the information provided by Ms. [redacted] and appreciate the opportunity to respond. In her complaint, Ms. [redacted] alleges that she agreed to a monthly service of $14.50 with Vivint, but Vivint is charging her $47.80. Ms. [redacted] desires the cancellation of her account without penalty.   Vivint’s records indicate that prior to the installation of any equipment; Ms. [redacted] completed a telephonic Pre-Installation Survey with Vivint’s Account Creation department. Every customer must complete this Pre-Installation Survey, and if a customer does not pass the survey, Vivint will not enter into an agreement with the customer and will not install any equipment in the customer’s home. The purpose of the survey is to verify certain information, ensure that the customer understands Vivint’s offer, and confirm the terms and conditions of the Agreement. Our records show that Ms. [redacted] completed the required Pre-Installation Survey on July 15, 2015.  During the recorded Pre-Installation Survey, Ms. [redacted] represented that she understood and agreed to the initial term of sixty (60) months.  She also represented that she would pay a monthly monitoring fee of $44.99 each month during that term plus any applicable taxes.  Further, Ms. [redacted] represented that these terms were clearly outlined on the Agreement and that Vivint’s representative did not make any promises or commitments which were not written on the Agreement.  Vivint relied on Ms. [redacted]’s representations to ensure that she understood her commitments to Vivint as outlined in the Agreement.    Cancellation without penalty is not warranted at this time. Should Ms. [redacted] wish to cancel her Vivint agreement prematurely, she may pay off the remaining balance on her account – currently $[redacted], however Vivint will take 25% off the payoff amount, bringing it to $[redacted]. Mr. [redacted] desires a shingle on his roof replaced rather than repaired. Vivint’s sent a handyman to Mr. [redacted]’s residence on September 20, 2016. The handy man filled a hole in Mr. [redacted]’s roof and determined that the repair would be sufficient. Although the handyman left excess putty on Mr. [redacted]’s roof the damage has been repaired and the issue is now cosmetic. Vivint is willing to repair any damage done to a home. the information provided by Ms. M[redacted] and appreciate the opportunity to respond. In her complaint, Ms. M[redacted] alleges that she cancelled her Vivint system two years ago, but continued to be drafted by Vivint. Ms. M[redacted] now desires the cancellation of her account and the refund monies paid to Vivint during the past two years. Vivint’s records indicate that prior to the installation of any equipment; Ms. M[redacted] completed a telephonic Pre-Installation Survey with Vivint’s Account Creation department.  Every customer must complete this Pre-Installation Survey, and if a customer does not pass the survey, Vivint will not enter into an agreement with the customer and will not install any equipment in the customer’s home.  The purpose of the survey is to verify certain information, ensure that the customer understands Vivint’s offer, and confirm the terms and conditions of the Agreement. Our records show that Ms. M[redacted] completed the required Pre-Installation Survey on March 17, 2009.  During the recorded Pre-Installation Survey, Ms. M[redacted] represented that she understood and agreed to the initial term of sixty (60) months.  She also represented that she would pay a monthly monitoring fee of $[redacted] each month during that term. Further, Ms. M[redacted] represented that these terms were clearly outlined on the Agreement and that Vivint’s representative did not make any promises or commitments which were not written on the Agreement.  Vivint relied on Ms. M[redacted]’s representations to ensure that he understood her commitments to Vivint as outlined in the Agreement.   Ms. M[redacted]’s original agreement with Vivint ended March 2014. At that time Ms. M[redacted]’s account continue with Vivint on a month to month basis. During this time, Ms. M[redacted] could request cancellation of her Vivint service with a written notice thirty (30) day prior to her desired cancellation date (Section 2.4). Vivint has no record of a written notice of cancellation for Ms. M[redacted]’s account until June 16, 2015. Vivint cancelled Ms. M[redacted]’s agreement on July 16, 2015.A representative from Vivint has recently contacted Ms. M[redacted], in an effort to resolve these concerns. A refund of two years of Vivint’s service fee is not warranted at this time, however in an effort to assist Ms. M[redacted], Vivint has agreed to refund her a total of $[redacted] to the credit card Vivint has on file. information provided by Mr. and Ms. [redacted] and appreciate the opportunity to respond. Vivint’s records show that Mr. and Ms. [redacted]’s Agreement with Vivint has been cancelled and they have no further contractual obligation to Vivint.Vivint’s records indicate that Mr. [redacted] signed a System Purchase and Services Agreement on May 11, 2013 with an initial term of sixty (60) months, a monthly services fee of $68.99, plus any applicable taxes, during that term.   