reviewed the information provided by Ms. [redacted] and appreciate the opportunity to respond. In her complaint, Ms. [redacted] states that her alarm went off and she was not notified. She called in to very why the alarm did not go off and was told it was a lost communication. Ms. [redacted] is requesting cancellation of her services without penalty.   Vivint’s records show that Ms. [redacted]’s system was fixed on August 29, 2016. Vivint will apply a two (2) month credit towards Ms. [redacted]’s account to cover the time she was without service.Vivint’s records indicate that Ms. [redacted] signed her System Purchase and Service Agreement (“Agreement”) on April 30, 2014. By signing her Agreement, she understood and agreed to the following: Section 4: “We do not warrant that the system will always detect, or help prevent, any burglary, fire, hold-up or any other such event. We do not warrant that the system cannot be defeated or compromised or that it will always operate.”Section 12: “You will test the system’s protective devices and send test signals to the Center in accordance with our instructions at least monthly. If a problem in the System occurs you will notify us.”Due the information above, cancellation without penalty is not warranted. Should Ms. [redacted] wish to cancel her Agreement prematurely, her payoff amount would be $1025.81; however, in an effort to assist Ms. [redacted], Vivint is willing to reduce her payoff amount by 50%, bringing the total payoff amount to $512.90. She is requesting immediate cancellation without penalty.At this time, cancellation without penalty is not warranted. If Ms. [redacted] would like to buyout the remainder of her contract or arrange an account takeover, she may contact Vivint’s representatives for assistance.   Vivint’s records show that on September 20, 2016, Ms. [redacted] signed a Purchase and Services Agreement with Vivint, with an initial term of forty-two (42) months. By signing this contract, Ms, [redacted] represented that she understood and accepted the terms. In addition to signing a contract with the term length outlined, Vivint has record of Ms. [redacted] completing the mandatory Pre-Install survey that Vivint requires of all customers prior to entering into an agreement with them. 2014 To Whom It May Concern: I have reviewed the information provided by Ms. [redacted] and appreciate the opportunity to respond. In her complaint, Ms. [redacted] alleges that she thought she had cancelled her agreement with Vivint upon moving out of her home.  Ms. [redacted] recently noticed that Vivint has been withdrawing payments from her bank account since August 2014, and this has caused fees from her bank.  Ms. [redacted] desires cancellation of her agreement without penalty, a refund of payments made since August 2014, and a refund of $25.00 she paid to her bank to stop payments.Vivint’s records show that on June 5, 2010, Ms. [redacted] signed a Purchase and Services Agreement with Vivint, with an initial term of forty-two (42) months.  Vivint spoke with Ms. [redacted] regarding her alarm service on January 27, 2014.  Ms. [redacted] represented that she was interested in cancelling her current agreement and resuming service after six (6) months, as her home was being torn down.  Based upon this representation, Vivint offered a forty-two (42) month extension of Ms. [redacted]’s agreement in exchange for six (6) free months of service and a free installation of a new system in her new home.  Ms. [redacted] agreed to this arrangement.  Indeed, Vivint read the following statement, after which Ms. [redacted] responded affirmatively:You understand that this call is being recorded, and you agree to extend the term of your agreement forty-two months from today.  No other provisions of your agreement have been changed and this amendment constitutes the new agreement between you and Vivint. Ms. [redacted] was not charged for service for the next six (6) months, as agreed.  Billing resumed in August 2014, but Ms. [redacted] did not contact Vivint to initiate the installation of her new system.  A representative has recently contacted Ms. [redacted], in an effort to resolve this matter.  To assist Ms. [redacted], Vivint has agreed to cancel the extended Agreement, and will refund two (2) monthly payments, in the amount of $[redacted].  A check is being sent to the mailing address on file to fulfill this refund.  Ms. [redacted] has no further obligation to Vivint.  No further refund is warranted.If you have further questions or concerns regarding this response, please respond to either our mailing address: 4931 North 300 West, Provo, Utah 84604, or fax number: [redacted], attention Department 160 – Legal. have reviewed the information provided by Ms. [redacted] and appreciate the opportunity to respond. In her complaint, Ms.
