terms. Though Mr. and Ms. [redacted] have indicated that they have not received their valid tickets, as we have previously clarified, these tickets were sent immediately after placing their order on 12/13/2016. As a courtesy, we re-sent these valid tickets on 1/23/2017 to the email address on file. As we have fully addressed their concerns and attempted to resolve this matter, we currently consider this matter closed.