Our records show that Ms. [redacted] contacted Vivint on June 13, 2014 to inform Vivint that she was unable to transfer her Vivint security system into her rental home. Vivint’s moves policy states:“If you have been a customer for at least a year and you sign a new agreement for your new residence, the moving fee will be waived. If you choose to remain under your current agreement, you will be charged a $99 move fee. If you have been a customer for less than a year, a $99 move fee will be charged. Vivint will provide you with a “like for like” system in your new residence, meaning we will provide the same number of protection points.” A written notice of cancellation was provided by Mr. and Ms. [redacted] on February 16, 2017. reviewed the information provided by Ms. [redacted] and appreciate the opportunity to respond. In her complaint Ms. [redacted] states that her husband was misled by Vivint’s sales rep regarding Vivint’s affiliation with her previous alarm company and the monthly cost of Vivint’s service. Ms. [redacted] desires Vivint to reduce her monthly rate to $32.99 to match her previous provider, a refund of her activation fee of $159.00 and a refund of $144 for four months of service paid at the monthly rate of $60.99. Before any customer enters into a System Purchase and Services Agreement (“Agreement”) with Vivint, and prior to the installation of any equipment, the customer must complete a telephonic Pre-Installation Survey with Vivint’s Account Creation department. If a customer does not pass the Pre-Installation Survey, Vivint will not enter into an Agreement with the customer and will not install any equipment in the customer’s home. The Purpose of the survey is to verify certain information, ensure that the customer understands Vivint’s offer, and confirm that terms and conditions of the Agreement. During the Pre-Installation Survey, Mr. [redacted], who is an account holder, represented that he understood and agreed that his Agreement has an initial term of forty-eight (48) months and that he would pay a monthly service fee of $69.00 plus any applicable taxes each month during that term. He further represented that the representative did not make any promises or commitments to him that were not provided on the Agreement. Mr. [redacted] also represented that he understood that his sales representative was a member of [redacted], an authorized dealer of Vivint, and that [redacted] and Vivint were not affiliated with any other alarm company. Vivint relied on Mr. [redacted]’s representations during this survey and, based upon his representations, entered into an Agreement with him and installed an alarm system in his home. Due to Mr. [redacted]’s representations during the Pre-Installation Survey, manipulation of the Agreement terms to match Ms. [redacted]’s previous alarm contract is not warranted. reviewed the information provided by Ms. [redacted] and appreciate the opportunity to respond. In her complaint, Ms. [redacted] states that she decided to cancel her system within her trial period, but Vivint did not have any appointment that worked with her schedule to remove the system. Ms. [redacted] desires a refund of all payments made to Vivint, and an additional credit of $248.00 for the time she had to take off of work.  Although Vivint attempts to provide customers with appointments that are convenient, some areas are unable to provide weekend or late hour appointments. The field service professionals in Ms. [redacted]’s area that have the approval to remove a system were only available during weekdays until 6:00 PM. Records indicate a field service professional was dispatched to Ms. [redacted]’s home and was able to remove all of Vivint’s equipment on August 11, 2016. Compensation for time off of work is not warranted. Vivint’s records indicate that a refund in the amount of $223.99 is being sent back to the checking account on file, to refund the monies paid to Vivint by Ms. [redacted]. This refund was submitted on August 10, 2016 and may take up to 14 days to be reflected on the bank account.       Date of Addendum: March 15, 2017 To Whom It May Concern: I have reviewed the information provided by Mr. [redacted] and appreciate the opportunity to respond. In his complaint, Mr. [redacted] states that he was manipulated into extending the term of his agreement over the phone with Vivint and that now he is unable to cancel his agreement. He further states that he has signed a contract with a different home security company. Mr. [redacted] desires cancellation of his agreement without penalty.At this time, Vivint agrees to cancel Mr. [redacted]’s Agreement without penalty, effective immediately.Vivint’s records show that on May 16, 2012 Mr. [redacted] signed a Purchase and Services Agreement with Vivint, with an initial term of forty-two (42) months. She states that Vivint did not receive authorization from the homeowner to install the system and that the technician did not receive authorization for the pre-existing system to be removed. At this time, Vivint will not be replacing the pre-existing system as Vivint is not liable for another company’s equipment.  It is Vivint’s position that the responsibility of gaining authorization to install equipment in a rented residence falls to the customer, not to Vivint. Vivint will not contact a potential customer’s landlord to seek permission to set up an account.