[redacted] alleges that
she experienced equipment issue with her system that were not resolved by
Vivint. As such, Ms. [redacted] cancelled her account with Vivint,
but still continues to be charged. Ms. [redacted] desires the cancellation of the
account without penalty and a refund of charges made after cancellation
request. Vivint’s
records indicate that prior to the installation of any equipment; Mr. [redacted]
[redacted] completed a telephonic Pre-Installation Survey with Vivint’s Account
Creation department. Every customer must complete this Pre-Installation Survey,
and if a customer does not pass the survey, Vivint will not enter into an
agreement with the customer and will not install any equipment in the
customer’s home.  The purpose of the
survey is to verify certain information, ensure that the customer understands
Vivint’s offer, and confirm the terms and conditions of the Agreement. Our
records show that Mr. [redacted] completed the required Pre-Installation
Survey on July 25, 2012.  During
the recorded Pre-Installation Survey, Mr. [redacted] represented that he
understood and agreed to the initial term of forty-two (42) months.  She also represented that he would pay a
monthly monitoring fee of $[redacted] each month during that term.  Further, Mr. [redacted] represented that
these terms were clearly outlined on the Agreement and that Vivint’s
representative did not make any promises or commitments which were not written
on the Agreement.  Vivint relied on Mr.
[redacted]’s representations to ensure that he understood his commitments
to Vivint as outlined in the Agreement.  
  Ms.
[redacted] notified Vivint of equipment concerns on June 3, 2015. Ms. [redacted]
explained it was a low battery alert. On June 7, 2015, Mr. [redacted] reported
a concern with false alarms. Vivint was able to schedule an appointment for
June 29, 2015. On June 29, 2015, a Vivint field service professional was
dispatched to Ms. [redacted]’s restaurant. The field service professional was told
that the service appointment was no longer needed and everything was working. On
July 22, 2015, Mr. [redacted] called Vivint in order to cancel the account.
Mr. [redacted] was informed that the account was still under the initial
term of the agreement. Mr. [redacted] informed the representative he had
another company installed. Cancellation
of Ms. [redacted] account is not warranted at this time, however Vivint would like
to assist Ms. [redacted]. If Ms. [redacted] agrees to pay the past due balance of
$[redacted], Vivint will agree to cancel her account and forgive the remaining
three (3) months of her agreement. If Ms. [redacted] wishes to take advantage of
this offer, I would advise her to contact Customer Loyalty at ###-###-####.  If

  To Whom It May Concern:I have reviewed the information provided by Ms. [redacted] and appreciate the opportunity to respond. In her complaint, Ms. [redacted] alleges that she had issues with her equipment that led to multiple false alarms and false alarm fees from her city. Ms. [redacted] desires compensation from Vivint in the amount of $1,175.00, to be sent to her city for these fees. Vivint’s records show that Ms. [redacted] signed an agreement with Vivint on June 21, 2007, in which she agreed that she would be responsible for any false alarm fees charged by an outside agency (Section 10, System Purchase and Services Agreement), and that Vivint could not warrant equipment installed by another alarm company.  This Agreement was renewed and extended by Ms. [redacted] most recently on December 17, 2014.After review of the alarm events in question, Vivint’s records show that the alarms were triggered by sensors previously existing in the home and not installed by Vivint.  Pursuant to the signed Agreement, compensation for any false alarm fees charged to Ms. [redacted] by a third party is not warranted.  Vivint offered a service visit to replace these sensors at no cost on November 25, 2015; however, this visit was not completed.  A representative from Vivint has attempted to contact Ms. [redacted], in an effort to resolve these concerns.  To assist Ms. [redacted] at this time, Vivint is willing to either cancel her Agreement without penalty as she has recently requested, or apply a credit to her Vivint account to cover four (4) months of service.  Vivint also remains willing to replace Ms. [redacted]’s third party sensors at no cost to her.  If Ms. [redacted] would like to accept one of these offers, she may contact Vivint’s representative directly, or she may call Vivint’s Customer Care department at ###-###-####.If you have further questions or concerns regarding this response, please respond to either our mailing address: 4931 North 300 West, Provo, Utah 84604, or fax number: ###-###-####, attention Department 160 – Legal. I am rejecting this response because: Vivint breached out contract by failing to close my father's account for two years despite numerous requests by me to close it. Additionally, Mr. W[redacted]'s response fails to mention that Vivint not only incorrectly damaged my father's credit by sending the account to collections for 9 months, but the company kept $250 that should've been refunded to us in September 2014.As this has taken two years and an email to Vivint's CEO to even get this far, and Vivint's actions were deceptive and deceitful by keeping money due to us for two years AND sending the account to collections, I want my account closed ASAP with no early termination fee. This is the third time I've asked for my account to be closed this week. Vivint continues to drag this out despite my making this request in writing three times now. If the company refuses to waive the early termination fee despite its obvious and blatant errors, I want to know how much the early termination fee is--in writing--MINUS the $250 the company owes my family, and I intend to contact the state attorney general next regarding the company's deceptive business practices.

information provided by Ms. [redacted] and appreciate the opportunity to respond. In his complaint, Ms. [redacted] alleges that she was misled by a Vivint representative regarding contract terms, and now is unable to cancel her agreement.  Ms. [redacted] desires cancellation of the Agreement without penalty.  Vivint’s records indicate that prior to the installation of any equipment, Ms. [redacted] completed a telephonic Pre-Installation Survey with Vivint’s Account Creation department.  Every customer must complete this Pre-Installation Survey, and if a customer does not pass the survey, Vivint will not enter into an agreement with the customer and will not install any equipment in the customer’s home.  The purpose of the survey is to verify certain information, ensure that the customer understands Vivint’s offer, and confirm the terms and conditions of the Agreement. Ms. [redacted] requests that her account be removed from collections.  In an effort to assist Ms. [redacted], Vivint has agreed to remove her account from collections. However, Vivint’s records indicate that attempts were made by Vivint to assist Ms. [redacted] with her technical issues. On December 8, 2015, Vivint offered to send out a technician to fix the system. However, Ms. [redacted] wanted to wait until she could afford an outdoor camera for a technician to come out to her residence. On April 27, 2016, Ms. [redacted] contacted Vivint again stating that she was still experiencing issues with the system. He claims that Vivint’s technicians did not show up to scheduled appointments, and is requesting cancellation without penalty or a free year of full service. At this time, Vivint is willing to extend the offer to two months of free service. Cancellation without penalty is not currently warranted. Vivint’s records show that an appointment to finish the installation and test the system was completed at Mr. [redacted]’ home on May 11, 2017. This appointment was able to be completed outside of regular business hours due to the technician offering to pick up overtime. In her complaint Ms. J[redacted] alleges that her equipment would not work properly and there were holes left in her home after the removal of the Vivint equipment. Ms. J[redacted] desires cancellation of the Agreement and a refund of monies paid to Vivint. A representative from Vivint has recently attempted to contact Ms. J[redacted] in an effort to resolve her concerns. Vivint’s records indicate that Ms. J[redacted]’s account has been cancelled and a full refund of Monies paid to Vivint has been sent to Ms. J[redacted] in the form of a check. I would advise Ms. J[redacted] to contact Vivint’s Home Damage department to resolve the holes in her wall from the equipment removal. reviewed the information provided by Mr. [redacted] and appreciate the opportunity to respond. In his complaint, Mr. [redacted] states the system was not correctly installed, and the system as a whole has not worked since the initial installation. Mr. [redacted] desires for the account to be cancelled with no penalty.A representative from Vivint recently attempted to contact Ms. [redacted] in an effort to resolve these concerns. At this time Vivint is willing to cancel Mr. [redacted]’s account without penalty provided he return the equipment which was installed in his home.  Vivint records indicate that the most recent technician to Visit Mr. [redacted]’s home indicated that the system was functioning properly when he left the home. Vivint is able to provide continued technical and service support.Despite the above information, in resolution to this matter, Vivint agrees to the above resolution. Mr. [redacted]’s Agreement will be cancelled once the equipment has been removed and he will have no further contractual obligation to Vivint. the information provided by Ms. [redacted] and appreciate the opportunity to respond. In her complaint, Ms. [redacted] states that she was misled by a Vivint representative regarding contract terms, and now is unable to cancel her agreement.  Ms. [redacted] desires cancellation of her Agreement without penalty. Cancellation of Ms. [redacted]’s agreement without penalty is not warranted at this time. Vivint’s records indicate that Ms. [redacted] signed a System Purchase and Services Agreement on August 20, 2015 with an initial term of sixty (60) months, a monthly services fee of $49.99, plus any applicable taxes, during that term. Vivint provides a Right of Rescission period immediately following installation of the equipment, during which time a customer may cancel the Agreement for any reason, and this period is extended for elderly customers.   Should Ms. [redacted] wish to cancel her agreement prematurely, her payoff amount would be $1,499.70; however, in an effort to assist Ms. [redacted], Vivint is willing to lower her payoff amount by 55%, bringing the total payoff amount to $674.86.  Alternately, Ms. [redacted] has been offered a reduced monthly rate by $10.00 for the remainder of her initial term.  If Ms. [redacted] wishes to take advantage of either of these offers, I would advise her to contact Vivint’s Customer Loyalty department at 1-800-216-5232.If you have further questions or concerns regarding this response, please respond to either our mailing address: 4931 North 300 West, Provo, Utah 84604, or fax number: (801) 765-5759, attention Department 160 – Legal.
